In 1992 Chapter 4 "Snow Removal on Sidewalks" of the City Code was amended so that
sidewalks and trails would be treated the same in respect to the property owners
responsibility for snow removal. It was noticed recently that the Section 4 -4 -3:
NUISANCE, still had the word concrete sidewalk which should have been modified at the
same time. Staff is asking that the Council modify that part of the ordinance to read
plainly "trails and sidewalks" without reference to material type..
In addition, Staff would like to add to the Ordinance under 4- 4 -3 -1: ASSESSMENT OF
COSTS, to clarify the cost of removal. This section deals with "Nuisance" described in
the paragraph above whereby the City has to remove the snow and ice from the
sidewalk due to the fact that the property owner has not complied with the Ordinance.
Right now the cost of the removal is charged to the abutting property but it is unclear
on the calculation of the cost of that removal. Presently we charge a minimum of one
hour of a maintenance worker's time, plus one hour of equipment time. To simplify this
cost we are proposing that a flat fee be calculated and that that amount be set in the Fee
Resolution each year.
Therefore we are asking that the paragraph entitled "Assessment of Costs" be modified
as shown and that the flat fee for 1996 be $60.00 for snow removal. This would be set
by the attached resolution for 1996 and the Fee Resolution hereafter.
