This item is on the Agenda for the Council to conduct a Public Hearing to consider the
referenced project. Attached is a Q &A sheet with the majority of the questions raised by
residents at the Informational Meeting held on December 21, 1995. 1 will provide an
overview of the proposed project at the meeting and of the questions raised by
residents.
The most discussed item was the proposed assessments. Residents questioned the
proposed $2,500 single family (SF) amount versus the $1,500 which was assessed on
145th Street. (Council had set the amount at $2,000 per SF lot with a driveway for
residential streets, but lowered it to $1,500 for SF lot on Collector streets such as 145th
Street in the Fall of 1993.) Staff feels the increase is justified due to inflation and that
there is added value in the proposed concrete curb & gutter in lieu of the bituminous
curb presently on the affected streets.
If Council desires to move ahead with the project, the pending assessment (P.A.) amount
should be set. This becomes important when a home with a P.A. is sold, but otherwise
Council sets the actual amount to be levied at the completion of the project which will be
in the fall of 1997.
Council has many options available to them: 1. Take the recommended action below
and move ahead with the project with the pending assessments as proposed or modified.
2. Table action and continue the Public Hearing. 3. Take action to stop the project. It
should be noted that a unanimous vote (4 -0) is required to move forward with the
project.

A RESOLUTION FOR THE APPROVAL AND ORDERING THE PREPARATION
OF PLANS AND SPECIFICATIONS FOR THE STREET AND UTILITY
RECONSTRUCTION IMPROVEMENTS
CITY PROJECT #266
WHEREAS, the City Council of the City of Rosemount ordered a feasibility report for the
1996 Street and Utility Reconstruction Improvements, City Project #266; and
WHEREAS, the City Council has received and accepted the Feasibility Report on December
19, 1995 for City Project #266; and
WHEREAS, the City Council ordered and held a public hearing on January 16, 1996 to
receive input of this project.
NOW THEREFORE BE IT RESOLVED, that the City Council of'the City of Rosemount hereby
orders the improvements of the 1996 Street and Utility Reconstruction Improvements, City
Project #266.
BE IT FURTHER RESOLVED, that the City Council of the City of Rosemount orders the
preparation of plans and specifications for said improvements of City Project No. 266.

The following constitutes Staffs understanding of the majority of the items discussed at the
Public Informational Meeting held on December 21, 1995. If there are any questions,
comments or changes, please notify Bud Osmundson immediately at 423 -4411.
The residents main concerns dealt with the assessments, the proposed HRA Building, and the
actual street widths and sidewalks. The issues are dealt with in detail as follows.
• HRA Senior Housing Development - Questions were raised that this project was being
completed to accommodate the HRA housing.
Staff responded that the HRA project and the Street & Utility Reconstruction are not co-
dependent. The street is in very poor condition and has been on the proposed Capital
Improvements Projects list for a number of years.
A second question relative to the construction of the HRA project, which is proposed to
begin in the fall of 1996, was that the street should be constructed after the HRA project
is complete so that the HRA construction project does not damage the new street.
Staff's response is that the final lift of bituminous would not be installed until after the
HRA project is complete. This is the exact same construction we utilize in building a
residential subdivision street as do most Metro area cities. This allows any possible
problem areas to discovered and corrected prior to the final wear coarse installation.
• Assessments - There was considerable concern from the residents regarding the
proposed $2,500 per single family lot assessment versus the $1,500 which was
assessed to properties on 145th Street. Staff explained that this is a proposal to the
Council for their consideration due to the fact that there is an increase in value because
of the added concrete curb & gutter to streets which currently do not have concrete curb

& gutter. It was explained that Council will make that decision at the Public Hearing and
that this is a pending assessment. The final assessment hearing will be held and the
actual assessments will be set in the fall of 1997 at the completion of the project.
Residents also thought that the HRA housing project should be responsible for more of
the cost of the project. The preliminary assessment roll shows that they eventually will
be responsible for $20,000 out of $180,000 in assessments.
• Burying Utility Lines - It was explained that the proposed cost of burying the lines was
$647,000 which is economically infeasible for all of this project. Residents were
concerned that the City had completed the burial on 145th Street and were not going to
complete any burial on this portion. It was explained that the segment from 145th Street
through the Park and up to Highway 3 was going to be buried and was funded in the
1996 Budget.
• Watermain - Staff is proposing a 12" watermain on Cameo Avenue, Lower 147th Street
east of Cameo Avenue and on Burma Avenue to replace the existing 6" and 8" mains.
Some residents were concerned that the 12" was proposed due to the HRA project.
Staff is proposing the 12" line to enhance the fire protection in the entire downtown
area. The 12" is required in all commercial areas which is the case for over half of the
proposed 12" line. The added cost from a 12" versus an 8" is approximately $5,000 on
Cameo Avenue which is very small relative to the entire project.
• Water and Sewer Services to the HRA Senior Housing Project - Residents were asked if
the water, sanitary sewer and storm sewer services were being proposed to be extended
out of the street so that the street would not have to be disrupted again for the Senior
Housing construction. The answer to that is yes they will be stubbed out to the right -of-
way line.
• Traffic Counts - The traffic counts provided to the residents, whom were skeptical of the
actual numbers. The traffic counts were taken on November 7th through 9th and
November 14th through 16th in 1995. These are both Tuesday through Thursday, 48
hour periods. This conforms with Traffic Engineering Guidelines for taking traffic counts.
The residents did not want the proposed reduction in street width from 36' to 32' on
Lower 147th Street between Canada Avenue and Cameo Avenue. Most residents desire
the 36' wide street.
• Parking - Residents were concerned that parking may be changed. It is not proposed
that there be any changes in the parking on the streets in this project area. Parking

would still be allowed per City ordinances.
• Sidewalks - There was considerable discussion regarding replacing the sidewalks and
widths of the proposed sidewalks. The proposed widths are 5' which is required due to
the American Disabilities Act which we investigated previous to the 145th Street project.
The majority of the residents desired that all of the sidewalks be replaced. However, at
least one asked that the sidewalk not be replaced.
• Curb & gutter - It was explained that the proposed curb would be the barrier type curb
called 136 -18. This is desired by the Public Works Department for safety and snow
removal reasons. A few residents desired the surmountable type curb which is used in
most new subdivisions. The majority desired that the barrier curb be used.
• Access during Construction - Residents were concerned about access to their homes
during construction. The contractor will be required to cover all holes at night unless
there are very special circumstances. They will install Class #5 crushed rock to allow
access through the project and to the homes except when trenching is completed in
front of the homes. Orange safety fence will be utilized during the construction project
to discourage children entering the construction site.
• Street Lights - The proposed street lights to be installed would be the shoe box style just
at intersections. Residents would like to have an additional street light on Lower 147th
Street between Canada Avenue and Cameo Avenue. This can be taken care of with NSP
during the project. Many of the old poles that will have to be moved during the project
will be replaced by NSP at no cost.
• Erickson Pond - The final destination for the storm water is Erickson Pond. This is the
present outlet for the storm water and does conform to previous and future Surface
Water Management Plans. This has been discussed with the Park & Rec Committee in
the past year or two when discussing the amphitheater site and construction.
• Sewer and Water Services - Some residents were concerned that there would be damage
to the property owners side of the sewer and water services. The City contractor will
replace the services to the property line and will be responsible to repair any damages he
makes to the property owners side of the service. If the contractor and construction
observer find any poor service lines which are the responsibility of the property owner,
the property owner will be made aware of the situation. The property owner must hire
their own contractor to replace services from the property line into their homes.

does this-project- rank -on the priortization list? When and by whom
was the list authored? When and by whom was the list endorsed or
annroved?

structures in compliance with City Ordinance B ?
4. As refered to on page 10 of the 1995 Feasibility Report concerning
traffic studies, if 300 is typical of a residential street,how can the
City claim that 540 to 820 is typical? When' it refers to "residential"
exactly what type of the six listed in Section 5.1 of City Ordinance B
is it refering to and why isn't it-specific? What are typical traffic
counts for the six different residential zoning districts? Why weren't
all of the Commercially and Pub -lic zoned properties located within the
project area- :zddressed in the report? Why doesn't the report adaress.

Following you will find a list of the sample properties you requested us to analysis in considering the
benefits as they relate to the pending assessment roll that was provided to us dated December 14, 1995.
As you will notice, the commercial properties with the exception of the Fleugel Elevator, appear to be
justified, Please note the comments for each of the four parcels ofMuegel Elevator.
In regards to tho residential properties, the overall assessment roll appears to be towards the upper range,
It is my initial opinion that several residential properties are justified at the $2,500 assessment, however
their are several lower priced homes within the neighborhood that are questionable in regards to
benefiting by the $2,500 assessment_ It is my recommendation if a "blanket' assessment is to be placed
on the properties rather than each property being individually assessed, that the consensus of the data
shows a median of $2,300 for the proposed assessment using the sample properties.

I am a United States Citizen and the duly qualified Clerk of the City of Rosemount,
Minnesota.
On January 4, 1996, acting on behalf of the said City, I posted at the City Hall, 2875
145th Street West, and on January 4, 1996 deposited in the United States Post
Office of Rosemount, Minnesota, copies of the attached notice of public hearing
regarding the proposed 1996 Street & Utility Reconstruction Improvements for curb
& gutter, street surfacing, sanitary sewer, sanitary sewer services, watermain and
water services, storm sewer line, sidewalk, utility lines and restoration for City
Project #266, enclosed in sealed envelopes, with postage thereon fully prepaid,
addressed to the persons listed on the attached listings at the addresses listed with
their names.
There is delivery service by United States Mail between the place of mailing and the

NOTICE IS HEREBY GIVEN, that the City Council of the City of Rosemount, Minnesota will meet
at 8:00 o'clock p.m. or as soon thereafter as possible, Tuesday, January 16, 1996 in the Council
Chambers of the City Hall, 2875 145th Street West, to consider the following improvements:
Project #266 - 1996 Street & Utility Reconstruction Improvements
The nature of improvements shall include the construction of curb and gutter, street surfacing,
sanitary sewer, sanitary sewer services, watermain and water services, storm sewer line, sidewalk,
utility lines and restoration.
The total estimated cost of said improvements is $2,650,000.
The area proposed to be assessed for the foregoing improvements will generally be: All parcels
within Lots 39 -41, 59 -63 Auditor's Subdivision No. 1; all parcels within Lots 1 -4, 13 -14 Auditor's

Due to being on vacation, we wish to submit the following.
We were informed at a informational meeting that our
assessment for this project would be $2500.00 per home.
We were also informed that the council has set an assessment
policy of $2000.00 per home. We were told that the $500.00
increase was concrete curb & gutter. We have asphalt curb
Gutter at the :present time, which was paid,- for by the property ownWr_s_ at the
time the street was put in. I see no reason the we should be assessed
additional for curb & gutter.
If the assessment policy was set at $2000.00 it should not be increased.
Other assessment�in past have been reduced noTincreased.
