Mr. Jim Nordberg is requesting the renewal of the Interim Use Permit (IUP) for The Adventure
Zone, located across TH 55 from U.S.P.C.I. in the General industrial District. The City Council
may recall that considerable efforts were made to bring this outdoor commercial recreational
use into compliance with the original conditions of operation. Mr Nordberg purchased the
business from the previous owner at a critical point in last year's proceedings and immediately
took action to resolve the outstanding issues.
At this time, all of the required site improvements have been made and that compliance with
the conditions of the IUP has been maintained since the last series of inspections have occurred
last year. Therefore, Staff will recommend that the IUP renewal be approved and that the
period be extended to two years, consistent with the Splatball, Inc. IUP on Fahey Avenue.
On April 23, 1996, the Planing Commission discussed the IUP renewal request and passed a
motion to recommend approval with one added condition. The Commission was concerned
that the entrance should be secured and that the hours of operation should be posted on a sign
at the entrance. The site inspection showed that the entrance was secured with a chain and
that Mr. Nordberg had requested a building permit for a permanent sign. The hours of
operation could be posted on the sign to satisfy the Planning Commission's concern.
RECOMMENDED ACTION: Motion to approve the renewal of the Interim Use Permit for
The Adventure Zone / Indoor Splatball Inc. For two years
subject to the attached conditions of operation.

A Commercial Outdoor Recreation Use located in the General Industrial District
This Interim Use Permit (IUP) is valid only for that part of the Northwest Quarter of
Section 20, Range 18 West, Township 115 North lying north of the right-of-way for •
State Trunk Highway 55 and east of Pine Bend Branch railroad right-of-way.
1. This permit shall be reviewed prior to renewal in 1998 for compliance with these
conditions. Thereafter, the City Council will determine the appropriate time
interval for the subsequent renewal procedure.
2. Violation of any specified Interim Use Permit condition or otherwise unlawful
activity may result in immediate termination of the Interim Use Permit.
3. The hours of operation shall be limited to 8:00 a.m. to sunset.
4. No parking is allowed in the Minnesota Department of Transportation (MnDOT)
State Trunk Highway (STH) 55 right-of-way.
5. Conformance with setback and dimensional standards with variance to front yard
setbacks granted only for the purpose of preserving existing vegetation.
6. Parking areas must consist of a minimum of six (6) inches of compacted, crushed
aggregate or other such material as is given prior written authorization by the City
Engineer.
7. The entry drive must be thirty-two (32) feet wide, in conformance with MnDOT
requirements and a culvert must be installed, if required by MnDOT, to facilitate
drainage runoff.
8. All structures must conform with the Uniform Building Code and City of
Rosemount Zoning Ordinance including materials and aesthetics requirements.
9. Conformance with Dakota County Health Department standards for portable
sanitary facilities.
10. Conformance with the City of Rosemount Sign Ordinance.
11. Hours of operation shall be posted on sign at entrance.
That Jim Nordberg, on behalf of The Adventure Zone/Splatball Indoors, hereby
consents and agrees to the foregoing conditions of said Interim Use Permit.

Public Hearing; Splatball Indoors/The Adventure Zone - Interim Use Permit
Chairperson Droste opened the public hearing scheduled at this time to hear public testimony regarding
the application of Splatball Indoors/The Adventure Zone for an Interim Use Permit to allow a
commercial outdoor recreational use in the General Industrial district. The recording secretary has
placed the Affidavit of Publication and Affidavits of Mailing and Posting of Public Hearing Notice on file
with the City.
Assistant Planner Pearson related that Jim Nordberg, owner of Splatball Indoors, purchased The
Adventure Zone in 1995 and is requesting an Interim Use Permit to allow a commercial outdoor
recreational use in the General Industrial district. Mr. Pearson mentioned that all of the non-conforming
issues that forced the termination of the previous Interim Use Permit has been corrected. On-site
inspections have shown that the site has been cleaned up, the illegal trailer has been removed, the
driveway entrance has been improved with pavement, the drainage has been restored with a culvert and
the parking area has been regraded and crushed rock imported for a parking surface. Mr. Pearson also
stated that Mr. Nordberg has no objections to the proposed conditions on the Interim Use Permit.
Cathy Busho, 12605 South Robert Trail, requested that the Commission add a condition to require the
owner to post a sign at the front entrance of the facility stating the hours of operation.
There being no further comments from the audience, MOTION by Shoe-Corrigan to close the public
hearing. Seconded by DeBettignies. Ayes: Shoe-Corrigan, McDermott, DeBettignies, Tentinger and
Droste. Nays: 0. Motion passes 5-0.
MOTION by DeBettignies to recommend that the City Council renew the Interim Use Permit for
Splatball Indoor/The Adventure Zone for 1996 and 1997 subject to the ten conditions previously
specified by Resolution 1995-19 and an added condition that a sign be posted at the front entrance of the
facility stating the hours of operation. Seconded by Shoe-Corrigan. Ayes: McDermott, DeBettignies,
Tentinger, Droste and Shoe-Corrigan. Nays: 0. Motion passes 5-0.
Public Hearing: Lot Coverage in General Industrial District- Zoning Text
Amendment
Chairperson Droste opened the public hearing scheduled at this time to hear public testimony regarding
the proposed zoning text amendment for lot coverage in the General Industrial district. The recording
secretary has placed the Affidavit of Publication and Affidavit of Posting of Public Hearing Notice on
file with the City.
Assistant Planner Pearson stated that this item was discussed at the March 12, 1996 Planning
Commission meeting. At that time, the Commissioners suggested revisions to the proposed amendment
and requested that this item be scheduled for a public hearing. Mr. Pearson stated that this proposed
