Plan Land Use Desig.: General Industrial Current Zoning: Agriculture Requested Zoning: General Industrial Planning Cornmission Action: Unanimous Recommendation of Approval SUMMARY Mr. and Mrs. Fischer are requesting approval of a lot division, rezoning and site plan review for a truck terminal that will occupy 14.24 acres and operate out of a 10,000 sq. ft. building. The property will be subdivided from a larger approximately 50 acre paxcel owned by Marlin and Joanne Rechtzigel. The property is now in the Metropolitan Urban Service Area(MUSA) and the site will be expected to be connected to available sewer and water. The Planning Commission conditionally approved the site plan review after conducting a public hearing on June 10, 1997. The Commission also recommended approval of the division and rezoning. LOT DIVISION The division is exempt from platting requirements given the Agricultural Zoning. Therefore, a metes and bounds subdivision is being processed. In any event, the 14.24 acre parcel exceeds a11 zoning requirements of both the Agriculture and the General Industrial District. The survey does not show a frontage road that is recommended by a Highway 52 Task Force Study prepared by Short Elliott Hendrickson(SEH). The frontage road system in this area will ultimately provide access to CSAH 42 and TH 55. This will substitute for what will ultimately be closed access to STH 52/ 56. The Minnesota Department of Transportation will review the division and have opportunity for comment. The proposed 14.24 acre parcel is wide enough for the developed site area, an 80 foot wide frontage road and the existing 50 ft. Enron pipeline easement. REZONING The entire property from CSAH 42 to 140th Street and beyond is guided for General Industrial use. Therefore, the rezoning will be in conformance with the Comprehensive Guide Plan. Subsequent to the rezoning, the truck terminal is a permitted use in the General Industrial District. RECOMMENDED ACTION: Motion to adopt a Resolution Approving an Agricultural Lot Division Requested by Marlin and 7oann RechtzigeL - and - Motion to Adopt an Ordinance rezoning the 14.24 acre parcel from Agriculture to General Industrial in conformance with the Com rehensive Guide Plan. ' CITY COUNCIL ACTION: ' -_ _ _ _--- '� CITY OF ROSEMOUNT � R�,� DAKOTA COUNTY,MINNESOTA � RESOLUT'ION 1997- A RESOLUTION APPROVING AN AGRICULTURAL LOT DIVISION REQUESTED BY MARLIN AND JOANN RECHTZIGEL WHEREAS, the Planning Department of the City of Rosemount received an application for approval of a division of property in the Agricultural District, said property legally described as: The north 1089.00 feet of the West Half of the NoRhwest Quarter of Section 30, Township 115, Range 18, Dakota County, Minnesota, except the west 500.00 feet thereof. Subject to all reservations, restrictions, and easments of record. Containing 13.24 acres. WHEREAS,the Planning Commission of the City of Rosemount conducted a public hearing on June 10, 1997, as required by the subdivision ordinance for the purpose of receiving testimony regarding the requested Agricultural division; and, WHEREAS,the Planning Commission adopted a motion to recommend approval of the Agricultural division to the City Council with conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission on June 17, 1997. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A [insert legal description] Parcei B [insert legal description) BE IT FURTHER RESOLVED, the approval of this subdivision is subject to: I 1. Incorporation of recommendations regarding easements and right-of-way for frontage I road use by the Public Works Department. 2. Payment of one unit of Park Dedication and GIS fees at the rate established by the current Fee resolution. 3. Approval as necessary or incorporation of comments by the Minnesota Department of Transportation. Resolution 1997- 4. Execution of an agreement securing public infrastructure improvements, including connections to sanitary sewer and city water.
