The attached ordinance reflects the proposed rezoning of the Wintz Trucking site and the
Brockway Golf Course site to BP -2 Business Park and P Public Institutional respectively. The
Council was asked to table action on November 5th because the zoning district descriptions
had to be prepared by staff as a City initiated rezoning.
The respective rezonings will bring the combined properties into conformance with the
Comprehensive Guide Plan and relieve the Brockway Golf Course of non -conforming use status.
On October 22, 1996, the Planning Commission conducted the public hearing as required by
ordinance. Few persons attended and no one spoke out against the proposed rezonings. Mr.
George Wintz had been contacted by phone and also voiced no objection to the rezoning upon
explanation of the issue.
RECOMMENDED ACTION: Motion to adopt an ordinance rezoning the Wintz Trucking
site to BP -2, Business Park and the Brockway Golf Course
property to P Public Institutional in conformance with the
Comprehensive Guide Plan.

AN ORDINANCE AMENDING ORDINANCE B
CITY OF ROSEMOUNT ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS
FOLLOWS:
Section 1. Ordinance B, adopted September 19, 1989, entitled "City of Rosemount
Zoning Ordinance, " is hereby amended to rezone from IG General Industrial to BP -2, Business
Park, the following described property located within the City of Rosemount, Minnesota to -wit:
East half of Section 20, Township 115, Range 19; all that property located within the following
described line:
Commencing at the north east comer of Section 20, thence south along the easterly
section line a distance of 2,640 feet, thence westerly a distance of 630 feet along a line
south 89D 30M west to the point of beginning. Continuing from the point of beginning,
northerly 1,070 feet north 12D 25 M west; thence westerly, 750 feet along a line south
77D 35M west; thence southerly 667 feet along a line south 12D 25M east; thence
westerly, 370 feet along a line north 75D I OM west to the easterly right-of-way of State
Trunk Highway 3; thence southerly along said right-of-way line 125 feet; thence easterly
370 feet along a line south 75D 10M east; thence southerly 350 feet along a line south
12D 25M east; thence easterly 200 feet along a line north 77D 35M east; thence southerly
2 10 feet along a line south 12D 25M east; thence easterly 170 feet along a fine north 88D
10M east; thence southerly 120 feet along a fine south 12D 25M east; thence easterly 290
feet along a line north 77D 3 5M east; thence northerly 13 5 feet along a fine north 12D

Section 2. Ordinance B, adopted September 19, 1989, entitiled "City of Rosemount
Zoning Ordinance," is hereby amended to rezone from IG General Industrial to P Public and
Institutional, the following desribed property located within the City of Rosemount to -wit:
East half of Section 20, Township 115, Range 19; all that property located east of the right -of
way of State Trunk Highway 3; south of the right-of-way of County Road 38; north of the right-
of-way line of Connemara Trail and Brazil Avenue; west of the SOO Line rail road right-of-way;
EXCEPT all that property located within the following described line:
Commencing at the north east comer of Section 20, thence south along the easterly
section line a distance of 2,640 feet, thence westerly a distance of 630 feet along a fine

Section 3. The Zoning Map of the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled "Zoning Map of the City of Rosemount" shall not
be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said
zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove
provided for in this Ordinance and all of the notation references and other information shown
thereon are hereby incorporated by reference and made a part of this Ordinance.
Section 4. This ordinance shall be effective immediately upon its passage and publication
according to law.

Public Hearing: City of Rosemount - RezoningLComprehensive Guide Plan
Implementation Program
Chairman Droste opened the public hearing to hear public testimony regarding the Rezoning
application of the City of Rosemount. The recording secretary has placed the Affidavit of Publication
and Affidavit of Mailing and Posting of Public Hearing Notice on file with the City.
Assistant Planner Pearson stated that the City is continuing its efforts to bring zoning into
conformance with the Comprehensive Guide Plan. He stated that the area requested to be rezoned is
the Wintz Trucking warehouse (previously the Brockway Glass plant) and the Brockway Golf
Course. Currently this entire site is zoned IG General Industrial and the golf course is legal non-
conforming. Mr. Pearson stated that Staff is requesting that the golf course be rezoned to P Public
and Institutional and the Wintz Trucking site be rezoned to BP -2 Business Park.
As there were no comments from the audience, MOTION by DeBettignies to close the public
hearing. Seconded by Tentinger. Ayes: Tentinger, DeBettignies, McDermott, Shoe -Corrigan and
Droste. Nays: 0. Motion passes 5-0.
MOTION by Droste to recommend that the City Council rezone the Wmtz Trucking site to BP -2
Business Park and that the Brockway Golf Course site be rezoned to P Public and Institutional.
Ayes: DeBettignies, McDermott, Shoe -Corrigan, Droste and Tentinger. Nays: 0. Motion passes 5-0.
