Guide Plan: General Industrial I Planning Commission Recommendation: Approval with Conditions �', SUMMARY '' This item is the final approval needed for the General Industrial planned unit development requested by Jerry Anderson of AAA Auto Salvage. A PUD was required because of the proposed expansion of the site from 20 to 30 acres, the establishment of multiple uses/businesses and the ultimate construction of a new 34,000 sq. ft. building on the ten acre expansion area. Any one of the three situations requires PUD approval in the IG district. An administrative plat has been previously approved on October 15, 1996 for the combination of the parcels. On Apri122, 1997, the Planning Commission conducted a public hearing as required which focused primarily on site plan issues of the new building and the overall site organization. No one appeared for comments and the � Planning Commission adopted two motions regarding the PUD. The site plan fell short of the 25% required green space by 1 to 2%. The Planning Commission adopted a motion(4-1) to direct staffto prepare findings in support of the green space deficiency variance with additional landscaping along the northern perimeter as a trade-off. The Planning Commission then adopted a motion to recommend approval of the PUD with the exclusion of the landscaping requirement for the entire perimeter(5-0). RECOMMENDED ACTION: Motion to adopt a resolution approving the General Industrial PUD for AAA Auto Salvage with conditions. COUNCIL ACTION: CTTY OF ROSEMOUNT DAKOTA COUNTY,MINNESOTA RESOLUTION 1997- A RESOLUTION APPROVING T� GENERAL INDUSTRIAL PI.ANNED UNIT DEVELOPMENT FOR AAA AUTO SALVAGE WITH CONDTTIONS WHEREAS,on November 7th, 1995, the City Council of the City of Rosemount adopted a resolution 1995-86 approving the concept for a General Industrial planned unit development for AAA Auto Salvage with conditions, and, WHEREAS,on April 22, 1997, the Planning Commission of the City of Rosemount conducted a ublic hearin to hear testimon regardin the final development plan requirements for planned P � Y g unit development in accordance with Section 12 of the City of Rosemount Zoning Ordinance, and, WHEREAS,the Planning Commission adopted a motion to recommend that the City Council II approve the planned unit development with conditions and a minor variance to lot coverage standards with additional landscaping in return. NOW,THEREFORE, BE IT RESOLVED,that the Council of the City of Rosemount hereby , approves the General Industrial Planned Unit Development for AAA Auto Salvage located at I, 2595 160th Street West subject to: �, 1. Recording of a plat combining the thirty acres into one iot with right-of-way dedicated and '� driveway issues addressed as required by Dakota County as well as modification of the ', site plan to eliminate any setback encroachments that may result; " 2. Curb and gutter must be installed along all parking lot and driveway exterior edges, and ' curb stops must be installed to channel interior parking areas; , 3. Proof of parking and access agreements or covenants guaranteeing sufficient access and parking to a11 uses established in the PUD; � 4. The entire perimeter must be enclosed by a fence 8 feet tall to screen the property from dissimilar uses with additional trees planted along the northern perimeter of the site to be approved by Staff; 5. Incorporation of comments/recommendations related to charges, fees, grading and easements indicated of Bud Osmundson's 9-18-96 correspondence; and, 6. The Plan provides sufficient open space and evidences a substantial preservation of natural features to warrant the granting of variances through Planned Unit Development. Over four acres of the site has been reserved for ponding purposes on the north west corner. This ponding area contributes towards the complex of ponds and wetlands between the�usiness Park and the 160th Street Generad Industriad District. This ponding area creates a transition to the Business Park area and the City has an interest in planting over story shade trees along the edge of the pond and northern perimeter of the f'enced recycling area. 2. The Plan complies with the intent of the Comprehensive Guide Plan. The property occupied by AAA Auto Salvage is guided for General Industrial use. The Auto Salvage business is considered to be a permitted use in the General Industr•ial District with conformance with the recycling standards. 3. The proposed development will not be detrimental to surrounding properties. The site is in the interior of a General Industrial District, and fronts on a codlector street. The property to the south in Empire Township is expected to remain f-ural, or without urban services through 2040. No evidence is available to support an impact o,f'detrimental effect. 4. The Plan is more creative and will provide a better living, working, or shopping I environment than is possible under strict ordinance requirements. The PUD is required by ordinance for multiple uses, buildings or parcels in the General Industrial District. The opportunity to enhance vegetative screening on the north edge of the � outdoor storage area will provide additional buffering of dissimilar uses. It also be noted that the Business Park is typically ten feet higher in elevation than the General Industrial District which means that every opportunity to plant shade trees shoudd be taken to screen outdoor storage areas. There was discussions concerning the possibility of future d elopment requiring improvements to th ement and access to the properties by e rgency vehicles. Conunissioner Tentinger in ' ted to both the applican and to Mr. Mickelson that, if in the future the City decides to upgrad�this easement, th andowners must be aware they may be assessed the cost for such improvem ts. Ch ' erson Droste closed the Board of Appeals and Adjustments and recon ned the P anning Commission hearing. Public Hearing• AAA Auto Salvage Planned Unit Development Plan. Chairperson Droste opened the public hearing for the AAA Auto Salvage Planned Unit Development Plan. The recording secretary has placed the�davit of Publication and Affidavit af Mailing and Posting of a Public Hearing Notice on file with the City. Mr. Pearson presented the final development plan of AAA Auto Salvage, consisting of a new building, mulriple uses, and the combination of several parcels into one. The business is expanding to provide a self-service feature. Mr. Pearson reviewed the site plan and building plan maps. The site will meet the green space requirements with an addiriona125 foot setback along the eastern edge. Chairperson Droste opened the floor to the applicant. Jerry Anderson, owner of AAA Auto Salvage, was present. In response to Commissioners' , questions, Mr. Anderson indicated the new fencing would be metal chain link with slats. ' The new driveway is posirioned to align with a drive-thru service and to allow traffic to flow Planning Commission Regular Meeting Minutes Aprii 22, 1997 Page 8 to the loading dock. The existing buildings will be leased out. Mr. Anderson explained that it is critical to his business to maintain sufficient inventory and that the 25 foot setback requested by the City for green space would reduce the space he needs to store inventory. Mr. Anderson described the landscaping already done, which he believes exceeds what is required. He e�ects to add to the eacisting landscaping. Additionally, as concerns the requirement for curb and gutter, Mr. Anderson requested that it be required only on the front entiy and corners, and eliminated along the pazking lot. MOTION by Droste to close the public hearing. Seconded by Tentinger. Ayes: DeBettignies, Tentinger, Droste, Shoe-Corrigan, and Weisensel. Nays: 0 Commissioner Droste inquired about the curb and gutter requirement. Mr. Pearson explained that a variance would be needed to exclude this requirement. There was an extensive discussion concerning the green space requirement. Without the 25 foot setback, AAA would be appro�cimately '/z acre short in green space. To avoid reduced inventory storage space, AAA offered to do additionallandscaping as a lrade-off for the reduced green space. Planned Unit Developmeat On October 15, 1996, the City Council approved the concept for a General Industrial PUD for AAA Auto Salvage for multiple buildings and uses to be located on several parcels of land to be combined into one lot. Subsequently, the administrative plat had been approved with conditions. ' The site plan or final development plan review is the culmination of the PUD. A new 34,000 sq. ft. building will be located about 100 feet east of the existing building. AAA Auto Salvage will be located in the new building with two separate retail entrances. The business is being expanded to include a"you pick `em" salvaged parts area where customers will physically remove parts from cars in the storage area behind and north of the building. ACCESS AND CIItCULATION Two driveways are proposed to the site. The existing driveway and a new one approximately 420 feet east. 160th Street West will be improved as a county highway project and will control access. For the present, the driveways are acceptable to the City with minor modifications. However, the driveways should be modified to be consistent with County recommendations at the time of the improvement project. Briefly, the existing driveway should realign with a north-south public street located midway between STH 3 and Biscayne avenue. The new driveway should be located 600 feet east of this new street in accordance with 1/8th mile intersection spacing requirements. Parking will be located in the front yard and between both buildings. Stai�is satisfied that sufficient parking is being added for the new building, but is concerned that all of the uses should have the right to share the parking with sufficient ability to expand if necessary, in the future. SITE ORGANIZATION The thirty acre combined site is 1/4 mile deep with large outdoor fenced storage areas behind the buildings. In accordance with the recycling standards of Section 14.9, the outdoor storage areas should be screened from surrounding uses with a fence and landscaping. A fence with a 25 ft. setback is located on the west side of the original salvage yard. The east side is partially fenced already from the adjacent property and a retaining wall is proposed. Staffwill recommend that a 25 foot setback be located on this side to ensure that the required green space is provided. Lastly, , a 4.1 acre ponding area is located on the northwest corner of the site to accommodate storm water runoff and sedimentation prior to linking with wetlands to the north. � ,��; as��r + �,— s�ya,��, �, FS� �. BUILDING CHARACTERISTICS A,ND LANDSCAPING The new building will be two`stories high and constructed of pre-cast"tip up" panels with windows and a glazed entry area at the southeast corner. The wall surfaces between the uppec windows and the roof will be metal. As proposed, the building exceeds materials requirements for the General Industrial District. A combination of boulevard trees and foundation plantings are proposed for the front yard of the new building which are consistent with minimum standards. Sta.i�believes that some trees should ` be planted on the perimeter ofthe storage area consistent with the intent of the recycling xequirements. If not on the east side, then at least on the north side which wiil eventually be visible from the Business Park. CONCLUSION . Much discussion has occurred regarding the need to combine the parcels into one. The concentration of required green space in the northwest corner pond is one of the prirnary reasons. The eastern ten acres cannot stand alone without the pond providing xhe required green space. In addition, new parcels will have to conform with the green space requirements (as weli as a11 other applicable ordinance standards) unless appropriate mechanisms are created"such as deed restrictions and/or conditional variances if future subdivisions are anticipated. Said property is adjacent to proposed County Road 46 (160th Strest) and is, therefore, subject to the Dakota County Contiguous Piat Ordinance. Proposed County Road 46 is part of #he 5-year CIP and a grant application #or Federal ISTEA funds has been submitted for the project from CSAH 31 to Trunk Highway 52. The County does not have adequate projected ADT data avaiiable to determinethe actual type of road that wiit need to be built in the future. The Plat Commission feels there are enough potential development passibilities in the area to warrant preserving adequate rigM of way for a future 4 lane divided highway. These possibilities incfude the possible sale and development of the University of Minnesota Res�arch Center, the location of a MERTS facility in Rosemount, and the Metropolitan Councii's 20 year proposed expansion of the MUSA boundary. The final plat as submitted by the City does not meet the County's access spacing and right of way guidelines for a 4 lane divided highway. The right of way guidelines call for 75 feet of half right of way. The access spacing guidel�nes call for quarter mile spacing for full intersections and eighth mile spacing for right iNout intersections of pubiic streets. The Plat Commission recommends the City incorporate into the design of this development future pubiic street access- at the west property line (half miie west of Biscayne Ave.) and at 660 feet east of the west property line. The existi�g driveway could remain in use until such time as the road actually becomes a eounty road and the re-constroction begins. County guidelines on a 41ane divided highway do not allow private driveways and the existing driveways onto 160th Street may be eliminated. It is the recommendation of the Plat Commission not to approve the plat as submitted. The Plat Commission requests the City to reconsider the proposed deveiopment to incorporate the County's access spacing and right of way guidelines for a four tane divided highway.
