March 19, 1996 AGENDA ITEM: Declare Cost/Set Assessment Hearing AGENDA SECTION: Shannon Hills 6th Addition, City Project #251 Consent PREPARED BY: Doug Utterer, Civil Engineer AGENDA ITEM # 4 L ATTACHMENTS: Resolution, Project Cost & Funding APPROVED BY: s/ Summary, Map .i Attached are copies of a Project Cost Summary, a Project Funding Summary and a Resolution declaring all costs for the referenced project. The Feasibility Report project cost estimate was $474,300. The Project was completed on July 7, 1995. The final project costs totaled $369,345 and a summary of these costs are attached. Most of the cost is assessable to the benefitting property which is the Shannon Hills 6th Addition. The final assessable cost to the project was $337,672, which is $11,256 per lot. The remaining $31,673 will come from the Storm Core Fund. City Project #251 was initiated through a petition from Ground Development Corporation for the construction of public streets and utilities for the Shannon Hills 6th Addition. The Public Hearing was held on March 2, 1994. Staff recommended action is as stated below and to set a Public Hearing to consider these assessments on April 16, 1996 at 8:00 p.m. or as soon as possible thereafter. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT FOR SHANNON HILLS 6TH ADDITION STREET AND UTILITY IMPROVEMENTS, CITY PROJECT #251. COUNCIL ACTION: 4 ,._..., CITY OF ROSEMOUNT '`� DAKOTA COUNTY, MINNESOTA _. ���� �•�w`;` RESOLUTION 1996 - 19 A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT SHANNON HILLS 6TH ADDITION STREET & UTILITY IMPROVEMENTS CITY PROJECT #251 WHEREAS, a contract has been let for Shannon Hiils 6th Addition Street & Utility Improvements and the contract price for such improvement is S295,765, and the expenses incurred or to be incurred in the making of such improvement amount to 573,580 so that the total cost of the improvement will be 5369,345. NOW, THEREFORE, BE IT RESOLVED by the City Council of Rosemount, Minnesota: 1 . The portion of the cost of such improvement to be paid by the City is hereby declared to be 531,673 and the portion of the cost to be assessed against benefited property owners is declared to be S337,672. � ,,. Assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with general taxes for the year 1996, and shall bear interest at the rate of 2% points per annum above the interest rate paid by the City for its bonds from date of the adoption of the assessment resolution. 3._ The City Clerk, with the assistance of the Public Works Director shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection; and BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: 1 . A hearing shall be held on the 16th day of April, 1996 in the City Hall at 8:00 p.m. or as soon thereafter as possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will y:` be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state in the notice the total cost of the improvement. .--� Resolution 1996 - 19 - , �,..; `� She shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. BE IT FURTHER RESOIVED by the City Council of Rosemount, Minnesota: The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year.
