Plan Land Use Desig.: Business Park Current Zoning. G4, General Commercial , SUMMARY ' Mr. Nordvik is requesting approval of an administrative plat to divide his property into two parcels. The property has three buildings and is the site of Rick's Auto Body in the blue northerly building and Rosemount ' Marine which stores boats on the rest of the site. The proposed boundary line would separate Rick's from the rest of the site, splitting the common driveway and parking area between the buildings. Access will remain in the same location, and in fact, the City may ask for an easement or right-of-way(ROW) for street purposes in this location which is across from Canada Avenue. MnDOT has previously reviewed access to STH 3 between CSAH 42 and 160th Street and indicated that no additional driveway connections will be permitted. The easement will have to be directly across from Canada Avenue, and then turn easterly to go between the buildings. In addition to providing access for the two lots, this location is one of two potential westerly entrances into the Business Park across the railroad tracks. However, the at-grade rail crossing requirement of this street location may result in a street connection to the east in the vicinity of Murgic's Auto, 15640 S. Robert Trail. If this alternative is preferred, then the street easement is unnecessary, and would be replaced by cross-access easements between the two new lots. In other respects, the subdivision as proposed will not create any new setback encroachments. The blue building (Rick's) is approximately 23 feet from the STH 3 ROW, an encroachment of 7 feet. In addition, the building is only 5.2 feet from the railroad ROW which is an encroachment of 4.8 feet into the setback. These are e�sting non-conforming situations that are not connected to the proposed subdivision. The new lots conform to all applicable business park and commercial lot dimensional standards. On June 10, 1997, the Planning Commission reviewed the proposed administrative plat. Mr. Nordvik appeared and questioned the amount of the fees recommended by Staff. Staff provided a brief explanation of the fees and informed Mr. Nordvik that the City Council does have the authority to waive some fees such as park dedication. Mr. Nordvik's primary concern was with the 1997 Storm Water Trunk Area Charge of$19,740. He did not object to the other fees. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1997- A RESOLUTION APPROVING THE ADMINISTRATIVE PLAT FOR ARLENDER NORDVIIZ AND JUDY NORDVIK WHEREAS, the Planning Department of the City of Rosemount received an application from Arlender Nordvik and Judy Nordvik for approval of the Administrative Plat to divide property located at 15280 South Robert Trail and 15872 Chippendale Avenue; and WHEREAS, on June 10, 1997, the Planning Commission of the City of Rosemount reviewed the Administrative Plat of Arlender Nordvik and Judy Nordvik and adopted a motion to recommend approval to the City Council. Sanitary Sewer An 8"sanitary sewer runs along the westerly property line of this proposed plat towards Canada Avenue. Watermain A 12"watermain runs along the westeriy property line of this proposed plat towards Canada Avenue. Easements�Ric,Lht-of-Ways The City is requesting a 66'easement dedication for street purposes. The easement should align with Canada Avenue right-of-way and run easterly to the railroad right-of-way thus eliminating the need for an adjoining lot line. Use a 10'minimum drainage&utility easement dedication on all lot lines. The City will review a future preliminary plat submittal for needed easements. Therefore, it seems appropriate that the question of access locations be resoived by a local decision made within the context of the regional system. It is our intent to provide guidance that will enable the Rosemount community to make an access location decision that Mn/DOT can support and approve. We understand the need for access to Trunk Highway 3 especially in light of CSAH 42's classification as a principal arterial. To maintain safety and an appropriate level of service on CSAH 42, it is necessary to orient access for developments in the area. to Chippendale and Biscavne Avenues, TH ;i and 1bOth Street. These roads must be the focus of access for the area.�Although TH 3 is classified as a minor arterial, its primary functional purpose is mobility. To maintain mobility, access must be limited. Consequently choices made now must accommodate not only existing and proposed land uses, but all future uses as well. Additional direct access to TH 3 must be prevented. TH 3's subordinate functional role, to provide land access, is complicated by a difficult geometric design that attempts to deal with topography and proximity to the railroad tracks. Platting and subdivision of property should be arranged so that access to the highway may be gained at one or two key intersections. We cannot allow the safety and function of the highway to become degraded by multiple accesses, public or private. An Equal Opportunity Employer . Lisa Freese October 15, 1993 a e two Pg Mn/DOT's position is that access to TH 3 in this area should be limited to one full intersection, or by a pair of T intersections serving opposite sides of the highway. Specific access locations have not been analyzed nor have any possible locations been compared with existing access locations for safety and operation. The separation between two T's must be great enough to allow traffic entering TH 3 from the intersections to reach a reasonable and prudent speed before encountering tne other. T'ne gotentiai ror a weaving 5 maneuver must ue avoided. The intersectivns must appear to be and must operate as two distinct intersections. The placement of intersections must be in accordance with standard practice with regard to safety. Among the specific considerations are sight distance and approach. Intersection spacing should be at least one eighth of a mile from other intersecrions. To determine spacing from CSAH 42 it should be assumed that the interchange envisioned by Dakota County will occur. Combined with the topographical and roadway structure limitations this should adequately frame the possible access locarions. As we have said before, Canada Avenue is an acceptable location for developing a full �' intersection and may also serve as one of the T intersections. If Canada Avenue is not utilized ' it must be closed and alternative access provided. ' The need for geometric improvements and signals at intersections will be based on e�cisting traffic volumes and estimated trip generation. Public Hearina: Nordvik Lot Diyision Chairperson Droste opened the public hearing concerning the application by Arlender and Judy Nordvik for a Lot Division. The recording secretary has placed the Affidavit of Publication and Ai�idavit of Mailing and Posting of a Public Hearing Notice on file with the City. Mr. Pearson presented the Nordviks' application to divide their property at 15280 South Robert Trail. Rick's Auto Body and Rosemount Marine is presently located upon this property. The common driveway and parking area would be split between the businesses. The City will ask for an easement or right-of-way across from Canada Avenue for street purposes. In addition to providing access to the two lots, this easement or right-of-way would provide an additional westerly entrance into the Business Park. Chairperson Droste opened the floor to the applicant. Mr. Nordvik asked about the storm water trunk area charges in the amount of$19,740, and inquired as to the amount of the park dedication fees. Mr. Nordvik was not comfortable in proceeding without having an idea of what these fees amount to. Additionally, Mr. Nordvik objected to the requirement that all existing buildings be connected to sewer and water when a building may be torn down. Mr. Nordvik pointed out that, while he is expected to pay these high fees, the City in return � Planning Commission Regular :Vleeting :�linutes - June 10, 1997 Page 11 expects him to grant an easement and not pay anythin� for it. This easement for road purposes would be beneficial to the City by providing an additional access into the Business Park. Chairperson Droste opened the floor to t�ie public. There was no comment.
