The thirty four lots are in the southwest corner of the plat,with access to Biscayne Avenue and are across from the County garage. The streets and lot design are consistent with the approved preliminary plat. As drawn, two minor variance situations have been identified, lot depth for Lot 24,Block 1 and lot width forlot 10, Block 2. The Developer has agreed to modify the plat accordingly. Otherwise, the final plat is consistent with the Biscayne Pointe preliminary plat which was intended to be variance free. The Plannin Commi i g ss on reviewed the final plat on October 14, 1997. Discussion occurred regarding the potential effect of the rail road tracks along the southern edge and the potential for pedestrian crossings. Staff explained that the lots were a minimum of 30 feet deeper than the standard 125 foot depth and that the developer would be required to install screening plantings and earthen berms. Subsequently, a motion recommending conditional approval was adopted. The Commissioner who voted against was being consistent I� with previous objections,primarily because of the rail road. ', The property also needs to be rezoned. Rezoning from Agriculture AG to Single Family Residential R-1 was tabled on June 3, 1997 until final plat approval. Execution of a subdivision agreement to secure public infrastructure and including recommendations relative to grading,utilities,easemerrts, right-of-ways, ponding,streets and public infrastructure requirements as recommended by the Public Works Department; and 2. Developer must make payment to the City at the time of final plat for the following items: a. Preliminary payment for future improvements to Biscayne Avenue, including street and trail, estimated at this time in the amount of 517,723; b. Preliminary paymerrt for trunk watermain improvements on Biscayne Avenue estimated at this time in the amount of S 1,530; c. 1997 Storm Sewer Trunk Area Charges at $2,000 per acre which is estimated at this time in the amount of 528,000 iBased on an estimated 14 acres►; and d. 1997 Geographic Information System (GIS) fees at S50 per lot/unit estimated at this time in the amount of 51,700 (Based on 34 units). The following is a review by the Public Works/Engineering Department for the Final Plat received by the Public Works/Engineering Department on October 1, 1997. The g�ading, streets and utilities are being done as a public improvement. The City Council received the Feasibility Report for Biscayne Pointe on September 16, 1997 and approved the Plans and Specifications/Order Ad for Bid on October 7, 1997. Fees &Assessments Developer must make payment to the City at the time of final plat for the following items a. Preliminary payment for future improvements to Biscayne Avenue, including street and trail, estimated at this time in the amount of 517,723; b. Preliminary paymerrt for trunk watermain improvements on Biscayne Avenue estimated at this time in the amount of S 1,530; c. 1997 Storm Sewer Trunk Area Charges at S2,000 per acre which is estimated at this time in the amount of 528,000 (Based on an estimated 14 acres); and d. 1997 Geographic Information System (GIS) fees at S50 per lot/unit estimated at this time in the amount of $1,700 (Based on 34 units). The preliminary payment for future improvements to Biscayne Avenue is based on the 1997 single family residential rate of half a street at 547.73 per foot for 307 lineal feet. It also includes S 10 per lineal foot for future trail construction on Biscayne Avenue. The Developer will be required to make preliminary payment for future improvements for Outlot A when that area adjacent to Biscayne Pointe develops. The preliminary payment for trunk watermain improvements on Biscayne Avenue is based on the 1997 residential rate of half an 8" watermain at $12.75 per foot for 120 lineal feet. Ordinance B, adopted September 19, 1989, entitled"City of Rosemount ', Zoning Ordinance, "is hereby amended to rezone from AG, Agricultural to R-1, Single Family ' Residential (Detached), the following described property located within the City of Rosemount, Minnesota, to-wit: All that part of the Northwest Quarter of Section 28, Township 115, Range 19,lying northerly of the right of way of the Chicago Rock Island and Pacific Railway Company as located across said premises, all accarding to the Government Survey thereof, Dakota County, Minnesota. Section 2. The Zoning Map of the City of Rosemount, referred to and described in said Ordinance No. B as that certain map entitled"Zoning Map of the City of Rosemount" shall not be republished to show the aforesaid rezoning,but the Clerk shall appropriately mark the said zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this Ordinance and all of the notation references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance.
