Rec.: Approval(4-1) SUMMARY Endres Processing, LLC. is proposing to develop a 50 - 60,000 sq. ft. building on property currently owned by Pine Bend Development Co. Endres will purchase the property if the project is approved. The property consists of several parcels which if combined, will amount to appro�mately 54 acres. The platting process combines the parcels and eliminates interior property boundary lines which cause setback issues with the zoning ordinance standards and the uniform building code. The combined property will have a very low intensity of development as a result of city required green space requirements and river bluff protection which is mandated by the Mississippi River Corridor Critical Overlay District (MRCC). The standards of MRCC are imposed with the intent of protecting the aesthetics and views of the Mississippi River corridor. It should be noted that industrial development is permitted and expected within the Urban Diversified District of MRCC of which the Endres site is a part. On Maxch 11, 1997, the Planning Commission conducted a public hearing as required for the review of the plat. The Commissioners questioned the status of the Comprehensive Guide Plan Amendment, site access issues and the approval of the Minnesota Department of Transportation. After further explanation of the former inconsistency between the zoning and land use designation, the Commission adopted a motion to recommend approval of the administrative plat. RECOMMENDED ACTION: Motion to adopt a resolution conditionally approving the administrative lat for Endres Pro erties Addition. Seconde d by D� �f�e M�eso ta De�ements for easem e n ts, ger• Na y s: S h o e-Comg� Motion t as A y es' D roste P�e n t o f P ses 4_1, � Weisensel, DeBettigru�s� CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1997- A RESOLUTION APPROVING THE ADMINISTRATIVE PLAT FOR ENDRES PROCESSING, LLP WHEREAS, the Planning Department of the City of Rosemount received an application for approval of an administrative plat from Endres Processing, LLC, concerning fifty acres of land between Pine Bend Trail and TH 55 legally described as: That part of the Southwest Quarter of the Northwest Quarter,and of the Southeast Quarter of the Northwest Quarter, and of the Northeast Quarter of the Southwest Quarter,Section 20,Township 115,Range 18,lying Nartheasterly of the , Northeasterly right of way of State Trunk Highway No. 55 and lying Southeasterly of the Southeasterly right of way of the Chicago and Northwestern Railway Company as per deed of record,Book 284 of Deeds,pages 414-417 and also '� that part of the West one half of the Southwest Quarter of the Northeast Quarter of said Section 20,lying Southerly of I said Chicago and Northwestern Railway Company right of way,and subject to Pine Bend Trail all in Dakota County, Minnesota. WHEREAS, on March 11, 1997, the Planning Commission of the City of Rosemount conducted a public hearing for review of the administrative plat as specified by the Subdivision Ordinance, and, WHEREAS,the Planning Commission adopted a motion to recommend approval of the administrative plat, and, WHEREAS, the City Council reviewed the administrative plat with the benefit of the Planning Commission recommendation and discussion. NOW, THEREFORE, BE IT RESOLVED,that the City Council of the City of Rosemount hereby approves of the administrative plat for Endres Properties subject to: 1. Compliance with the subdivision requirements for easements for drainage, ponding and utilities as detailed in a letter to the consulting engineer dated March 27, 199�, and GIS fees; 2. Approval of the Minnesota Department of Transportation as required including driveway permit; 3. Payment of storm water area charges of$30,738 paid prior to any grading of the site (based upon 10.9 acres of area disturbed or graded. Grading and construction of the proposed rail spur will require an additional $8,460, based upon the additional3 acres based upon a rate of$2,820 per acre; and, 4. Sunde Engineering, Inc. 4200 West Old Shakopee Road Bloomington, MN 55437 Re: Endres Processing Site Piat City of Rosemount Dear Ms. Rojina: Attached is a copy of the preliminary plat with highlighted areas of ponding and utility easements which will be required on the plat. A "ponding and utility" easement should be shown on the plat at the 844.2 contour and below. This ponding easement is located in the north central portion of the proposed plat. In addition there are three drainage and utility easements which should be marked on the plat where water is channeled away from State Trunk Highway 55 (Courthouse Boulevard). There also should be a drainage and utility easement which will be a future outlet for the pond, which generally is in a southwest to northeast direction in the northern area of the plat. These four "drainage and utility easements" should be labeled as such and should be 25' in width. It appears that the two southerly channels f�om Trunk Highway 55 to the ponding area may be effected by the proposed construction of the driveway entrance and may have to be modified per the construction plans.
