As a result, all sidewalk signs fall under the portable sign definition and are allowed to be displa.yed only six (6) times a year for a maximum of ten (10) days per permit. Following suggestions from the Rosemount Commercial Plan Focus Committee, City Staff recommended implementation of a separate sidewalk sign definition and amendment. In addition, a memo was sent to approximately 20 downtown businesses. At the March 11, 1997 meeting of the Planning Commission, two area businesses expressed strong desire of ordinance passage. Following the Council's meeting on April 1, Staff has made revisions to the defuution language to ensure sign advertising is directly related to a business located adjacent to the right-of-way. In additian, the revised definition is intended for a business with no front yard that will not accommodate a permanent free-standing sign. Staff is conf'ident this amendment will lead to increased business activity while preserving the historical atmosphere downtown. Council Action: . ; ,' I City of Rosemount Ordinance No. B- AN ORDINANCE AMENDING ORDINANCE B CITY OF ROSEMOUNT ZONING ORDINANCE Regulations for Sidewalk Signs TI-� CITY COUNCIL OF TI� CITY OF ROSEMOUNT, NIINNESOTA, ORDAINS AS FOLLOWS: SECTION 1. Section 10.1.B. "Definitions", Ordinance B, City of Rosemount Zoning Ordinance, adopted September 19, 1989, is hereby amended to include: SIDEWALK SIGNS: A portable sign for temporary placement on a sidewalk in the public right-of-way, intended for a building or business located adjacent to the right-of-way with no front yard or a front yard that will not accommodate a permanent free-standing sign as permitted by this ordinance. SECTION 2. Section 10.l.C. "General Provisions" Ordinance B, City of Rosemount Zoning Ordinance, adopted September 19, 1989, is hereby amended to include: 21. Sidewalk signs are allowed without a permit only in the Community Commercial(C2) District with the following standards: a. Signs shall be limited to two (2)feet in width and three and one-half(3.5) feet in height, including support members. b. No sign shall have more than two (2)faces. c. Signs shall not limit the normal pedestrian use of the sidewalk, and a minimum passable contiguous space of three(3)feet shall be maintained at a11 times. d. One (1) sign is pernutted for each building adjacent to the public right-of-way, unless multiple businesses within one building a11ow separate business signs to be spaced no closer than thirty(30) feet from another sidewalk sign. e. A business or building with two right-of-way frontages may display a sidewalk sign on either frontage. f. All signs must be removed from the sidewalk at the end of each business day. g. No sidewalk sign shall be lighted by attached external or individual internal lights. SECTION 3. This ordinance shall be effective immediately upon its passage and publication according to law.
