APPROVED BY: Summary and minutes (6-11-96), Comp Guide Plan excerpt Mr. Jim Remder, Mr. John Prinz and Mr. Dick Putnam have an interest in developing approximately 62 acres of land east of Biscayne Avenue and north of the Dakota County Garage for single family residential use. The property is beyond the Metropolitan Urban Service Area (MUSA) and a Comprehensive Guide Plan Amendment will be required to accelerate the expansion of the MUSA to for this property. The proposal is variance free and is described in detail in the attached Planning Commission review. On June 11, 1996, the Planning Commission discussed the proposal at length and adopted motions to recommend approval of the preliminary plat and rezoning to R-1. The dissenting commissioner expressed concern about the proximity of the railroad tracks and questioned the creativity of the design. The commissioner suggested that clustering techniques be used in a manner similar to the CMC proposal to create buffer space near the tracks. The U.S. Army National Guard was represented by Terry Palmer who expressed concerns about future utilization of the O.M.S. facility across Biscayne Avenue. The O.M.S. Facility was constructed with a significantly increased setback and landscaping concentrated along the Biscayne Avenue frontage because of the urban residential land use designation. Approval of the Comprehensive Guide Plan Amendment is necessary for rezoning from Agriculture (AG) to R-1, Single Family Residential. However, it is inappropriate to approve a conditional rezoning. Therefore, action on the rezoning should be undefinitely tabled pending the outcome of the Guide Plan Amendment process. The Preliminary Plat was prepared in lieu of a concept, in support of the Guide Plan Amendment. Therefore, it is premature to approve the preliminary plat. However, the City Council should provide the Developer an indication of the relative acceptance of the plat. The Developer will be asked to accept the tabeling in writing in order to process the amendments. RECOMMENDED ACTION: Motion to indefinitely table action regarding the preliminary plat and rezoning for the Biscayne Pointe residential proposal pending the implementation of a Comprehensive Guide Plan Amendment to include the property in the MUSA as approved by the Metropolitan Council and completion of the preliminary plat requirements. ATTACHMENTS: Preliminary Plat APPROVED BY: ,(" PROPOSAL Mr. Jim Remder, John Prinz and Dick Putnam are proposing to develop the approximately 62 acres of land east of Biscayne Ave. And north of the Dakota County Maintenance Facility currently owned by the Corrigan Family for 155 single e Metropolitan Urban Service The cel Areas currently zoned for Agricultural use and is beyo nd (MUSA). The land is in an area that is designated for urban residential land use in the next phase of MUSA expansion. The proposal is intended to be free of variances and therefore a conventional single family detached preliminary plat proposal. Overall density is 2.5 dwelling units per acre. ACCESS AND STREET DESIGN generally across from the The plat has two primary street connections to Biscayne Avenue, g Y National Guard OMS Facility. The streets intertwine in a modified grid design that is oriented east and west generally parallel with the rail road ROW. Proposed future local street connections are one north and one east. Temporary cul-de-sacs will be required until future development occurs on adjacent property. LOT DESIGN The initial preliminary plat included 23 lot dimension variances. The Developer has responded with a plan revision that is intended to eliminate all variances. The revisions arrived Friday morning (June 7) and a cursory review has (so far) found the revision to have achieved the goal. • PARKS SIDEWALKS/TRAILS AND OPEN SPACE will No park land is included with the current proposal. One is located in the interior of block 5 in the west center of the development and the other is against the wide portion of the RR ROW. /AMENDED ACTION: MOTION to recommend approval of the preliminary plat for Biscayne Point to the City Council subject to: 1) incorporation of recommendations relative to grading, utilities and easements identified by the Public Works Department; 2) incorporation of recommendations relative to the Parks and Recreation Committee for park dedication , sidewalks and trail linkages; 3) adoption of a Comprehensive Guide Plan Amendment to place the 62 acre preliminary plat area in the Metropolitan Urban Service Area; 4) Rezoning of the preliminary plat area to R-1 Single Family Residential (Detached); and 5) conformance with the subdivision ordinance requirements for final plat approval including execution of a development agreement to secure the public improvements, landscaping and potential future phasing considerations; and, MOTION to recommend that the City Council rezone the property to R-1 Single Family Residential Detached " " PLANNING COMMISSION ACTION: • • Regular Planning Commission Meeting Proceedings June 11,1996 Page 4 Th ommissioners and Staff discussed the following: (1) possible MUSA expansion and the effect on fu development; (2) surrounding land uses; (3)bike trails and walk p connecting to the downto area; (4) safety concerns with circular streets and intersections; (5) setbacks. Member DeBe ;:r. 'es stated that he likes this proposal but is"not sold%'"that people will buy these small lots. He felt ' : more information and discussion was needed b' fore a decision could be made. Mr. DeBettignies also -.uested the name and location of a similar development so that he could either visit the site or talk t. e Homeowner's Association. Other Commissioners stated that they too would like this information. Member Tentinger stated that he has , problem wi the road system as he believes it is not practical; however, overall he likes the-concept. Member Shoe-Corrigan stated that she was'm :vor of the clustering of the homes, life-cycle housing, smaller lots and the open space aareas. Sh- would like to visit a similar development and see more pictures and examples of a"ne ditional" de . opment. Ms. Shoe-Corrigan also requested that the a pp licant address Staff's/concerns and Mr. Leon ach's concerns cerns which he stated in his letter to the Planning Commis ion. Public Hearing: Render-Putnam-Prins Partnership - Preliminary Plat/Rezoning Chairman Droste opened the public hearing scheduled at this time to hear public testimony regarding the Render-Putnam-Prins Partnership Preliminary Plat/Rezoning application. The recording secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of Public Hearing Notice on file with the City. Assistant Planner Pearson stated that the City has received a proposal from the Render-Putnam-Prins Partnership to develop approximately 62 acres of land east of Biscayne Avenue, north of the Dakota County Maintenance Facility and north of the railroad tracks for 155 single-family lots. Mr. Pearson briefly reviewed the Preliminary Plat and noted that there are no variances requested. He also stated that no park land is included with this proposal and the Park and Recreation Committee will meet to provide a recommendation in this regards. Mr. Pearson mentioned that a Planned Unit Development is not required because this Preliminary Plat is consistent with all City standards. Staff and Commissioners discussed the MUSA timeline availability. Regular Planning Commission Meeting Proceedings June 11,1996 Page 5 Dick Putnam stated that he is 1 of 3 partners requesting approval of the rezoning and Preliminary Plat. He mentioned that this proposal meets all standards and is very straight-forward. Mr. Putnam stated that he understood the MUSA issue; however, was still hoping to begin development this year. Terry Palmer, a representative of the National Guard, stated that they were concerned with the proposed zoning change. He stated that the OMS Facility and adjacent undeveloped land is west of this proposed development and they foresee this undeveloped land to eventually be used for parking their equipment. Mr. Palmer was concerned that the National Guard's uses be consistent with that of neighboring property owners. A discussion occurred regarding the OMS Facility. As there were no further comments from the audience, MOTION by DeBettignies to close the public hearing. Seconded by Tentinger. Ayes: DeBettignies, Tentinger, Droste and Shoe-Corrigan. Nays: 0. Motion passes 4-0. Member Shoe-Corrigan commented that this was a good proposal; however, she was very concerned about some of the lots abutting the railroad tracks. She felt this was a serious safety issue. Assistant Planner Pearson mentioned that the lots abutting the railroad tracks do conform to the additional setback requirements for railroads. Member Shoe-Corrigan also expressed her concern that this development will not be integrated with the rest of the City. She stated that she would like to see a more creative design approach used for this piece of land. Mr. Putnam addressed Member Shoe-Corrigan's concerns. The Commissioners discussed fences, sidewalks and park issues.
