This project involved the reconstruction of Cameo Avenue from Lower 147th to 145th Street, Lower 147th Street from Canada Avenue to Burma Avenue and Burma Avenue from 146th Street to Lower 147th Street. It also included a major trunk storm sewer from the Cameo Avenue/Lower 147th Street intersection along the Lower 147th Street and Burma Avenue alignment past City Hall and into Erickson Pond. The project also included the installation of trunk watermain on Cameo Avenue, Lower 147th Street and Burma Avenue and the replacement of sanitary sewer in the entire project area. Also included was the replacement of sidewalk in the project area which was some of the worst in the City. Another item included was the NSP line burial in Erickson Park and alon Hi hwa 3. 9 9 Y The total construction cost for the project was S 1,71 1,223. Added to the construction cost are the cost for legal, engineering, administration and finance which are itemized on the Cost Summary and total $288,692 or 17% of the project cost. This brings the total project cost to 51,999,915. The original cost estimate in the Feasibility Report was 52.6 million. The funding for the project is as shown on the , Funding Summary. The majority of the cost is to be paid from the Storm Water Core Fund and the Storm I Water Utility Fund totaling approximately S971,000 or 49% of the total project cost. The assessment for � streets included in the project total 5180,000 or 9% of the project cost. The remaining funding sources I are the C.I.P., the Sewer Operating, Water Operating and Water Core Funds as shown. ', We have received and have attached an appeal of the assessments from the Oxboroughs who live at ', 14690 Cameo Avenue South. This is a corner lot and as per the policy the Oxboroughs are proposed to �i be assessed two residential units totaling 54,500 due to the fact that they do have a driveway on each '�, improved street. Their letter appeals this assessment. ', We have also had a discussion with Jerome Clarke who owns the car wash located on Burma Avenue. ' This car wash is constructed over two parcels and in the preliminary assessment roll each parcel had a proposed assessment of $5,000 for a total of $10,000 which Mr. Clarke would have to pay. Mr. Clarke ' was instructed to put his appeal in writing, but it has not yet been received. If approved the assessments would be payable over a ten year period at an interest rate of approximately 7.5%� Staff recommends that the City Council adopt this Assessment Roll as presented. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION ADOPTING ASSESSMENT ROLL, 1996 STREET AND UTILITY RECONSTRUCTION IMPROVEMENTS, CITY PROJECT #266. COUNCIL ACTION: , CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1997 - A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR 1996 STREET AND UTILITY RECONSTRUCTION IMPROVEMENTS CITY PROJECT #266 WHEREAS, pursuant to notice duly given as required by law, the City Council has met, heard and passed upon all objections to the proposed assessment for the 1996 Street and Utility Reconstruction Improvements, City Project #266, and has amended such proposed assessment as it deems just. NOW THEREFORE BE IT RESOLVfD by the City Council of the City of Rosemount, Minnesota, as follows: (1) Such proposed assessment, in the amount of S 180,000, a copy of which is in Clerk's File 1997-34 is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the proposed improvement. {2) Such assessments shall be as follows a. The assessments shall be payable in equal annual installments extending aver a period of ten (10) years, the first of said installments to be payable with general taxes for the year 1997, collectible with such taxes during the year 1998. b. To the first installment shall be added interest at the rate of 7.5137% per annum on the entire principal amount of the assessment from the date of this resolution until December 31 of the year in which such installment is payable. To each subsequent installment, when due there shall be added interest for one year at said rate on the unpaid principal amount of the assessment. c. The owner of any property so assessed may at any time prior to the certification of the assessment or the first installment thereof to the County Auditor, pay the whole of the principal amount of the assessment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the date hereof; and such property owner may at any time prior to November 15 of any year pay to the County Auditor the entire principal amount of the assessment remaining due with ,, interest accrued to December 31 of the year in which said payment is made. I Resolution 1997 - (3) The City Clerk shall forthwith transmit a certified duplicate copy of this assessment roll to the County Auditor to be extended on the tax list of the County. Wa1sY�. Objection 1. Services provided by the City of I�osemount �nd it's suhcontractor for landscape restoration are not c�mplet� and do not meet expectations. The prop�rky in questzQn 11as been damaged and has not been retumed to its original condition. Objection 2. Assessment is n�t equitable. This is based on a rnuch lower assessment given to residents under the 145th St. Project. Thas� received much more benefit for much lower cost. Objection 3. Improverri�nt of Lower 147th street has now made this a "feeder street.'" In effect this increase in traffic h�s nat precipitated an ine�ease in Police Patrols. Rosemount, MN 55068 Ras�mount, MN 550�� ' October 21, 1997 In Re: 1996 Street and Utiiity Reconstruction Improvements, City Projecf#266' I would tike to appeal the assessment proposed by the city of$2,250.00 for parcel number 34-03800-010-01 for the following reasons. --The recommended assessment conducted by the city's appraisal for this propertywas $2000. I do not feel that my assessment should be more because the`city allows other property owners who equally benetit to pay nothing. --The city did not attempt to resolve any issues with repairs to this project and I was told that if I wanted them fixed that it would be necessary to appeaL The following items stili need to be addressed: The sidewalk leading from my house has dirt ground into it giving it a two-tone mud - appearance. The dividing cracks put in this sidewalk are twice the width as the regular sidewalks allowing water to collect and freeze which I believe will decrease the lifespan of the sidewalk. One of the steps in front of my house is cracked. The initial plan that was given to me called for the one step I had to be removed and my sidewalk slopedto meetthe other one. Because the street was;lowered below the initial plan, I was ieftwith 2 steps and a retaining wall leaving the front yard harder to maintain; The sidewalk in front of the steps has a cement saw mark in it and the sidewatk in front of the driveway is cracked. The retaining watl was buiit without pea rock behind it and it is similiar to another wall built in Rosemount that needed to 6e replaced because of insufficient water drainage which caused that wall to collapse in 5 years. The city maintains that the wall is the property owners responsibility 2 years after the project, but this was built by the city on city easement and was not requested by the homeowner. When f complained that the machine used to take the cement out of driveway broke up the tar farther up on my driveway, the city sent the contractor over to argue that he had wi#nesses that it didn't. I had to fill the cracks and seal the area to protect it from#he up coming winter. The city did not want to deal with it. 1 did nof hire the contractor and it was not my place to deal with him. I want to be reimbursed for my time and supplies and compensated for future maintenance. I attended the meetings in the fall of 1995 and was aware that the car wash was considered two lots but no one ever mentioned that there was a higher rate for commercial property vs. residential. I was prepared to be assessed between$4500 to $5000 for the two lots that the car wash was built on. The one lot is only 35' wide and did not require any sewer or water hook-up. I suffered a financial loss when I was out of business during the 6 week project. Not only the sales lost but at my own expense it became necessary to repave the front of my property to match the street. These losses are unrecoverable. I had the car wash appraised the suinmer of 1996. In a business such as this,property and building is a very small percentage of what a business is worth. Gross sales and profit are the two factors that mean the most. I strongly feel that$5000 for assessments is a very fair price. I would appreciate your attention to this matter, and I hope that we can come to a fair agreement.
