The attached ordinance was resented to Ci Council on A ril 1, 1997. As requested, the revised ordinance ',

exempts government agencies from 4-4-7: D. , the regulation of providing a comprehensive general liability ',
insurance policy and waiver. A summary of the ordinance follows: '
Pnrnose- To insure the health, safety and welfare of large public gatherings in city parkland.
Definition of lax�e public athering- 500 or more persons.
Large Assemblv License- Organizers of special events attended by 500 or more persons shall obtain a large '
assembly license. City Council reviews and approves the license.
Application- Application for large assembly license must apply 60 days in advance of the event. The application
contains a detailed plan of the event identifying purpose, number of persons attending, sound amplification
controls, food& concessions, waste disposal, sanitary facilities, inspections of equipment and vehicles, post
event clean-up, and other precautions necessary to conduct the event safely.
Fees - The proposed license fee is $150.00 (based upon the estimated cost of staffto review an application).
Attached is a resolution for City Council consideration to set this fee at the proposed $150.00. All City costs
associated with the event sha11 be paid by the applicant in the form of a cash escrow. A surety bond or other
form of financial guarantee may be required to guarantee any conditions imposed by City CounciL
Insurance-The applicant (except government agencies) shall maintain a general liability insurance policy naming
the City as additional insured.

AN ORDINANCE RELATING TO THE REGULATION OF PARKS;
AMENDING TTTLE 4,WITH CHAP'TER 4, OF THE
CTTY CODE OF ROSEMOUNT
The City Council of the City of Rosemount,Minnesota ordains that Title 4 of the Rosemount City
Code is amended by adding a new Chapter 4 as follows:
TITLE 4
CHAPTER 4 LARGE PUBLIC GATHERINGS ON CTTY PARKLAND

4-4-1: PURPOSE: The purpose of this Chapter is to regulate and control the assembly of '��
large numbers of persons on city parkland and to establish regulations which promote the health, �'
safety and welfare of large public gatherings organized on city parkland. ,
4-4-2: DEFINITIONS: Large assembly means a gathering numbering more than five
hundred(500) persons; or actions by one or more persons the intention of which is to attract and
assemble a gathering of persons in excess of five hundred(500) persons at a single time on city
parkland.
4-4-3: LICENSE REQUII2EMENTS: No person shall permit, maintain, promote,
conduct, advertise, manage, sell, barter or give tickets to an actual or reasonabiy anticipated
assembly of five hundred (500) or more people on city parkland unless a license to hold the
assembly has been first issued by the city council as provided herein. In addition to the pernut
required herein, the applicant must possess and submit to the city any other necessary state,
county or city licenses and/or permits necessary to carry on the assembly.

4-4-4: APPLICATION FOR LICENSE: The application for a large assembly license
shall be made in writing and filed with the city clerk no less than sixty(60) days in advance of the
proposed date for the large assembly, upon forms provided by the city clerk. The application shall
contain, without limitation, the following information:
A. The name, age, residence, social security number and mailing address of the applicant, if
an individual, all partners if a partnership and all officers of the corporation if the applicant
is a corporation.
B. A full description of the nature, purpose and extent of the praposed large assembly.
C. The maximum number of persons which the proposed large assembly will attract at any
given time, together with the dates and hours dwing which the proposed large assembly
will be conducted.
D. A full description of plans for sound amplification and sound control to be utilized by the
applicant.
E. Plans for food or other concessions which will be provided.
F. A detailed plan to insure waste disposal, sanitary facilities, inspections of vehicle or
equipment, post-event clean-up and other necessary precautions to prevent pollution to
land or ponds. ',
G. All other information required or requested by the city council or the parks and recreation I�
department.
4-4-5: LICENSE FEES: The license fee shall be set from time to time by city council
resolution.
A The license fee shall be nonrefundable.
B. As a condition of granting a license the city may require establishing of a cash escrow to
be deposited with the city clerk. The cash escrow shall be used to guarantee payment by
the applicant of the city's costs for planning, sanitation, health, traffic control, law
enforcement services and other city costs which are directly attributable to the large
assembiy.
4-4-6: CONDITIONS OF APPROVAL: The city council may impose any condition
reasonably required to protect the health, safety and welfare of the general public and the persons
assembled. A violation of any of the conditions sha11 be a violation of this ordinance.

4-4-7: ADDITIONAL REGULAI'IONS: The following regulations must be complied with:
A No person granted a pemut pursuant to this ordinance shall gain a vested right to obtain
such pernuts in the future.
B. By making application, the applicant consents to pernutting officers and agents of the city
to enter the event area at all times to investigate the activities and to deternune whether
the conditions of the permit and all applicable laws are being complied with.
C. A surety bond or other financial guarantee approved as to form by the city clerk in an
amount deemed sufficient by the city council to guazantee performance by the applicant of
the conditions may be imposed by the city council amount in granting the lazge assembly
license.
D. A comprehensive general liability insurance policy, naming the city as an additional
insured, covering any and all damages, claims or other liabilities arising out of the
operation of the large assembly whether incuned by the city or by any other association or
person. Government agencies do not apply to this condition.
E. No person holding a large assembly license shall permit and no participant in a large
assembly shall remain overnight at the location of a lazge assembly, except for a
reasonable number of persons required for security purposes.
4-4-8: PENALTY: Any person violating any provision of this Chapter is guilty of a
misdemeanor and upon conviction thereof shall be punished not more than the maximum penalty ;
for a misdemeanor as prescribed by law. '
This ordinance shall be ef�ective the day following its adoption and publication. '

A RESOLUTION ESTABLISHING LICENSE FEE FOR LARGE PUBLIC GATHERINGS ON CITY
PARKI.AND.
WHEREAS, the City Council has reviewed the need to establish a license fee for large public gatherings on city
parkland.
NOW, THEREFORE,BE IT RESOLVED, that the City Council of the City of Rosemount hereby sets the
license fee at one hundred fifty dollars($150.00).
ADOPTED this 15th day of April, 1997.
