Mr. Tim Broback, President of Rosemount Development Company is requesting that a 2.08 acre
parcel of land located between Shannon Pond PUD and Westridge Second & Third Additions be
zoned R-1 Single Family Residential Detached. The property is currently zoned AG Agriculture
and contains a storm sewer pipe that connects Westridge Third Addition with the storm water
ponding area west of Shannon Parkway. The land use designation of the parcel is Urban
Residential (UR).
On November 12, 1996, the Planning Commission discussed the requested rezoning in detail.
The size of the parcel caused speculative discussion regarding subdivision potential and the
relationship with another outlot owned by Hampton Development (Developers of Shannon
Pond). Mr. John Broback was present to express the desire of Rosemount Development
Company to build one large house on the property that would have access to Danville Avenue.
After additional discussion, the Planning Commission adopted a motion to recommend approval
of the rezoning. Members of the audience that were present were assured that any subdivision
of the parcel would result in additional public hearing requirements.
RECOMMENDED ACTION: Motion to adopt an ordinance to rezone the 2.08 acres of
land from Agriculture AG to R-1 Single Family Detached
Residential in conformance with the Comprehensive Guide
Plan

AN ORDNANCE AMENDING ORDINANCE B
CITY OF ROSEMOUNT ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS
FOLLOWS:
Section 1. Ordinance B, adopted September 19, 1989, entitled "City of Rosemount
Zoning Ordinance, " is hereby amended to rezone from AG Agriculture to R-1 Single Family
Residential Detached the following described property located within the City of Rosemount,
Minnesota to -wit:
That part of the Southwest Quarter of Section 3 1, Township 115, Range 19, Dakota County,
Minnesota described as follows: Commencing at the northwest comer of Lot 1, Block 3, WEST
RIDGE SECOND ADDITION, record plat, thence North 29 degrees 33 minutes 00 seconds
East, record plat bearing, along the northerly extension of the westerly fine of said Lot 1, the same
being the easterly line of Danville Avenue as platted, a distance of 140 feet to the point of
beginning of the land to be described; thence continuing North 29 degrees 33 minutes 00 seconds
East along said easterly fine of Danville Avenue 120.00 feet to the southwesterly comer of
SHANNON POND, record plat; thence South 60 degrees 27 minutes 00 seconds east along the
southerly line of said SHANNON POND 130.00 feet; thence easterly 153.14 feet along said
southerly line and along a tangential curve which is concave to the northeast, central angle of 22
degrees 46 minutes 14 seconds, radius of 386.94 feet; thence South 83 degrees 13 minutes 14
seconds East along said southerly line and along a tangential curve which is concave to the
southwest, central angle of 21 degrees 41 minutes 14 seconds, radius of 529.85 feet; thence South
61 degrees 32 minutes 00 seconds East along said southerly line, tangent to last described curve,
60.00 feet; thence North 28 degrees 28 minutes 00 seconds East along said southerly line 10.00
feet; thence South 61 degrees 32 minutes 00 seconds East along said southerly line and its
easterly extension 180.00 feet; thence South 28 degrees 28 minutes 00 seconds West 120.00 feet;
thence North 61 degrees 32 minutes 00 seconds West 180 feet; thence South 28 degrees 28
minutes 00 seconds West 10.00 feet; thence North 61 degrees 32 minutes 00 seconds West 60.00
feet; thence westerly 155.13 feet along a tangential curve which is concave to the southwest,
central angle of 21 degrees 41 minutes 14 seconds, radius of 409.85 feet; thence North 83 degrees
13 minutes 14 seconds West, tangent to the last described curve, 29.06 feet; thence westerly
201.47 feet along a tangential curve which is concave to the northeast, central angle of 22 degrees
46 minutes 14 seconds, radius of 506.94 feet; thence north 60 degrees 27 minutes 00 seconds
West, tangent to last described curve, 130.00 feet to the point of beginning.
Section 2. The Zoning Map of the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled "Zoning Map of the City of Rosemount" shall not
be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said
zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove
provided for in this Ordinance and all of the notation references and other information shown
thereon are hereby incorporated by reference and made a part of this Ordinance.
Section 3. This ordinance shall be effective immediately upon its passage and publication
according to law.

Mr. Tim Broback of the Rosemount Development Company is requesting a rezoning of 2.08
acres of land from Agriculture (AG) to R-1, Single Family Detached Residential. The property is
guided for urban residential use in the Comprehensive Guide Plan, and is located between
Shannon Pond and Westridge Second Addition, east of Danville Avenue. The parcel is slightly
irregular in the shape, measuring approximately 120 ft. X 750 ft. The parcel was originally
created for the purpose of locating a storm sewer pipe that drains water from Westridge Third
Addition to a ponding area along the south side of the Shannon Pond additions.
Mr. Broback intends to construct a single family house on the property with frontage along
Danville Avenue.
RECOMMENDED ACTION: Motion to recommend that the City Council rezone the
property from Agriculture to R-1, Single Family Detached
Residential.

Rosemount City Council,
We were recently notified of the upcoming hearing scheduled for November
12, 1996 concerning the strip of property between Danville and Shannon
Parkway, south of Crystal Path. We will attend the hearing in person, but
feel very strongly about this matter and wish to include a letter.
As prospective homebuilders in 1994, our realtor assured us there would
be no building on the property which backs up to our property. That was
the primary reason for us building our home where we did. We were very
impressed that Rosemount was a city that did not build on every space
available, but reserved some of nature's beauty for its residents to enjoy.
in the time we have lived here (since November 1995) we have enjoyed the
open space behind our property. We have enjoyed watching many
neighborhood children use their imaginations as they played in the
"forest" and several neighborhood families as they use the naturally
created paths for walks.
We oppose any building of homes on the proposed site and request that it
remain a natural area. The proposed site is very narrow and would crowd
the area. If any development of this land occurs we would much rather see
a playground and park rather than another housing development.
