At the May 12, 1997 regular Utility Commission meeting the Commission reviewed the
attached revisions to the Storm Water Utility Policy.
The verbiage was modified so as to clarify the actual interpretation of the land use
determination, and the way Staff had been utilizing the Policy.
Staff and the Utility Commission recommend the clarification as shown.
RECOMMENDED ACTION: MOTION TO AMEND THE LANGUAGE IN THE CURRENT STORM
WATER UTILITY POLICY REGARDING THE PROCESS OF DETERMINING LAND USE.

Based on our experience with the Krech fee appeal, we would like to suggest the
attached changes to our fee policy language. These changes clarify how and when
we determine land use. These changes should make the process of determining land
use
easier for residents and staff to understand and explain.
RECOMMENDED ACTION: Recommend Storm Water Utility Policy language changes to
City Council.

5.4 LAND USE
The land use for determining the storm water utility fee on a parcel shall be the existing land
use at the date of enactment of the Storm Water Utility. As land is developed or redeveloped, the fees
will be recomputed based on the revised land use. This new fee will be assigned as soon as possible
after the land use change has been approved by the City.

5.4 LAND USE
The land use for determining the storm water utility fee on a parcel shall be the predominant
existing land use as determined by the Public Works Department. The utility fee is not based on
zoning, but rather considers the amount of impervious surface (including buildings and concrete,
bituminous, compacted gravel, crushed rock and recycled materials paved areas) along with potential
water quality impacts of activity on a parcel. The determination utilizes the District Use Regulations
Section 6 of the City of Rosemount Zoning Regulations definitions for land use as a guide. As land
use changes, the fees will be recomputed and assigned based on the revised land use as soon as is
reasonably possible by the City. Appeals of land use determinations shall be presented to the Utility
Commission.
