This item is on the agenda for Council consideration to authorize the sale of Outlot A of
O'Leary's Hills 5th Addition. The landowner of Lot 1, Block 1, O'Leary's Hills 5th
Addition, which is immediately adjacent to the south has agreed to purchase the Outlot
for $500.00 which is the price the City paid for it.
Staff recommends that Council authorize the necessary action to sell Outlot A of the
O'Leary's Hills 5th Addition to Kelly McGivern for $500.00.
RECOMMENDED ACTION: MOTION TO AUTHORIZE THE SALE OF OUTLOT A OF THE
O'LEARY'S HILLS 5TH ADDITION TO KELLY McGIVERN FOR $500.00.

This item is on the agenda for Council consideration to authorize the purchase of Outlot
A of O'Leary's Hills 5th Addition. Outlot A is located at the northwest corner of this
subdivision. The Outlot was created with the Plat to be utilized by the City for a storm
water and watermain piping. The deed for this Outlot was not transferred to the City for
this subdivision in the Subdivision Agreement. Now Parkview, Inc. has offered to sell
this Outlot to the City for $500.
Recently the homeowner to the south, which is Kelly McGivern, has received approval to
combine Outlot A with his lot, Lot 1, Block 1, O'Leary's Hills 5th Addition. The ultimate
goal is to sell this Outlot A to the McGiverns so there is no cost to the City. However,
the City would keep a utility easement over this Outlot for access to the pond to the
west and for the pipes which lie underneath it. If the Outlot is not sold to McGivern, the
City would retain ownership of Outlot A which is necessary due to the underlying piping.
Staff recommends that Council make a motion to authorize the necessary signatures for
the purchase of Outlot A.
RECOMMENDED ACTION: MOTION TO DIRECT STAFF TO TAKE THE NECESSARY ACTION
TO PURCHASE OUTLOT A OF THE O'LEARY'S HILLS 5TH ADDITION FROM PARKVIEW,
INC. FOR $500.
