Public Hearing Date: January 14, 1997 Planning Commission Action: Recommendation of Renewal(unanirnous) SUMMARY Mr. Jim Lathrop of Splatball, Inc Is requesting the renewal of an Inte�im Use Permit (IUP)that allows the conduct of commercial outdoor recreation in the Agriculture District. The IUP was originally granted in 1994 with an annual review for compliance with the approved conditions of operation. In 1995, the I[JP was renewed and the use was found to be consistent with the conditions. As a result,a two year renewal period was then recommended and approved. The site has been periodically monitored during the year and has again been found to be consistent with the conditions of operations. No complaints have been received by Planning Staff or the Police regarding the IITP. Therefore, Sta.ff will recommend that the IUP again be renewed for a period of two yeaxs subj ect to the attached conditions of operation of the IUP for Splatball, Inc. On January 14, 1997,the Planning Commission conducted a public hearing regarding the renewal request. No one attended regarding the renewal of the IUP. Subsequently, the Planning Commission adopted a recommendation to renew the IiJP for two years. RECOMMENDED ACTION: Motion to renew the Interim Use Permit for Splatball, Inc for a period of ' two years subject to the attached conditions of operation for 1997-98. CITY COUNCIL ACT'ION: � � �, ___ . Exhibit A 1997-9$ Interim Use Permit Conditions for Splatball, Inc. A Commercial Qutdoor Recreartional Use located in the Agrieulture District This Interim Use Pernut(IUP) is valid only for that part of the Southwest Quarter of Section 21, Range 18 West, Township 115 North lying north of the right-of-way for State Trunk H'ighway 55 and west of Fahey Avenue. , 1. This pernut allows the operation of art interim use with modificaxions to standards specified by the City of Rosemount Zoning Regulations as approved by resolution adopted ' by the City Council of the City of Rosemount onn April 19, 1994. 2. This permit shall be reviewed prior to renewal in 1999 for conformance with these conditions. Thereafter, the City Council will detemune the appropriate time interval for the subsequesnt renewal procedure. 3. Violation of any specified ILTP condition or otherwise unlawful activity may result in immediate revocation of the IIJP. 4. Site improvements, as required, must be maintained and acceptable to the City Public Works Department. Work needed to maintain the site must be performed within thirty (30) days of written notice by the City Public Works Department. 5. The hours of operation shall be limited to 8;00 a.rn. to sunset. 6. All perrnits required by other applicable agencies must be obtained and copies submitted to the City. '7. Parking areas must consist of a minimum of six(6)inches of compacted, crushed limestone or other such material acceptable to the City Public Works Department. 8. The entry drive must be twenty-four(24)feet wide, in conformance with City requirements and the culvert must be maintained to facilitate ditch runoff. The entry drive must be secured by a gate or chain at all times the site is not being used for recreational use or related maintenance. 9. All structures must conform with the Uniform Building Code and all applicable City of Rosemount Zoning requirements including Section 10, the Sign Ordinance. 10.
