It was noticed recently that the Section 4 -4 -3: NUISANCE, still had the word concrete sidewalk which should have been modified at the same time. Staff is asking that the Council modify that part of the ordinance to read plainly "trails and sidewalks" without reference to material type.. In addition, Staff would like to add to the Ordinance under 4- 4 -3 -1: ASSESSMENT OF COSTS, to clarify the cost of removal. This section deals with "Nuisance" described in the paragraph above whereby the City has to remove the snow and ice from the sidewalk due to the fact that the property owner has not complied with the Ordinance. Right now the cost of the removal is charged to the abutting property but it is unclear on the calculation of the cost of that removal. Presently we charge a minimum of one hour of a maintenance worker's time, plus one hour of equipment time. To simplify this cost we are proposing that a flat fee be calculated and that that amount be set in the Fee Resolution each year. Therefore we are asking that the paragraph entitled "Assessment of Costs" be modified as shown and that the flat fee for 1996 be $60.00 for snow removal. This would be set by the attached resolution for 1996 and the Fee Resolution hereafter. RECOMMENDED ACTION: MOTION TO ADOPT ORDINANCE XII.16, AN ORDINANCE AMENDING TITLE 4 PERTAINING TO SNOW REMOVAL ON SIDEWALKS. MOTION TO ADOPT A RESOLUTION SETTING FEES FOR SNOW REMOVAL ON SIDEWALKS. COUNCIL ACTION: 3 ORDINANCE NO. XI1.16 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 4, PERTAINING TO SNOW REMOVAL ON SIDEWALKS The City Council of the City of Rosemount ordains as follows: Section 1. -Title 4, Chapter -41 Section 3 of the Rosemount City Code is amended as follows: NUISANCE: Snow and ice which is allowed to remain on a cone,ete trails and sidewalks within the City for a longer period of time than twenty -four (24) hours after the same falls, gathers or accumulates is hereby declared to be a nuisance, and the City may remove the snow and ice and charge the cost of the removal against the abutting property. Section 2. Title 4, Chapter 4, Section 3 -1 of the Rosemount City Code is amended as follows: ASSESSMENT OF COSTS: Following such snow and ice removal, the cost of removal shall be calculated set from time to time by City Council resolution. In accordance with Minnesota Statutes §429.101, the City Council shall assess the cost against the abutting property owner. Section 3.
