This public hearing is set for the review and approval of a concept for a residential planned unit
development involving two types of attached single family housing proposed for the remaining 1$.5
acres of combined property between Dodd Blvd., Shannon Parkway and 145th Street West. The
proposal is consistent with the requirements of the R-2 Attached Single Family Zoning District with
a density of six dwelling units per acre and it includes 1.5 acres of land proposed for park use.
The proposal includes 111 residential units consisting of 61 three story townhouses called "deck
homes", and 50 single level units arrangecl in "quads".
On 7uly 25, 1995, the Planning Commission reviewed the proposal and received public comments
that resulted in a recommendation of approval for the concept with an additional recommended
condition added to the Staff recommendation:
1. Incorporation of engineering recommendations relative to gra.ding and utilities plan and ponding
capacity in the fmal development plan.
2. Enhancement of emergency vehicle access consistent with recommendations made by the Fire
Marshal.
3. City Council acceptance of 1.5 (as proposed) or up to 2 acres for park development with the
balance of the park dedication being in the form of a ca.sh contribution.
4. Conformance with the City of Rosemount Subdivision Ordinance as well as Section 12.2 of the
zoning ordinance for PUD final development plan review and platting requirements.
5. (Added by the Planning Commission) The 1.5 acre park be developed as green or open space
with no buildings or parking lots included.
The park was considered too small to accommodate uses other than typical "mini park"
development and that other uses should not pre-empt the development potential of the proposed
(and recommended) 1.5 acres for park.

V�JHEREAS, the City of Rosemount has received a proposal for a residential planned unit
development and preliminary plat for the following legally described properties:
The Fast 440.0 feet of the West ll2 of the Southeast 1?4 lying Northwesterly of Sta.te
Aid Road No. 42 (Now Dodd Boulevard), Section 30, Township 115, Range 19,
according to the Government Survey thereof, except the North 379.50 feet thereof.
AND
That part of the West 1/2 of the Southeast 1/4 of Section 30, Township 115, Range
19, lying North of Dodd Boulevard, except the East 440.0 feet, except those parts
platted as Shannon Park lst Addition and Limerick Way, County of Dakota, State of
Minnesota., according to the Government Survey thereof.
WHEREAS, on July 25, 1995, the Planning Commission of the City of Rosemount
recommended approval of the concept for a residential planned unit development referred to
as "The Triangle"; and
WHF1tEAS, the proposal is inconformance with the R-2 Single Family Residential District
density standards; and
R�iF12EAS, on August 1, 1995 the City Council held a public hearing in accorda.nce with
the City of Rosemount Zoning Ordinance and State Statutes.
NOW, THERF,FORE, BE IT RESOLVED, the City Council of the City of Rosemount
hereby approves the concept for the residential planned unit development known as "The
Triangle" proposed by Wensmann Homes, Inc., subject to:
1. incorporation of engineering recommendatians rela.tive to gra.ding and utilities plans
and ponding capacity in the final development plan;
2. enhancement of emergency vehicle access consistent with recommendations made by
the Fire Marshal;
3. City Council acceptance of 1.5 acres for park development with the balance of the
park dedication being in the form of ca.sh contribution;

4. that the park be developed as green or open space with no buildings or parking lots;
5. conformance with the subdivision ordinance as well as Section 12.2 of the City of

Mr.Herb Wensmann is requesting approval of a residential Planned Unit Development(PUD)that will consist of
two types of attached housing or townhouses and a park in the 18.5 acres of undeveloped land between Dodd Blvd.,
Shannon Parkway and 145th Street West. The property is in the R-2 Single Family Attached District which allows
this type of residential development up to a density of six dwelling units per acre. Mr.Wensmann will be combining
two parcels for the development,then platting lots for townhouse units,common space,public right-of-way,private
driveways and a park.
The Plan has been modified since the Planning Commission's informal discussion regarding the project. Dwelling
units have been redistributed about the site to respond to questions previously raised about densities slightly
exceeding six dwelling units per acre. The result seems to provide enhanced transitions of housing types to existing
single family detached development patterns to the west,south and southeast.
The proposed housing types are new to Rosemount but have familiar qualities in design or have existing examples
in adjacent suburbs.
Sixty-one(61)three-story townhouses called"deck homes" are proposed for the northem half of the property.
Similar examples can be found in Apple Valley,near Johnny Cake Ridge Road between 140th Street West and
CSAH 42. This design has most of the living space above the gazage and offers a sense of security. Six"clusters"
of eight to twelve dwelling units will be located on the northern half of the development between Shannon Pazk and
Rosemount Green.
Fifly(50)single level townhouses that will attract"empry nesters"will be organized as "quad"clusters with the
garages in the middle and the dwellings on the corners. Thirteen clusters of two to four dwellings characterize the
southem half of the development with primary access from Dodd Blvd. The single level townhouse will provide a
transition of density as well as massing from the"deck homes"of the north to the single family patterns south of
Dodd Blvd.
Four access points are proposed,one at 145th Street West,one at Shannon Parkway and two at Dodd Blvd. A
meandering north-south public street provides the primary access to the majoriry of the developmen� Two private
driveways provide access to clusters off of Shannon Pazkway and Dodd Blvd.
The proposal includes 1.5 acres of land that will be dedicated for pazk use. The proposed park has frontage along
the east side of the public street so that unrestricted access is possible to 145th Street West as well as Dodd Blvd. A
proposed sidewallc within the right-of-way would connect existing and planned sidewalks/trails at both 145th Street
West and Dodd Blvd.
The Parks and Recreation Committee reviewed the concept and recommended that three acres of the development be
dedicated for park use. Ttus recommendation is contrary to the discussions conceming previous development
scenarios for the area being considered. Previously,in September 1988,the Park and Recreation Committee
accepted cash in lieu of land dedication for the then proposed Limerick Way townhouse development. At that time,
a 1.5 acre park was proposed in a future phase of the project. The Committee indicated a preference for a privately
owned pazk but would have accepted land dedication. The proposal was never developed due to financing problems.
Limerick Way was proposed at a density of 11 units per acre.

The City of Rosemount Comprehensive Park Plan and Development Guide has no projected park development
within this property. Kidder pazk lies less than 1/8th of a mile to the southeast on the other side of Dodd Blvd. If
Dodd Blvd is considered to be a barrier that limits access to Kidder Pazk,then criteria contained within the
Comprehensive Park Plan and Development Guide may support a"mini-pazk"of 2,500 square feet to 2 acres.
Mini-pazks are intended to be"Within neighborhoods and in close proximiry to apartment eomplexes,townhomes,
or housing for the elderly.°
Prelirninary discussions with the Developer regazding this proposal had the benefit of the record of previous
discussions and recommendations. The l.� acre parcel proposed for pazk development was considered reasonable
based upon the density limit of six dwelling units per acre. The 1.5 acres allotted for parks is also consistent with
criteria and standazds contained within the Comprehensive Park Plan and Development Guide.
An eight foot wide bituminous path will be either constructed or escrowed for future construction on Dodd Blvd.
Ponding capaciry demand for the development area is estimated at approximately 5 acre-feet. The proposed pond
along Dodd Blvd. appears to be inadequate in terms of needed capacity without being enlarged or possibly
augmented with other ponds.
Dodd Blvd.will be rebuilt to an urban design much like 145th Street West. As a result,additional right-of-way
(ROV�may be needed or additional easements needed for slopes and other improvements.
The intemal private street system will have to be modified to enhance emergency vehicle access. The City and the
Developer have met regazding these and other issues.
The proposed development meets the maximum densiry standards allowed in the R-2 Attached Residential District.
The housing types provide a diversity of housing types not currently available in the Ciry. The relationship of the
housing types provides a logical transition between the e�sting attached and multiple family development and the
single family development of the Broback,Carrollton and Edwin Rahn Additions.
Issues to be resolved are primarily related to appropriate park size and storm water ponding capaciry. Planning
Staff is of the opinion that a slightly larger park may be possible but a significantly lazger park would unnecessarily
burden this development and compromise the integriry of the design. The ponding capaciry can probably be
increased without the need for wholescale revision of the concept.
Recommended Action: MOTIONto recommend to City Council approval of the concept plan for the
Wensmann Homes,Inc.Residential Planned Unit Development subject to: 1)incorporation of engineering
recommendations relative to grading and utilities plans and ponding capacity in the final development plan; 2)
enhancement of emergency vehicle access consistent with recommendations made by the fire marshal; 3)Ciry
Council acceptance of 1.5 (as proposed)or up to 2 acres for park development with the balance of the park
dedication being in the form of cash contribution; and 4)conformance with Sectian 12.2 of the City of
Rosemount Zoning ordinance for PUD final development plan review requirements as well as platting
re uirements s ecified b the Subdivision Ordinance.

In approving the concept plan as presented by Wensmann Homes, Inc., the Planning
Commission must find as follows and forward its findings to the City Council.
1. The Plan provides sufficient useable open space and evidences a substa.ntial
preservation of natural features to warrant the granting of variances through Planned
Unit Development.
The proposed park Is consistent with crlteria for mini parks as speclfied in the
Comprehensive Park Plan and Development Guide.

The Commission reviewed the preliminary plat for Limerick Way, a 32-unit townhouse
development on a 2.75-acre site south of Shannoa Park townhouses. City Planaer Wozniak
stated that consideration for the rezoning of this parcel from AG Agriculture to R�d-
Multiple Residential should also be addressed at this meeting. It was noted that the
preliminary plat and rezoning are consistent with the compreheasive guide plan and minimum
.--� ordinance requirements for multiple family districts. The Park and Recreation Committee
has recommended accepting cash in lieu of land dedication; however, the 1.�-acre oQen space
area as proposed on the concept plan should be required as the property east of this
proposal is developed. The Committee's preference is for private ownership, however land
dedication would be accepted.
Commissioner Jacobson expressed his appreciation to the Park and Recreation Committee,
� City Administrator Stephan Jilk and staff for their contribution toward a successful and
informative Planaing Commission/Park and Recrea[ion Committee joint meeting which had
been held the- previous evening. Jacobson stated his opposition to the Limerick Way
preliminary plat is based on the eo�-p-��aa=s comQrehensive guide pian's referral to special

setback from Shannon Parkway, Commissioner Jacobson ques[ioned whether this is adequa[e

Ci[y Planner Wozniak apprised the Commission that site plan review will be deferred to a
subsequeat meeting in order to allow police aad fire department comment. He noted that
