Community Center Director. ITEM # 4 J . ATTACHMENTS: Contracts APPROVED BY: 1* Jamie Steckart has terminated his contract with the City of Rosemount. This contract was funded by the State of Minnesota to coordinated services to the Dodd triangle housing area, teen night, and other youth programs. Community Action Council (CAC) has been selected as the contractor for half of Jamie's duties. These duties include the formation of a citizen advisory board, supporting Rosemount Partnership Program on various initiatives, and operating the resource center in Limerick Way. Sheila Klassen has been selected to perform remaining duties including teen night and Youth Service Team. Each contractor will receive $1,458.33 per month until the grant ends on December 31, 1996. CAC will receive an additional $250.00 per month for computer and supply expenses from the Crime Reduction Grant. Both contracts are to begin on March 7, 1996. RECOMMENDED ACTION: Motion to approve the contract between the City of Rosemount and Community Action Council and the contract between the City of Rosemount and Sheila Klassen. COUNCIL ACTION: CONTRACT FOR SERVICES THIS AGREEMENT is entered into the 7th day of March, 1996 by and the City of Rosemount, Minnesota (City) and Community Action Council between ty ( ty) ty c (Contractor). WHEREAS, the City has the need for services of the type provided by the Contractor; and WHEREAS, the Contractor possesses the required experience and expertise for the performance of the required services. NOW THEREFORE, the parties agree as follows: I. Scope of Services. Organize a targeted neighborhood in Rosemount: a) Assist with the formation of Rosemount Partnership Program Citizen Advisory Board. b) Identify the needs of individuals living within the target neighborhood, perform a work plan, and refer to appropriate resources. c) Support the planning, coordination, promotion, and evaluation of Rosemount Partnership Program initiatives, such as but not limited to Community Garden, Job Shadowing Program, Together Time Mondays, Candle Light Vigil, Community Meetings on Gangs. d) Schedule and promote utilization of Community Resource Center. Perform housekeeping and other maintenance duties. Schedule and keep regular office hours. e) Interface with governmental agencies, schools, businesses, faith community, and the residents of Rosemount. f) Attend meetings including but not limited to Family Services Collaborative - East Cluster, Rosemount Partnership Program, Rosemount Activity Program. g) Prepare and distribute minutes of Rosemount Partnership Program meeting. h) Accountable to Rosemount Partnership Program Citizen Advisory Board. Accountable for fiscal responsibilities to the City of Rosemount. i) Prepare and submit Crime Reduction Grant Quarterly Report. j) Perform within budget by monitoring revenues and expenses in assigned areas to assure sound fiscal control; assure effective and efficient use of budgeted funds, materials, facilities, and time management. k) Prepare a variety of studies, reports, and related information for decision-making purposes. 1) Prepare and mail a variety of brochures, calendars, letters, posters, news releases, flyers, meeting minutes and related communication regarding assigned programs. m) Seek additional funding through sponsorships, donations, and grants. n) Perform other related duties as assigned. II. Time of Performance. This agreement will begin as of March 7, 1996, and will terminate December 31, 1996. III. Compensation. Compensation to the Contractor will be paid in monthly payments of $1,708.33. The Contractor shall pay any and all taxes due to Federal, State, or Local governments and the City shall not withhold any amounts for payments of such taxes . IV. Independent Contractor. The Contractor is an independent contractor and not an employee of the City. The Contractor shall retain control over the manner and means of the work set forth above. The Contractor understands and acknowledges that the City shall not provide any benefits of any type in connection with this Agreement, including but not limited to health or medical insurance, unemployment insurance, or workers' compensation insurance. The Contractor will provide for its own computer needs and supplies. V. Insurance. The Contractor shall provide evidence of automobile insurance coverage for all motor vehicles used in connection with work under this Agreement for a single limit for bodily injury and property damage of at least $500,000 per occurrence and general liability insurance in the amount of at least $500,000 per occurrence; and provide a binder of such coverage naming the City of Rosemount as additionally insured. VII. Termination. Either party may terminate this Agreement at any time by giving written notice of the intention to terminate to the other party 14 days prior to such termination. IX. General Terms and Conditions. a) This Agreement may be amended only by written consent of both parties. b) The Contractor (and representatives) must provide evidence of a valid drivers license; in the event that the Contractor's (or representatives') driver license is suspended or revoked during the term of this Agreement, he must immediately inform the City. c) Any and all reports, manuscripts and other work products, whether completed or not, that are prepared or developed by the Contractor as part of this Agreement shall be the shared property of the City and Contractor and such items shall be turned over to the City promptly at the City's request or at the termination of this Agreement; any confidential reports and information shall remain the property of the City. d) The Contractor acknowledges that he has received a copy of the City's Workplace Harassment Policy, and that he understands that he must comply with its terms. The Contractor will plan, conduct, coordinate, and evaluate Teen Night Program and the Youth Service Team Program: a) Supervise, train, direct and evaluate volunteers and interns. b) Perform within budget by monitoring revenues and expenses in assigned areas to assure sound fiscal control; assure effective and efficient use of budgeted funds, materials, facilities, and time management. c) Prepare a variety of studies, reports, and related information for decision-making purposes. d) Communicate official plans, policies, and procedures to volunteers and the general public; respond to routine citizen complaints and concerns regarding assigned programs. e) Prepare and mail a variety of brochures, calendars, letters, posters, news releases, flyers, meeting minutes and related communication regarding assigned programs. f) Seek additional funding through sponsorships, donations, and g rants. g) Maintain accurate inventories and make recommendations for purchase of supplies and equipment. h) Other related duties as assigned.
