The City received a petition from the vacant lot owners in the Broback Industrial Park to
improve the street so that homes could be built upon these lots. The Broback Industrial
Park (BIP) plat was approved in 1973 with the intention of developing a business or
industrial park. At this time there is one land owner within the BIP which is Rosemount
Woods, (a cabinet making shop). One outlot within the subdivision is owned by the City
and is used for storm water ponding purposes.
The owners of the vacant lots also recently had the property rezoned from Business Park '
to Single Family Residential with the intent to develop the nine (9) vacant lots into single
family home sites. These lots are unusually large, most being appraximately 1 .2 acres in
size with 150 feet of frontage along the service road, which is parallel to Diamond Path.
In completing the Feasibility Report, Staff is recommending to construct an outlet for the�
pond in the BIP. This adds to the cost of the project which will be assessed to the
vacant lots. The total cost of the project is approximately S 180,000 of which
approximately $158,550 is proposed to be assessed against the lots. The estimated
cost per lot is 515,855 to complete the street paving and a portion of the cost of the
outlet to the pond. There is a storm pipe oversizing cost which Staff is recommending
be paid for out of the Storm Water Core Fund in the amount of 521,450. The Utility
Commission recommended that the project be constructed as described in the Feasibility
Report.
Since this per lot amount is high for a single family lot, the City Attorney and myself
recommend that the City hold the assessment hearing and wait for any appeals prior to
awarding a contract for the work.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION RECEIVING THE
FEASIBILITY REPORT AND SETTING A PUBLIC HEARING FOR BROBACK INDUSTRIAL PARK

A RESOLUTION RECEIVING THE FEASIBILITY REPORT /SET PUBLIC HEARING
BROBACK INDUSTRIAL PARK ADDITION STREET UTILITY IMPROVEMENTS
CITY PROJECT #279
WHEREAS, pursuant to the resolutions of the Council adopted on November 19, 1996, a
report has been prepared by the City Engineer with reference to the improvement of Broback
Industrial Park Addition Street Utility Improvements, City Project #279, and this report
was received by the Council on March 4, 1997, and
WHEREAS, the report provides information regarding whether the proposed project is
necessary, cost effective, and feasible.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF ROSEMOUNT, MINNESOTA:
1. The Council will consider the improvements in accordance with the report and the
assessment of abutting property for all or a portion of the cost of the improvements
pursuant to Minnesota Statutes, Chapter 429 at an estimated total cost of the
improvements of 180,000.
2. A public hearing shall be held on such proposed improvements on the 18th day of
March, 1997, in the Council Chambers of the City Hall at 8:00 p.m. and the clerk
shall give mailed and published notice of such hearing and improvements as required
by law.

1 EXECUTIVE SUMMARY
The Broback Industriai Park Street & Storm Sewer Improvement, City Project No. 279
consists of paving the existing street subgrade, installing storm sewer from Upper
145th Street West to outlet the pond on City Outlot B, and installing additional catch
basins on the frontage street.
This Feasibility Report proposes the construction of approximately 1,400 feet of
street and two cul-de-sacs. It also proposes the installation of two catch basins and
180 feet of 15" storm sewer on the frontage streets as well as the installation of 600
feet of 27" storm sewer from Upper 145th Street West to the pond on City Outlot B.
The total estimated cost of the project is approximately S 180,000. Funding for the
project will come from assessments to the benefited properties and the Storm Water
Core Fund. The project construction could be completed by July of 1997 with the
assessment hearing in the fall of 1997.
Due to the relatively high per cost for basically street improvements, and the fact that
the Rosemount Woods Cabinet Shop already has a driveway access, Staff
recommends that the City Council hold an assessment hearing prior to awarding a
contract on the proposed project. If appeals are filed then the project should not be
constructed until the issues are resolved.
The proposed improvement is feasible, necessary and cost-effective from an
engineering standpoint, and is best made as proposed and not in connection with
some other improvement.
