During snowplow operations on November 15, 1996 a City snowplow hit a decorative rock
base and light pole in the entrance to the LeForet Addition. The conditions were extremely icy
at that time and the operator slid down the hill towards Diamond Path road and hit the entrance
monument. The accident was reported and an insuran�e claim was filed on November 18. Rick
Cook, Superintendent, and myself visited the site on Monday the 18th and took pictures. On
December 2, the City received a letter (attached) from the League of Minnesota Cities
insurance Trust stating that they would not make payment for damages. Their reasoning was
that the City was not liable for the damages because the structure is within the City's right of
way. In addition, the City's coverage doesn't insure the monument and light because the City
is not the owner. Since receiving this letter we have discussed the situation with the City
attorney and the insurance trust. Hopefully we will get an indication soon that the City's
insurance will reevaluate and cover the damages.
In April we contacted a contractor to obtain a proposal to repair this monument. His work
would amount to approximately S 1500. This does not include any electrical work. We have
contacted Dakota Electric and believe that they will replace the light but they have not
determined a cost. Staff estimates this cost to be at least another S 1000 to 52000.
As explained in my letter to the residents of the LeForet Addition dated June 2, staff feels that
if the monument is to be replaced that it should be constructed in such a manner to minimize
future accidents and the City's and LeForet homeowners liability. If someone had gotten hurt
due to a collision with this monument tor the other two monuments in the right of way) it is
possible that the City and the homeowners would be held liable for the placement of these
structures.
The City attorney and myself will be available for questions at the meeting. The Gouncil has
several options available to them. Staff could be directed to replace the monument to it's
original condition. Staff could be directed to investigate other options for constructing the
monument to minimize future accidents; or staff could investigate whether or not the structure
should even be reconstructed at all within the City right of way.

Re: Entrance Monument to LeForet
To Whom lt May Concern:
Thank you for your questions regarding the entrance monument to the LeForet
Subdivision. A couple of months ago we did submit a claim to the City's insurance
company to repair the damages to the monument. However, we have received word
that the insurance company will not make any payment to the City for the damages.
We are further pursuing a claim utilizing the City Attorney.
In April we did receive a proposal to repair the monument in the amount of
approximately $1,500, which did not include any electrical work. The electrical work
is estimated to be an additional 51,000.
Mr. & Mrs. Norder have left with us a copy of a portion of their abstract which states
that "all building plot owners will be responsible for the maintenance of the guard
house and entrance gates." Herein lies the problem. If it is determined that the
entrance monuments are not owned by the City, but are in the City right-of-way and
it is determined to rebuild this monument, the monument should be constructed in
such a manner to minimize future accidents and the City's and LeForet homeowners'
liability.
If any of you have any information about the ownership of the entrance monuments
when the subdivision was constructed, please contact me with that information. It
may help to sort out the issues that the City faces in regards to the reconstruction of ,
the monument, and in its insurance claims.
We have contacted the power company to repair the southerly light that has also
gone out recently.
