At it's meeting held on 7une 20, 1995, members of Council considered a request by CMC
Heartland Partners for an amendment to the PUD and directed Staff to prepare findings of fact
consistent with denial of the request. Subsequent to that meeting on July 5, 1995 Council tabled
action upon the fmdings in order to allow Staff an opportunity to review these findings and the
response to the fmdings offered by the applicant.
As a result of these discussions with the applicant and at the recommenda,tion of the City
Attomey, CMC has decided to withdraw their request for PUD amendment. Therefore, no
further action upon the application by Council will be required. As representa,tive for CMC
Heartland Partners, the attached letter of withdraw from Mr. Reid Hansen formally allows the
City to officially close the file on this application.
Based upon a discussion this week with Mr. Hansen, it is our understanding that a decision in
favor of CMC has been rendered by the 7udge in the CMC/CP Rail suit. As a result CMC

anticipates a very strong negotiating posit�on on the rail line relocation agreement which will be
initiated unmediaxely. As a result of this activity, Staff would antieipate stepping up acrivity on

this project in order to finalize the Master PUD and Subdivision Agreement so as to enable
; proceeding with fmal plat approvals for Phase I of the development. This is very positive news
; for the sta.tus of this project.
