Staff has reviewed the Domeier's sewer backup claim and concurs with the League of Minnesota Cities
Insurance Trust (LMCIT) that the City was not negligent in causing the sewer to backup. The City should not
assume responsibility if it cannot be proven the obstructions were caused by faulty workmanship or design. This
sewer line has been routinely maintained to assure the lines are free of obstructions not because of design or '�
workmanship but caused by residents putting inappropriate items into the sewer system. II
Staff has been sympathetic with the Domeiers, as we do not want to be in a position of causing them additional
stress in an unpleasant situation; however, due to the facts in this case we agree with the LMCIT in their decision
to turn down the claim.
John Simacek, Risk Management Consultant, will be in attendance to discuss the issue and is prepared to discuss
any questions Council may have.

Dear Mr. & Mrs. Domeier:
It was unfortunate to hear about the sewer back up on June 8, 1997 and the disruption this has caused to your
family. The City of Rosemount does not want to be in a position of causing you additional stress but has to
evaluate fault of damage. In this case our insurance company has deterrruned that the City is not responsible
for damages as identified in Mike Munson's, June 16, 1997 letter.
The City does routinely service lines to assure they are free of debris and Rosemount has prided itself in
keeping a good schedule of maintenance. The reason we routinely maintain the lines is not because of faulty
workmanship but rather to assure the lines are free of obstructions caused by residents putting inappropriate
items into the sewer system.
When the insurance company evaluates if there was fault on the part of the City they provide an answer that
only looks at the facts. They do not consider the human element and the disruption and stress it has caused
you. To date the City has supported the insurance company's findings that the City was not negliaent and the
City does not intend to pursue this issue further.
Attached is our complete file as it relates to the June 8, 1997 backup including our maintenance records you
requested.
This item is not a scheduled item for discussion before the City Council. The City Council must direct this
item to be place on the a?enda before it may be schedule. However, you are invited to come to any City
Council meeting to discuss this issue during the "Public Comment" section of the meeting. At that time the
City Council listens to issues but does not respond. At a future meeting a response is prepared and presented
to the City Council. City Council meetings are at 7:30 PM on the first and third Tuesday of each month.

Claim At: 14557 Dahomey Ave.
There was extensive damage to the drywall and carpet in two rooms as a result of the
sewer line backup. Additional damage to paneling and other rooms possible.
The sewer line was last cleaned on 07/07/95. Most residential areas are cleaned on
a three year schedule. The blockage was approximately 200 to 300 feet from the home. When
it was cleared with the jet truck, it was found not to be caused by tree roots. The cause
of the blockage could not be determined.
We have several polaroid pictures of the damage in the home for file use if needed.

Dear Mr. and Mrs. Domeier:
As you know, our office has handled the investigation of the above captioned sewer back-up on
behalf of the City of Rosemount.
Our investigation into this sewer back-up claim has been completed. It is important for you to
understand that in order for the city to be at fault for your damages, there are four areas that must
be considered. There must be a defect in the city sewer line; the city had to have had knowledge �
of a defective condition in their main line; the city had to have failed to properly respond to their
notice of a defective line; and as a result of the city's failure to respond, the damages occurred.
Our investigation has revealed there was not a defect in the main Iine, the city did not have prior
knowledge that there was anything wrong in their line, the city did promptly respond to your
notice of a back-up and as a result the damages sustained were not as a result of negligence on the
part of the City of Rosemount.
Our investi�ation has revealed that the city has oerformed excellent maintenance on the line
involved and it does not have a history of any prior back-ups.
As a result of the above I will be unable to recommend payment of your claim.

EGLIGENCE
� Minnesota law requ�.r�s cities to exercise r�asonable aare in
th,e design and maintcnance of their sewer systems and in respanse
to notice of a problem. It is well established under Minnesota Law
tlaat negligence is the appropriate standard to apply wher� analXzing
a sanitary s�wer backup claim. This raas set eut by the Minnesata
Supreme Court in Pett�n er v. V��.J.a e of Winneba a, 239 Minn. 156,
at 162, 58 N.W. 325 (1953) :
"'�h� Iaw is well settled that a municipality, while not an
,insurer of the safe candition o� its sewers, is liable fox damages
r�suZting fxom its failure to ex�rcise oxdinary or reasonable car�
ta keep them in repair and free from obstructions.n

Munzcipal tort immunity is pxovided by Minn. Stat. §466. 03,
subd. 6 for "any claim based upon the perforznance or failure ta

which was ana].yzed by the Minnesata Suprem� court in Holmquist v.

Th� doctrine of res ipsa loqu�.tur may be alleged if the
situation is such that it i.s difficult to prove negligence_ '�hen
the law st�tes that the claimant may still recover if he can shaw
that the incident c�rou�.d not hav� occurred but for the neglig�nce of
someone. Claizaants must prove that the �nstrum�ntality is under
the exclusive contral o£ the city. Hanzel v. Good �arth, Inc. , 371
N.W_2d 72 (Minn. App. 1985) .

Dear Mr. Burt:
On June 8, 1997, sewage from the Rosemount city sewer line backed up into our basement.
Fortunately,we were home. We called the city that same evening for your help and had we not
called immediately, several other homes would have also been filled with sewage. Your
seviceman unplugged the line at the corner of Dahomey and Upper 145th Street to relieve the
problem.
Since this unfortunate incident we have had to move out of our house and will not be able to
return until our home is healthy enough to live in again. We did try staying in the house,but all
three of our children became tremendously ill from the fumes and have been to their pediatrician
various times since this incident! We are beginning the process now of completely tearing out
the floors, walls and ceiling so that we can sanitize and refurbish the basement. Nevertheless,
this has been an extremely stressful and costly event of which we have found no help or
sympathy from the City of Rosemount.
On June i l, i9y7, \�Iike iviunson came out io inspect our damage and informed us that the city's I
insurance only covers defects in the city sewage line. Therefore they will not pay for any of the
damages. We believe the city is still at fault. As residents,we have no control over preventing '
this; as a taxpayer and someone who pays a quarterly sewage bill, we expect the city to be able to '
keep the sewage lines open and free from debris which potentially could cause major damages
and unfortunately did to our house. If this means that you need to check the pipelines regularly
and/or replace them with larger sizes, than this is what should be done. Perhaps the angle of the
line is inappropriate. Whatever the reason may be for each specific neighborhood or residential
block, it is your responsibility to management the maintenance of the sewage pipelines and
ensure an incident which happened to our family does not occur.
We expect the city to stand behind their warkmanship and take the necessary actions so that this
does not happen ever again. From our previous conversations with Alfred on the evening of June
8th, he verified that this was clearly a problem with the city sewage line. In addition, per our

conversation with Randy on the afternoon of June 11 @3pm,he specifically said that the corner
of Dahomey and Upper 145th Street"is a problem azea". It would be a shame if the city of
Rosemount should be sued because of something that is preventable.
Please provide us with copies of the maintenance records on the line at the corner of Dahomey
and Upper 145th Street for the past eight(8) years. We would appreciate a response in writing
informing us of the action steps that will be taken to expedite this problem and we are
anticipating a response from you within 10 business days (July 17th). We would also request
that you present this in front of the City Council at the next City Council Meeting.
