The attached Cooperative Purchasing Agreement with the State of Minnesota is required
for the City to utilize the "State Bid" Cooperative Purchasing which we have utilized in
the past. There are no specific pending items which would be purchased through this
agreement, but it does give us flexibility throughout the whole year. Staff recommends a
motion to approve entering into a Cooperative Purchasing Agreement contract with the
State of Minnesota and that the appropriate signatures be authorized.
RECOMMENDED ACTION: MOTION TO ENTER INTO A COOPERATIVE PURCHASING
AGREEMENT WITH THE STATE OF MINNESOTA AND AUTHORIZE THE NECESSARY
SIGNATURES.

JUST A REMINDER
Minnesota Statutes Chapter 16B.09 sub 5 grants the Commissioner of
Administration authority to enter into cooperative purchasing agreements with
political subdivisions or governmental entities. In order to enjoy the mutual
benefits of these agreements this office must have on file a current joint powers
agreement and an indication of your jurisdiction interest by virtue of annual fee
payments to cover administrative costs. Our records indicate that your joint
powers agreement has not been received in this office. Please, ensure that
agreement is forthcoming in order to continue to receive the opportunities to save
substantial amounts through the use of these leveraged state contracts.

COOPERATIVE PURCHASING AGREEMENT
STATE CONTRACTS
WHEREAS, the Commissioner of Administration of the State of Minnesota, procures for State
Agencies through competitive bidding various supplies, commodities and equipment, which are
then ordered by or for State Agencies, and
WHEREAS, the State Legislature by Minnesota Statutes, Sec. 471.59 Subd. 10, has authorized
the State and its Political Subdivisions to enter into agreements to exercise jointly the
governmental powers and functions each has individually, and
WHEREAS, the State and (the) poll 4e W r 01, t , ' wish to combine
their ,purchasing functions as specifically prbvided below so that the State Political Subdivision may
avail itself of the prices which have been agreed upon by the State and its vendor.
THEREFORE, it is the purpose of this agreement to make available to the aforementioned Political
Subdivisions the commodities as listed on the State's contract index and contracts at the prices
and terms as are available to the State, except delivery charges, under said contracts entered into
under competitive bidding pursuant to M.S., Chapter 168, by the Commissioner of Administration.
IT IS AGREED that if the Political Subdivision chooses to buy any of the commodities from any
such State contracts, it will issue purchase orders in accordance with all conditions, terms,
specifications and prices stated in such contracts and will send the purchase orders directly to the
vendors who entered into the contracts.
The Political Subdivision also agrees to make payment directly to the vendor in accordance with its
established procedures and conditions and terms of the contract. Neither the State nor its
purchasing agent, personally, or officially, assumes any responsibility for the accountability of
funds expended hereunder by the Political Subdivision, or the issuance or non - issuance of any
purchase order by the Political Subdivision. The Political Subdivision further agrees to save and
hold the State harmless from any loss, damage or expense arising from this agreement or from
any purchase order issued by the Political Subdivision. This Agreement expires on June 30, 1996.
