Mr. Jeffery Nivila of Basic Builders is requesting approval of the revised preliminary plat, PUD
final development plan and rezoning of the Hawkins Pond area to R-1, Single Family Detached
Residential. The preliminary plat is consistent with the approved concept with one exception.
The westerly terminus of 143rd Street West has been shifted north to align with the anticipated
street design for the Baptist Church property. The street as revised will not create any
additional variances.
On August 27, 1996, the Planning Commission conducted a public hearing as required by
ordinance. No one appeared to testify for or against the proposal. Subsequently, the
Commission passed a motion to recommend approval of the preliminary plat, PUD final
development plan and rezoning of Hawkins Pond to R-1, Single Family Residential Detached.
RECOMMENDED ACTION: Motion to adopt a resolution approving the revised
preliminary plat and PUD final development plan with
conditions; and,
Motion to adopt an ordinance rezoning the Hawkins Pond
property from AG Agriculture to R-1 Single Family Residential
Detached.

RESOLUTION 1996-
A RESOLUTION APPROVING THE FINAL PLANNED UNIT
DEVELOPMENT AND REVISED PRELIMINARY PLAT FOR
WHEREAS, the City Council of the City of Rosemount approved the Hawkins Pond Concept
Planned Unit Development on April 16, 1996; and
WHEREAS, the City of Rosemount has received an application for approval of the Hawkins Pond
Final Planned Unit Development and revised Preliminary Plat; and
WHEREAS, the Final Planned Unit Development and revised Preliminary Plat is in conformance
with the approved Concept Planned Unit Development with one exception; and
WHEREAS, on August 27, 1996, the Planning Commission of the City of Rosemount reviewed the
Final Planned Unit Development and revised Preliminary Plat and has recommended approval of the
Hawkins Pond Final Planned Unit Development and revised Preliminary Plat subject to conditions.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the Hawkins Pond Final Planned Unit Development and revised Preliminary Plat subject to:
1. incorporation of recommendations relative to grading and utilities by the Public
Works Department;
2. provision of a boulevard tree planting plan to be approved by Staff,
3. park dedication in the form of cash in the amount established by resolution; and
4. conformance with requirements for Final Plat including execution of a development
agreement to secure public improvements.

AN ORDINANCE AMENDING ORDINANCE B
CITY OF ROSEMOUNT ZONING ORDINANCE
Hawkins Pond
TBE CITY COUNCIL OF TIHE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS
FOLLOWS:
Section 1. Ordinance B, adopted September 19, 1989, entitled "City of Rosemount
Zoning Ordinance," is hereby amended to rezone from AG Agriculture to R- I Single Family
Residential (detached) the following described property located within the City of Rosemount,
Minnesota to -wit:
Parcel No. 1: The West 164.80 feet of the East 692.17 feet of the South one-half (1/2)
of the Northwest quarter (1/4), Section 30, Township 115, Range 19
Parcel No. 2: The West 164.81 feet of the East 856.95 feet of the South one-half (1/2)
of the Northwest quarter (1/4), Section 30, Township 115, Range 20
Parcel No. 3: The West 299 feet of the East 1155.95 feet of the South one-half (1/2) of
the Northwest quarter (1/4), except the South 370 feet thereof, Section 30, Township
115, Range 19
Section 2. The Zoning Map of the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled "Zoning Map of the City of Rosemount" shall not
be republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said
zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove
provided for in this Ordinance and all of the notation references and other information shown
thereon are hereby incorporated by reference and made a part of this Ordinance.
Section 3. This ordinance shall be effective immediately upon its passage and
publication according to law.
ENACTED AND ORDAINED into an Ordinance this 3rd day of September, 1996.
