The acquisition of property for constriction of the proposed fire station necessitates the
following recommendation for rezoning. The approximate 2.8 acres of land on the northeast
corner of Dodd Blvd. and Shannon Parkway is currently zoned R -2, Attached Single Family
Residential. The appropriate zoning classification for the property is now PB, Public / Quasi
Public which permits all major public and institutional uses of a governmental, educational,
cultural, recreational, public service and health care nature that serve the entire community. All
city, county and school district property is in the PB district.
The Planning Commission conducted a public hearing for the rezoning on January 23, 1996,
and recommended approval after brief discussion. No one appeared at the public hearing to
speak in favor or against the rezoning. The Planning Commission inquired about the permitted
uses within the PB district. Although the Planning Commission was interested in the property
acquisition, there were no other land use issues or questions.
Recommended Action: MOTION to adopt ordinance B- rezoning Outlot B, Wensmann
Ninth Addition to PB Public / Quasi Public from R -2 Single Family Attached Residential.

CITY OF ROSEMOUNT ZONING ORDINANCE
Fire Station Property on Shannon Parkway
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, N1NNESOTA ORDAINS AS
FOLLOWS:
Section 1. Ordinance B, adopted September 19, 1989, entitled City of Rosemount
Zoning Ordinance is hereby amended to rezone from R -2 Single Family Attached Residential
to PB Public / Quasi Public the following described property located within the City of
Rosemount, Minnesota to-wit:
Outlot B, Wensmann Ninth Addition, Section 30, Township 115, Range 19, Dakota
County, Minnesota.
Section 2. The Zoning Map of the City of Rosemount, referred to and described in
said Ordinance No. B as that certain map entitled Zoning Map of the City of Rosemount
shall not be republished to show the aforesaid rezoning, but the Clerk shall appropriately
mark the said zoning map on file in the Clerk's office for the purpose of indicating the
rezoning hereinabove provided for in this Ordinance and all of the notation references and
other information shown thereon are hereby incorporated by reference and made a part of
this Ordinance.
Section 3. This ordinance shall be effective immediately upon its passage and
publication according to law.

Pursuant to due call and notice thereof the Regular meeting of the Planning Commission was duly
held on Tuesday, January 23, 1996 at 6:30 p.m. Chairperson McDermott called the meeting to
order with members DeBettignies, Ingram, and Droste present. Also in attendance were Senior
Planner Andrew Mack, Assistant Planner Rick Pearson, Community Development Director Dan
Rogness, and Building Official Paul Heimkes.
MOTION by DeBettignies to approve the January 9, 1996 Regular Planning Commission
Meeting Minutes as presented. Second by Droste. Ayes: DeBettignies, McDermott, Ingram,
Droste. Nays: 0.
Commission Tentinger took his chair at 6:33 p.m.
Assistant Planner Pearson informed the Commission of a joint public meeting with the Minnesota
Valley Transit Authority.
Senior Planner Andrew Mack presented the Commission with a Livable Communities Act update.
Public Hearing: Rezoning. Petition for the Proposed Fire Station•
Chairperson McDermott recessed the January 23, 1996 Regular Planning Commission Meeting
and opened the public hearing scheduled for this 7:00 p.m. The recording secretary had in her
possession Affidavit of Publication and Affidavits for Mailing & posting of Public Hearing Notice.
Assistant Planner Rick Pearson advised the Commission of the necessity to change the zoning
classification of the property intended for the new fire station that will be constructed on the
northeast corner of Dodd Blvd and Shannon Parkway from R -2 to PB/Public Quasi Public.
There being no further public comment Chairperson McDermott closed the public hearing at 7:18
p.m. Commission members discussed the Public and Quasi Public zoning classification. Concerns
regarded the zoning classification and the use of the existing fire station.
MOTION by Droste to recommend- that the City Council rezone Outlot B, Wensmann Ninth
Addition to Public /Quasi Public from R -2 Single Family Attached Residential. Second by
DeBettignies. Ayes: Tentinger, McDermott, Ingram, Droste, DeBettignies. Nays: 0.

Paul Heimkes, Building Official, updated the Commission as to the proposal of a septic system
ordinance. The adoption of this ordinance is being mandated by the Met Council as part of the
Comprehensive Guide Plan implementation program. Paul Heimkes briefed the Commission with
reference to the time frame for implementation, potential costs of the update, number of systems
affected, costs of permits, costs of operating the program, necessary staff time and other
surrounding cities ordinances in comparison to this proposal. Mr. Heimkes indicated that there
will be both formal and informal meetings for the public. He will keep the Commission updated
as to the progress of the ordinance and its inception.
Thank you's and best wishes were extended to Lorraine Ingram for her contributions to the
Planning Commission.
MOTION by McDermott to adjourn. Second by Droste. There being no further business to
come before this Commission and upon unanimous decision this meeting was adjourned at 8:12
p.m.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN, the Planning Commission of the City of Rosemount will hold
a public hearing to consider the item listed below on Tuesday, January 23, 1996, in the
Council Chambers of the City Hall, 2875 145th Street West, beginning at 7:00 p.m., or as
soon thereafter as possible. The public hearing pertains to property located at the northeast
comer of the intersection of Dodd Blvd. and Shannon Parkway, legally described as
Outlot B, Wensmann Ninth Addition, Section 30, Township 115, Range 19, City of
Rosemount, Dakota County, Minnesota.
The purpose of this hearing is to discuss the rezoning of approximately 2.8 acres of land
from R -2 Single Family Attached Residential to PB Public / Quasi Public for the construction
of a fire station as required in Section 16.2 of Ordinance B - the City of Rosemount Zoning
Ordinance.
Those persons wishing to comment on this issue are invited to attend and be heard at the
Tuesday, January 23, 1996 Planning Commission Meeting at 7:00 p.m.
Written comments will be accepted prior to the date of the meeting by the Planning
Department Staff. Questions regarding this proposed rezoning should be directed to the
Planning Staff at 322 -2052.
