Normally, the full text of I ordinances are published in the officiat newspaper as required by Minnesota Statute. In the case of the subdivision ordinance, a special edition would be required at a prohibitive cost. The alternative is to publish a �I summary with the entire text available for review in the reception area of City Hall. The ordinance will be �i available for a minimum of si�y days. RECOMMENDED ACTION: Motion to adopt a resolution approving a summary of Ordinance No. B- i 91 and directing publication and posting thereof. COUNCIL ACTION: I RESOLUTION 1997- A RESOLUTION APPROVING A SUMMARY OF ORDINANCE B-9188 AND DIRECTING PUBLICATION AND POSTING THEREOF WHEREAS, on July 15, 1997, the Rosemount City Council adopted Ordinance No. B-91 entitled An Ordinance Amendirzg Ordinance Xl�IL�; The Subdivision Ordinance (Subc�ivision Ordinance); and, WHEREAS, said ordinance is lengthy, and the city would incur unnecessary expense by the publication of the entire text of the ordinance; and, WHEREAS, city staff has prepared an ordinance summary which the city council has reviewed and which the council finds would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota, as follows: 1. The ordinance summary attached hereto is hereby approved; 2. The city clerk shall publish the ordinance summary in the official newspaper pursuant to and in accordance with the requirements of Minnesota Statutes, Section 412.191, subd. 4; and 3. The city clerk shall make available a copy of the full te� of the ordinance to any person during normal business hours and shall post a copy of the full teat of the ordinance on the public bulletin board at city hall for a period of sixty(60) days from the adoption of this ordinance. B-91 CITY OF ROSEMOUNT, DAKOTA COUNTY, MINNESOTA An Ordinance Replacing Ordinance No.XVII.4; The Subdivision Ordinance The City Council of the City of Rosemount hereby ordains that Ordinance XVII.4 originally adopted on October 19, 1972 and variously amended since,shall be repealed and replaced by a revised and updated Subdivision Ordinance. The new subdivision ordinance provides the city with alternatives regarding the regulation of land subdivision within the city as enabled by Minnesota Statute. The complexity of the city has increased since the original ordinance was adopted and a variety of subdivision applications and process alternatives previously available are necessaty. The comprehensive update of this ordinance includes several significant sections described below. Seetion 1,General. This section includes the purpose and scope of the ordinance and the overall objectives or reasons why the city has authority to regulate land subdivisions. Section 2,Definitions. Common and technical teims consistently used in the regulation of land subdivision are defined in this section which includes more than si�ty defuutions. Section 3,Plat Procedures. This section describes the methods,alternatives,process and requirements for platting land which is the standard method of describing lots created from larger parcels of land for residential or other uses. Section 4,Qualifications for Governing Approval of Plats.Plats must conform with all of the ten criteria contained in this section in order to be approved by the city. Section 5,Subdivision Design Standards and Improvements. This section refers to requirements for public improvements that serve subdivisions. Public street design criteria is included along with easement,grading and park dedication requirements. Section 6,Variances,Exceptions and Planned Unit Developments. This section refers to the zoning ordinance for criteria regarding variances and planned unit developments which are described in detail. Exceptions to the platting requirements are provided in this section. Section 7,Administration and Enforcement. Describes the authority of city officials relative to subdivision regulation and includes criteria for denial of premature subdivisions. Sections 8,9 and 10,Repeals,Validity and Effective Date. Preserves the remainder of the ordinance if a part is declared by a court to be invalid. Effective date indicates the date of adoption of the ordinance by the City Council. A copy of the full text of this ordinance is available to anyone during normal business hours at City Hall,2875 145th Street West,Rosemount,Minnesota. This ordinance shall become effective unmediately upon its passage and publication according to law. ENACTED AND ORDAINED into an Ordinance on the Sth day of August, 1997.
