Resolution 1997-53,A Resolution Approving the Final Plat for Geronime Pond, adopted June 3,
1997, contains a legal description which covers only a portion of the plat for Geronime Pond. The
County Recorder's office has requested an amended Resolution to reflect the entire legal description
far the plat.

A RESOLUTION APPROVING
THE FINAL PLAT FOR GERONIME POND
WHEREAS, the Planning Department of the City of Rosemount received an application for final
plat approval submitted by Heritage Development of Minnesota as required by ordinance for the
purpose of a single family detached and attached residential development on land legally described
as:
The Southeast Quarter of the Southeast Quarter, Seciion 31, Township 115, Range 19,
Dakota County, Minnesota, EXCEPT the South 175 feet of the East 325 feet thereof. �
WHEREAS,the Planning Commission of the City of Rosemount reviewed the final plat I
application for Geronime Pond at their regular meeting on May 27, 1997; and,
WHEREAS,the Planning Commission adopted a motion to recommend approval of the final plat
to the City Council as required by the Subdivision Ordinance; and,
WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as
required by the Subdivision Ordinance on June 3, 1997.
NOW,THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the final plat for Geronime Pond subject to:
1. Conformance with the applicable specified conditions of Resolution 1997-10;
2. Execution of a subdivision agreement to secure public infrastructure and including
recommendations relative to grading, utilities, easernents, ponding, streets and public
infrastructure requirements as recommended by the Public Works Department; and ,
3. Developer must make payment to the City at the time of final plat for (the following
items modify items Sa-e of Resolution 1997-10):
a. Park dedication costs consisting of the payment of$31,928.00 in park dedication
fees and land dedication consisting of.7010 acres;
b. Geographic Information System (GIS) fees in the amount of$2650.00 (Based on
53 lots);
c. Storm Sewer Trunk Area Charges as a prepayment of all Storm Sewer Trunk
Assessments for improvements, either constructed or to be constructed, to sewer
the subject property, in the amount of$36,600.00.
d. Prepayment of all special assessments applicable to the subject property for the
following projects:
i) Chippendale Avenue Street Improvements: One half the cost previously
discussed for the preliminary plat of Geronime Pond in the amount of
$35,300.00, which is for street, trail, and appurtenanf improvements;
ii) 160th Street West improvements (City Project No. 284): One half the cost
previously discussed for the preliminary plat of Geronime Pond in the amount
of$30,100.00, which is for street, trail and appurtenant improvements.
RESO�UTION 1997-53 `
e. Developer shall pay at the time of issuance of building permits for the subject
property the fees, charges and assessments in effect at the time of issuance. The
fees, charges, and assessments presently in effect are as follows:
i) Metropolitan Council Environment Services Availability Charges in the amount
of 950.00 per SAC unit;
ii) Storm Sewer Connection Charges in the amount of$685.00 per lot.
iii} Sanitary Sewer Availability Charges in the amount of$1,245.00 per SAC unit.
iv) Water Availability Charges in the amount of$1245.00 per SAC unit.
ADOPTED this 3rd day of June, 1997 by the City Council of the City of Rosemount.

A RESOLUTION AMENDING RESOLUTION 1997-53
APPROVING THE FINAL PLAT FOR GERONIME POND
WHEREAS, on June 3, 1997, the Rosemount City Council adopted Resolution 1997-53 A
Resolution Approving the Final Plat for Geronime Pond; and,
WHEREAS, tl�e legal description contained in Resolution 1997-53 is not the correct legal
description as reflected in the plat; and,
WHEREAS, this Resolution is made to correct the legal description for Geronime Pond.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount,
Minnesota, that Resolution 1997-53, adopted June 3, 1997, shall be amended as follows:
1. The legal description contained in Resolution 1997-53, shall be deleted and replaced
with the following description:
The Southeast Quarter of the Southeast Quarter of Section 31, Township 115, Range 19,
Dakota County,Minnesota, except the Soutn 175.00 feet of the East 325.00 feet thereof;
And that part of the Southwest Quarter of the Southeast Quarter of Section 31, Township
115, Range 19, Dakota County,Minnesota lying southerly of the plat of Shannon Pond
East Addition and northerly and easterly of the following described line:
Beginning at the northeast corner of the south I6 rods of said Southwest Quarter of the
Southeast Quarter; thence North 89 degrees 58 minutes 12 seconds West, assumed
bearing along the north line of said south 16 rods, a distance of 165.01 feet to the west
line of the east 10 rods of said Southwest Quarter of the Southeast Quarter; thence North
42 degrees 51 minutes 42 seconds West a distance of 175.90 feet; thence South 76
degrees OS minutes 02 seconds West a distance of 146.56 feet; thence North 04 degrees
03 minutes 15 seconds East a distance of 168.38 feet; thence North 55 degrees 27 minutes
39 seconds West a distance of 116.51 feet; thence North 52 degrees 39 minutes 51
seconds East a distance of 69.73 feet more or less to the southwest corner of Lot 1, Block
3 of Shannon Pond East Addition and there terminating.
2. That all other conditions and restrictions included in Resolution 1997-53 shall remain
in full force and effect.
