SUMMARY
This final plat will result in the completion of the second and final phase of Shannon Pond East, the forty acres of
land developed for single family residential use on the north east corner of Shannon Parkway and 160th Street
West. The preliminary plat was approved by the City Council on June 6, 1995 (please see attached resolution
1995-33). At that time, public hearings were still being conducted by the City Council. The public hearing for
the preliminary plat included the rezoning from Agriculture to R-1, Single Family detached. The Council then
tabled action regarding the rezoning (until final plat approval).
The final plat is consistent with the preliminary plat as approved. Six variances were granted with the preliminary
plat, but they were generally associated with cul-de-sac lots in the (northerly)first phase,
On July 8, 1997, the Planning Commission reviewed the final plat and adopted a motion to recommend approval.
RECOMMENDED ACTION: Motion to adopt A Resolution Approving the Final Plat for Shannon
Pond East First Addition.

A RESOLUTION APPROVING
THE FINAL PLAT FOR SHANNON POND EAST FIItST ADDITION
WHEREAS, the Planning Department of the City of Rosemount received an application for final
plat approval submitted by Hampton Development Corporation as required by ordinance for the
purpose of a single family detached residential development on land legally described as:
That part of the Southwest Quarter of the Southeast Quarter of Section 31, Township
115, Range 19, Dakota County, Minnesota, lying easterly of the easterly right-of-way
line of Shannon Parkway, southerly of the piat of SHANNON POND EAST
ADDITION, and westerly and southwesterly of the following described line:
Beginning at the southwest corner of the east 10.00 rods of said Southwest Quarter of
the Southeast Quarter;thence North 00 degrees 30 minutes 40 seconds East, assumed
bearing, along the west line of said east 10.00 rods, a distance of 264.01 feet to the north
line of the south 16.00 rods of said Southwest Quarter of the Southeast Quarter; thence
North 42 degrees 51 minutes 42 seconds West a distance of 175.90 feet; thence South
76 degrees OS minutes 02 seconds West a distance of 146.56 feet; thence North 04
degrees 03 minutes 15 seconds East a distance of 168.36 feet; thence North 55 degrees
27 minutes 39 seconds West a distance of 116.51 feet;thence North 52 degrees 39
minutes 51 seconds East a distance of 69.73 feet more or less to the southwest corner of
Lot 1, Block 3, SHANNON POND EAST ADDITION, and there terminating.
WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat
application for Shannon Pond East First Addition at their regular meeting on July 8, 1997; and,
WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat
to the City Council as required by the Subdivision Ordinance; and,
WHEREAS,the City Council of the City of Rosemount reviewed the final plat application as
required by the Subdivision Ordinance on July 15, 1997.
NOW, THEREFORE, BE IT RESOLVED,the City Council of the City of Rosemount hereby
approves the final plat for Shannon Pond East First Add'rtion, subject to:
1. Incorporation of recommendations relative to grading, public streets, public utilities, and
public easements/right-of-ways as identified by the Public Works Department.
2. Incorporation of recommendations relative to the right-of-way and intersection spacing
on future County Road 46 (160th Street West)by the Dakota County Plat Commission.
3. Developer must make payment to the City at the time of final plat for:
a. 1997 Storm Water Trunk Area Charges of$2,000 per acre which is estimated at
this time to be 16 acres x $2 000 = $32 000•

4. Payment of 33 units of park dedication(estimated to be $29,700 according to the 1997
fee resolution).

Shannon Pond East First Addition
T'HE CITY COUNCII, OF TI-� CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS
FOLLOWS:
Section 1. Ordinance B, adopted September 19, 1989, entitled"City of Rosemount
Zoning Ordinance, " is hereby amended to rezone from Agriculture to R-1, Single Family
detached Residential, the following described property located within the City of Rosemount,
Minnesota, to-wit:
That part of the Southwest Quarter of the Southeast Quarter of Section 3 l, Township 115,
Range 19, Dakota County, Minnesota, lying easterly of the easterly right-of-way line of
Shannon Parkway, southerly of the plat of SHANNON POND EAST ADDITION, and
westerly and southwesterly of the following described line:
Beginning at the southwest corner of the east 10.00 rods of said Southwest Quarter of the
Southeast Quarter; thence North 00 degrees 30 minutes 40 seconds East, assumed bearing,
along the west line of said east 10.00 rods, a distance of 264.01 feet to the north line of the

republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said zoning
map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided
for in this Ordinance and all of the notation references and other information shown thereon are
hereby incorporated by reference and made a part of this Ordinance.
Section 3. This ordinance shall be effective immediately upon its passage and publication
according to law.

This development will be served by a 16"trunk sewer that runs through it.
Watermain
A 12"trunk watermain will be extended southerly along the east right-of-way line of Shannon Parkway to 160th Street
as part of this improvement.
Streets
Walks�Trails
An 8'wide bituminous trail will be constructed with this development along the east side of Shannon Parkway.
An 8'wide bituminous trail will also be constructed with County Road 46. The developer will be responsible for that
portion from Shannon Parkway to the easterly plat limit of the development.

A RESOLIITION APPROVING TSE SHANNON POND EAST ADDITION
. RESIDENTIAL PLANNED UNIT DEVELOPMENT
AND PRELIMINARY PLAT
�REAS, on June 6, 1995 the Rosemount City Council held a public
hearing, in accordance with the City' s Subdivision Ordinance and
State Statutes, and approved the Shannon Pond East Residential
Planned Unit Development and preliminary plat subject to conditions;
and
�HEREAS, the developer, Hampton Development Corporation, has made '
application for approval of the Shannon Pond East Residential '
Planned Unit Development and Preliminary Plat; and
WSEREAS, on May 9 , 1995, the Planning Commission of the City of �
Rosemount reviewed and recommended approval of the Shannon Pond East 'I
Residential Planned Unit Development; and
AIHEREAS, the Shannon Pond East Addition Planned Unit Development is
consistent with the findings required by the Rosemount Zoning
Ordinance Section 12 .2 D for Planned Unit Development .
NOpi, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby approves the Shannon Pond East Addition Residential
Planned Unit Development and preliminary plat subject to:
1. Execution of a Planned unit Development Agreement and Master
Subdivision Development Agreement securing anticipated public
and private improvements, phasing and variances for future
phases;
2 . Approval by the City Engineer for the grading and utilities
plans and the exchange of property associated with the ponding
areas;
3 . Final plat approval for each phase with development agreements
executed to secure public and private improvements;
4 . Park Dedication in the form of cash contribution due at the time
of final plat approval relative to each phase at the rate
established by resolution; and
5 . Installation of bituminous paths along Shannon Parkway and 160th
Street West in conformance with standards on file with the
Director of Parks and Recreation.
ADOPTED this 6th day of June, 1995 .

Assistant Planner Pearson reviewed the request by Hampton Development Corporation for a
Planned Unit Development, preliminary plat and rezoning for Shannon Pond Fast I,
Development. 7im Allen and Gary Bergquist have planned 77 single family lots on a 38 acre '
' parcel on the northeast corner of Shannon Parkway and 160th 5treet. Osmundson noted that ',
easements are needed into the ponding area since this is not a city owned pond. The
development is planned in phases with the first beginning in the northwest corner of the parcel
with 20 to 30 homes.
Bill Deane, 15670 Crestone Court, commented that the land is quite low for building.
Osmundson noted that grading will raise the area to the level necessary.
Gary Bergquist, Hampton Development Corporation, said that homes should be valued at
$152,000 to $190,000. Bergquist commented on the large amount of waste concrete
discovered that is being hauled away.

Pursuant to due call and notice thereof the Regular Meeting of the Pianning Commission was duly held on
Tuesday, May 9, 1995 at 5:30 p.m. Chairperson McDermott called the meeting to order with members
DeBettignies, Tentinger, and Droste present. Also in attendance was Senior Planner Andrew Mack,
Assistant Planner Rick Pearson, Civil Engineer poug Litterer, and Park& Recreation Director Topitzhofer.
MOTION by DeBettignies to approve the April 25, 1995 Regular Planning Commission Meeting Minutes
as presented. Second by Tentinger. Ayes: DeBettignies, Tentinger, McDermott, Droste. Nays: 0.
SHANNON POND EAST
Assistant Ciry Planner Pearson apprised the Commission for the proposal from Hampton Development
requesting approval of a PUD, preliminary plat and rezoning for a 77 lot single family detached
residential development. The proposal concerns 38 acres of land between the "Winds Crossing" area,
Shannon Parkway and 160th Street West.
Commissioner Ingram took her chair at 5:38 p.m.
Upon review of the proposed configuration the Commission asked questions regarding the ponding, ',
drainage easements, and distance between the two access roads on Shannon Parkway. '
MOTION by Ingram to recommend that the City council schedule a public hearing to hear testimony �I
regarding the preliminary plat, planned unit development and rezoning for Shannon Pond East.
SECOND by Droste. Ayes: Tentinger, McDermott, Ingram, Droste, DeBettignies. Nays: 0.
MOTION by Ingram to recommend to the City council approval of the final development plan and
preliminary plat for Shannon Pond East subject to: 1) entering into a PUD and Master Subdivision
Development Agreement to secure the anticipated public and private improvements, phasing and
variances for future phases; 2) approval of the grading and utilities plans and the exchange of property
associated with the ponding areas by the City Engineer; 3) final plats must be approved for each phase
with development agreements executed to secure public and private improvements; 4) park dedication
will be in the form of cash contribution due at the time of final plat approval relative to each phase at the
rate established by resolution; 5) bituminous paths will be installed along Shannon Parkway and 160th
Street in conformance with standards on file with the Director of Parks and Recreation; and 6) a
landscape plan must be prepared which specifies boulevard trees and screening planting strips along
Shannon Parkway and 160th Street West. SECOND by Tentinger. Ayes: McDermott, Ingram,

MOTION by Ingram to recommend that the property for Shannon Pond East be rezoned from Ag

A RESOLUTION APPROVING
THE FINAL PLAT FOR SHANNON POND EAST FII2ST ADDTTION
WHEREAS,the Planning Department of the City of Rosemount received an application for final
plat approval submitted by Hampton Development Corporation as required by ordinance for the
purpose of a single family detached residential developrnent on land legally described as:
That part of the Southwest Quarter of the Southeast Quarter of Section 31, Township
115, Range 19, Dakota County, Minnesota, lying easterly of the easterly right-of-way
line of Shannon Parkway, southerly of the plat of SH[ANNON POND EAST
ADDITION, and westerly and southwesterly of the following described line:
Beginning at the southwest corner of the east 10.00 rods of said Southwest Quarter of
the Southeast Quarter; thence North 00 degrees 30 minutes 40 seconds East, assumed
bearing, along the west line of said east 10.00 rods, a distance of 264.01 feet to the north
line of the south 16.00 rods of said Southwest Quarter af the Southeast Quarter; thence
North 42 degrees 51 minutes 42 seconds West a distance of 175.90 feet; thence South

WHEREAS,the Planning Commission of the City of Rosemount reviewed the final plat
application for Shannon Pond East First Addition at their regular meeting on July 8, 1997; and,
WHEREAS,the Planning Commission adopted a motion to recommend approval of the final plat
to the City Council as required by the Subdivision Ordinance; and,
WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as
required by the Subdivision Ordinance on July 15, 1997.
NOW, THEREFORE, BE IT RESOLVED,the City Council of the City of Rosemount hereby
approves the final plat for Shannon Pond East First Addition, subject to:
1. Incorporation of recommendations relative to grading, public streets, public utilities, and
public easements/right-of-ways as identified by the Public Works Department.
2. Incorporation of recommendations relative to the right-of-way and intersection spacing
on future County Road 46 (160th Street West)by the Dakota County Plat Commission.
3. Developer must make payment to the City at the time of final plat for:
a. 1997 Storm Water Trunk Area Charges of$2,000 per acre which is estimated at
this time to be 16 acres x $2,000= $32,000;

Commissioners noted the actions taken b e City Cou ' on July 1, 1997. There was discussion
concerning the CounciPs approval of e Heritage Develop ntproject. The Commissioners
referenced a letter from NIr. Mc ty in opposition to the Heri e development project and noted
his concerns. Further cl�rifi ion was also provided by Mr. Pears concerning the Rosemount
Woods variance.
N1r. Pearson pr nted information concerning the Prairie Crossing project to e developed in Apple
Valley at th 'ntersection of Dodd Blvd. and CSAH 42.
Co 'ssioners noted the Joint City/County Planning Commissioners meeting schedule r July 17,
97. Rosemount will be hosting this meetina.
New Business• Shannon Pond East Second Addition Final Plat
Mr. Pearson presented the final plat for the second and final phase of Shannon Pond East, located in
the northeast corner of Shannon Parkway and 160th Street. Mr. Pearson pointed out the pondin�
area and noted ownership of the pond is with the individual lot owners, as illustrated on the plat
drawing.
Present at the meeting was Jim Allen of Hampton Development and Gary Bergquist.
Commissioners discussed concerns about maintenance of the pond area where it fronts Cascade Path.
According to the plat, this area is part of Lot 4, Block 2. Commissioners discussed the possibility of
landscaping this area with rocks or trees. Mr. Litterer explained that was not an option. After
' fiirther discussions with Mr. Allen, it was decided that the lot lines for Lots 10 and l t should be
redistributed to eliminate the frontage of Lot 4 on Cascade Path.
