The City Attorney and myself agreed that the City should have an adopted policy for water tower antenna site applications for a number of reasons. The main reason for requiring a policy is to ensure that each company is treated fairly and that the City does not take on additional costs without entering into a lease. As it stands now, Staff and the Attorney could spend considerable time negotiating a lease which may not be consumated. In the policy we are requesting that a fee be set to offset City Consultant and Legal costs. Other cities have similar type procedures and costs. In 1996 we recommend that amount be $2,500 which would be non-refundable and paid by an applicant prior to negotiating a lease. In the future this fee would be set annually in the Fee Resolution. Staff recommends adoption of the Water Tower Antenna Site Application Policy. IRECOMMENDED ACTION: MOTION TO ADOPT THE ANTENNA POLICY FOR INSTALLATION ON WATER TOWER. COUNCIL ACTION: K] PUBLIC WORKS POLICY NO. ANTENNA POLICY ADOPTED BY COUNCIL FOR ON: INSTALLATION ON WATER TOWER 1. PURPOSE: The City -owned elevated water tanks are ideal sites for the installation of antennas for private company communication systems. The City may require contracting with a professional consultant to review technical specifications of the communication equipment. The City also requires the City Attorney to review and/or negotiate antenna lease agreements. These expenses should be borne by a company who has expressed a desire into placing an antenna on a City -owned facility even though a lease agreement may not be reached. II. STATEMENT OF POLICY The City shall charge potential users a fee to offset the cost of retaining professional engineers and attorneys to review the technical data associated with each potential user and to review lease agreements. The fee amount should be reviewed from time to time and stated in the yearly fee resolution. This fee shall offset City costs prior to an applicant entering into a lease agreement with the City. In some cases, these costs may be more than the initial fee amount in which case, the applicant would be required to pay the additional costs. !;tom �•Z�3_�1�L'3� 1. The application form fees and all pertinent information should be submitted to the Public Works Director who will review the information, discuss it with the City Attorney, and determine if a consulting engineer is required and hire a consultant if necessary. 2. After the application information is reviewed and approved, the lease agreement can be negotiated by the Public Works Director and City Attorney with the applicant. 3. Upon agreement on the lease details, the lease will be brought to the City Utility Commission for their approval. (The Utility Commission meets once a month on the first Monday after the first Tuesday.) 4. If the Utility Commission so recommends, the lease agreement, signed by the applicant, will be brought to the City Council for their approval. The commencement date of the lease should be as soon as possible after the City Council meeting. (The City Council meets the first and third Tuesday of each month.)
