Burt, City Administrator AGENDA NO. ATTACHMENTS: APPROVED BY: Julie Lenertz of Brockway Golf Club has submitted an application for an on-sale wine license. She currently holds a 3.2%malt liquor license. She wants the wine license so she can sell strong beer rather than 3.2%beer. Rosemount City Code states that a holder of an on-sale wine license who is also licensed to se113.2%beer on-sale and whose gross receipts are at least 60% attributable to the sale of food may sell strong beer without an additional license. According to Ms. Lenertz, Brockway Golf Club meets the 60%provision; and if granted the wine license, she would have to attest to this each year at renewal time. This application for on-sale wine is similar to Tops Pizza,which was granted the on-sale wine so that he could sell strong beer. The City Code also states that on-sale wine licenses must be issued only to restaurants meeting the qualifications of M.S. 340A.404, subd. 5. This law states that restaurants must have seating for at least 25 guests at one time. Ms. Lenertz advised she also meet this requirement. Her menu at the clubhouse consists of burgers, hot dogs, chips, muffins, candy bars, and soft drinks. Sue has discussed this application with Attorney LeFevere who feels the applicant meets the provisions of the City Code and State Statutes. The public hearing is scheduled for May 4, 1999. The notice will be placed in the paper on Apri123, 1999. Recommended Action Notes:
