Normally, the full text of ordinances is published in the official newpaper as required by Minnesota Statute. In the case of Title 9, the cost for publication of the entire text would be substantial. The alternative is to publish a summary with the entire text available for review in the reception area of City Hall. The revised code will be available for a minimum of sixty days. The revised Title 9 also requires, as a houskeeping measure, the repeal of Section 14.6 of the Zoning Ordinance,pertaining to the Design, Installation and Maintenance of Individual Sewage Treatment System,which is now included in Title 9. '', Authority Action: s _. City of Rosemount Dakota County,Minnesota SUMMARY OF ORDINANCE NO. XVIII.10 CITY OF ROSEMOUNT, DAKOTA CQUNTY,MINNESOTA Title 9 of the City Code far Rosemount, Minnesota currently addresses building regulations, including four chapters, as follows: Chapter 1 - Building Code Chapter 2 - Excavations and Grading Chapter 3 -Electrical Installations, Regulations Chapter 4-Building and Property Maintenance Title 9 is repealed in its entirety and replaced with the following seven chapters, which are summarized as follows: Chapter 1,Building Code. This Chapter includes the adoption of the State Building Code and all amendments, including legal grounds for enforcement and administration of all other codes and regulations outside of the State Building Code. It includes information related to building code application, administration, enforcement,permits, fees,violations,penalties and appeals. Chapter 2,Excavations and Grading. This Chapter was amended only to make it conform with state statutes for misdemeanar offenses. Chapter 3,Electrical Installations, Regulations. This Chapter removed ordinance language regulating electrical inspectors' maral character, clarified city contracting language for the electrical inspector's position, added an updated language for the adoption of the current state electrical code, and added electrical inspectors' and contractors' licensing and insurance . requirements. Chapter 4,Building and Property Maintenance. In this Chapter,retaining walls were added for the enforcement and rnaintenance of these types of structures. Abatement provisions were rewritten for clarity, and the penalty provisions were amended to confarm with state statutes. Chapter 5,Building Code; Moved Buildings and Structures. This Chapter is new in Title 9 of the City Code. It regulates the transport and moving,storage and placement of moved buildings and their corresponding structural condition and treatment. It also regulates moved building site conditions, timing and bonding requirements. Chapter 6,On-Site Sewage Treatment System Regulations. This Chapter was moved from Section 14.6 of the Zoning Ordinance B and placed within Title 9 of the City Code. Minor amendments were made, including that appeals made to the septic rules are no longer appealed to the Planning Commission. Chapter 7, Construction Operations and Excessive Noise. This chapter is new in Title 9 of the City Code. It establishes construction activity hours as follows: (a) 7:00 a.m.-10:00 p.m. Monday-Friday; (b) 7:00 a.m.-7:00 p.m. on Saturday; and(c) 9:00 a.m.-5:00 p.m. on Sunday. ._ * :Summary Ordinance No:XVIIIIO A copy of the full text of this ordinance is available to anyone during normal business hours at City Hall, 2875 145th Street West, Rosemount, Minnesota. Walsh, City Clerk City of Rosemount Dakota County,Minnesota Published in the Rosemount Town Pages this day of , 1997. / • CITY OF ROSEMOUNT DAKOTA COUNTY,MINNESOTA RESOLUTION 1997- A RESOLUTION APPROVING A SUMMARY OF ORDINANCE NO, XVIII.10 AND DIRECTING PUBLICATION AND POSTING THEREOF WHEREAS, on September 2, 1997, the Rosemount City Council adopted Ordinance No. XVIII.10,Title 9, Building Regulations; and, WHEREAS, said Ordinance is lengthy, and the City would incur unnecessary expense by the publication of the entire text of the ordinance; and, WHEREAS, City staff has prepared an ordinance summary which the City Council has reviewed and which the Council finds would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota, as follows: 1. The ordinance summary attached hereto is hereby approved. 2. The City Clerk shall publish the ordinance summary in the official newspaper pursuant to and in accordance with the requirements of Minnesota Statute Section 412.191, Subd. 4; and 3. The City Clerk shall make available a copy of the full text of the ordinance to any person during normal business hours and shall post a copy of the full text of the ordinance on the public bulletin board at City Hall for a period of sixty(60) days from the adoption of this ordinance. AN ORDINANCE AMENDING ORDINANCE B j CITY OF ROSEMOUNT ZONING ORDINANCE �I THE CITY COUNCIL OF THE CITY OF ROSEMOUNT HEREBY ORDAINS that Section 14.6 Design, Installation and Maintenance of Individual Sewage Treatment Systems contained in Ordinance B - City of Rosemount Zoning Ordinance, shall be repealed in its entirety.
