Plan Land Use Desig.: Urban Residential Current Zoning: Agriculture Requested Zoning: R-1, Single Family detached Residential PC Recommendation: Unanimous Approval with conditions SUMMARY This final plat will result in the completion of the second and final phase of Shannon Pond East, the forty acres of land developed for single family residential use on the north east corner of Shannon Parkway and 160th Street West. The preliminary plat was approved by the City Council on June 6, 1995 (please see attached resolution 1995-33). At that time, public hearings were still being conducted by the City Council. The public hearing for the preliminary plat included the rezoning from Agriculture to R-1, Single Family detached. The Council then tabled action regarding the rezoning (until final plat approval). The final plat is consistent with the preliminary plat as approved. Six variances were granted with the preliminary plat, but they were generally associated with cul-de-sac lots in the (northerly)first phase, On July 8, 1997, the Planning Commission reviewed the final plat and adopted a motion to recommend approval. RECOMMENDED ACTION: Motion to adopt A Resolution Approving the Final Plat for Shannon Pond East First Addition. - and - Motion to adopt an Ordinance rezoning the subject property from Agriculture to R-1, Single Family detached Residential in conformance with the Comprehensive Guide Plan. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY,MINNESOTA RESOLUTION 1997- A RESOLUTION APPROVING THE FINAL PLAT FOR SHANNON POND EAST FIItST ADDITION WHEREAS, the Planning Department of the City of Rosemount received an application for final plat approval submitted by Hampton Development Corporation as required by ordinance for the purpose of a single family detached residential development on land legally described as: That part of the Southwest Quarter of the Southeast Quarter of Section 31, Township 115, Range 19, Dakota County, Minnesota, lying easterly of the easterly right-of-way line of Shannon Parkway, southerly of the piat of SHANNON POND EAST ADDITION, and westerly and southwesterly of the following described line: Beginning at the southwest corner of the east 10.00 rods of said Southwest Quarter of the Southeast Quarter;thence North 00 degrees 30 minutes 40 seconds East, assumed bearing, along the west line of said east 10.00 rods, a distance of 264.01 feet to the north line of the south 16.00 rods of said Southwest Quarter of the Southeast Quarter; thence North 42 degrees 51 minutes 42 seconds West a distance of 175.90 feet; thence South 76 degrees OS minutes 02 seconds West a distance of 146.56 feet; thence North 04 degrees 03 minutes 15 seconds East a distance of 168.36 feet; thence North 55 degrees 27 minutes 39 seconds West a distance of 116.51 feet;thence North 52 degrees 39 minutes 51 seconds East a distance of 69.73 feet more or less to the southwest corner of Lot 1, Block 3, SHANNON POND EAST ADDITION, and there terminating. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Shannon Pond East First Addition at their regular meeting on July 8, 1997; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance; and, WHEREAS,the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on July 15, 1997. NOW, THEREFORE, BE IT RESOLVED,the City Council of the City of Rosemount hereby approves the final plat for Shannon Pond East First Add'rtion, subject to: 1. Incorporation of recommendations relative to grading, public streets, public utilities, and public easements/right-of-ways as identified by the Public Works Department. 2. Incorporation of recommendations relative to the right-of-way and intersection spacing on future County Road 46 (160th Street West)by the Dakota County Plat Commission. 3. Developer must make payment to the City at the time of final plat for: a. 1997 Storm Water Trunk Area Charges of$2,000 per acre which is estimated at this time to be 16 acres x $2 000 = $32 000• , , , Resolution 1997- b. Preliminary payment for future street improvements to 160th Street West using 1997 rates for a 38'wide residential street which is estimated at this time to be $53.20 per foot x 1,116'_$59,370; c. Escrow for 8'bituminous trail on 160th Street West(which will be constructed , with b. above)using a 1997 rate which is estimated at this time to be $10 per ' foot x 1,116'_ $11,164; I d. 1997 GIS fees of$50 per lodunit which is estimated at this time as 33 lots x$50 I, per lot/unit=$1,650.Execution of a subdivision development agreement to secure public infrastructure. , 4. Grading/Drainaae Facilities/VUater Resources Grading was completed with the grading for Shannon Pond East additian. Sanitary Sewer This development will be served by a 16"trunk sewer that runs through it. Watermain A 12"trunk watermain will be extended southerly along the east right-of-way line of Shannon Parkway to 160th Street as part of this improvement. Streets Walks�Trails An 8'wide bituminous trail will be constructed with this development along the east side of Shannon Parkway. An 8'wide bituminous trail will also be constructed with County Road 46. The developer will be responsible for that portion from Shannon Parkway to the easterly plat limit of the development. 1 of 2 . Easements�Riaht-of-Wavs The developer will need to incorporate recommendations relative to the right-of-way and intersection spacing on future County Road 46 (460th Street West) by the Dakota County Plat Commission. Drainage&Utility easements need finalizing. Osmundson noted that ', easements are needed into the ponding area since this is not a city owned pond. The development is planned in phases with the first beginning in the northwest corner of the parcel with 20 to 30 homes. Bill Deane, 15670 Crestone Court, commented that the land is quite low for building. Osmundson noted that grading will raise the area to the level necessary. Gary Bergquist, Hampton Development Corporation, said that homes should be valued at $152,000 to $190,000. Bergquist commented on the large amount of waste concrete discovered that is being hauled away. The proposal concerns 38 acres of land between the "Winds Crossing" area, Shannon Parkway and 160th Street West. Commissioner Ingram took her chair at 5:38 p.m. Upon review of the proposed configuration the Commission asked questions regarding the ponding, ', drainage easements, and distance between the two access roads on Shannon Parkway. ' MOTION by Ingram to recommend that the City council schedule a public hearing to hear testimony �I regarding the preliminary plat, planned unit development and rezoning for Shannon Pond East. New Business• Shannon Pond East Second Addition Final Plat Mr. Pearson presented the final plat for the second and final phase of Shannon Pond East, located in the northeast corner of Shannon Parkway and 160th Street. Mr. Pearson pointed out the pondin� area and noted ownership of the pond is with the individual lot owners, as illustrated on the plat drawing. Present at the meeting was Jim Allen of Hampton Development and Gary Bergquist. Commissioners discussed concerns about maintenance of the pond area where it fronts Cascade Path. According to the plat, this area is part of Lot 4, Block 2. Commissioners discussed the possibility of landscaping this area with rocks or trees. Mr. Litterer explained that was not an option. After ' fiirther discussions with Mr. Allen, it was decided that the lot lines for Lots 10 and l t should be redistributed to eliminate the frontage of Lot 4 on Cascade Path.
