City Project #266, the 1996 Street & Utility Reconstruction Project, is moving along very
well. Plans have been prepared, which are probably at the 60% complete stage. Final
details will be completed by the Consultant and Staff in the next few weeks.
As you are aware, the City needs a right-of-entry from all property owners where
services will be replaced. As of this writing, 29 of 60 right-of-entries have been
received. The City has sent out two letters requesting the right-of-entry to be signed by
the property owners. Staff's recommendation is that if they are not received by the next
Council meeting, eminent domain proceedings be undertaken to assure that the project
can remain on schedule. The eminent domain proceedings will add to the cost of the
project which is borne by the taxpayers and utility users in the City. A significant
amount of Staff time plus legal fees will be required. Hopefully the residents along the
street understand that by not signing all they are doing is adding to the City taxpayers
cost of the project.
I am confident that we will not need to undertake eminent domain proceedings on the
majority of the remaining right-of-entries, however it is our intention to keep the Council
informed and keep the project on schedule.
