Dear Mr. Denn:
In October of 1994, Mr. John Rrausert of Rehder and Associates on
behalf of Guetschoff Theaters Inc. (GTI) requested a private
driveway access onto TH 3 at the south property line of their
theater parcel. The parcel is located approximately 2200 feet
south of the intersection of Dakota County road 42 on the west side
of Iiighway 3 in section 32 in Rosemount NIlV. The request was denied
by MnDOT staff (letters attached) .
The property line would split the driveway providing access to two
lots. One lot is currently developed with an eight screen movie
�' theater developed by the requesting party GTI. The lot to the
south of the line is undeveloped with no pending plan for
improvement at this time. The undeveloped lot is currently zoned
for office/warehouse.
The design of the access would be similar to that provided to City
Limits Bowling Alley and Lounge by the Department of Transportation
with the reconstruction of Highway 3 in 1991. The location of the
requested driveway would be directly to the west adjacent to the
south bound lane with centerline of the driveways aligned.
The City does support the request for a private access. Conditioned
upon the facts that there is no connection of the requested access
to the city streets to the west of these sites providing a through
connection; and that this private access does not necessitate the
closing of existing public street access to TH 3 nor restrict the
ability to provide an additional public connection to the highway
between county road 42 and 160th street if needed sometime in the
future. The city would consider the requesting a reduced speed
limit along this portion of the highway if necessary to preserve
the safety of the highway.
The access is not one that would be used during peak traffic
volumes thus eliminating conflicts with the heaviest traffic flows.
The requesting party would design the connection with street
lighting to illuminate the intersection if necessary.

IF there are other design requirements to be considered to assure
traffic the City of Rosemount would support the installation of
those improvements by the requesting party.
The attached resolution from the City Council signifies their
support. we are requesting your assistance in the consideration of
- this access. If there is some opportunity that MnDot staff has
overlooked we would encourage its examination. Council feels there
would be great benefit to the further development and utilization
of this property if access was provided.

On behalf of Carlson Properties of Rosemount, as owners of Outlot
"A" Carrousel Plaza South, I am writing to confirm our intentions
that any private driveway access off of, and entering onto
Minnesota Highway 3 from the subject plat, will not directly
connect to Chippendale Ave.
In addition, Carlson Properties of Rosemount supports the council's
resolution requesting that MN DOT allow such a private access to
the plat.

letters dated October 15, 1993, December 9, 1993, and October 20,
1994 citing safety and operational standards; and
�PSEREAS, GTI is willing to make necessary improvements on and off
site to preserve the safety and operational standards; and
oPBERF�AS, the City Council of the City of Rosemount is willing to
request a reduction in speed limit as necessary to preserve the
safety of this roadway; and
�HBREAS, the City Council of the City of Rosemount recognizes the
benefit of a direct access to the operation of this theater.
NOOP, T8$REFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby requests the Minnesota Department of
Transportation to reconsider its former position and issue a
permit to GTI for the installation of a private direct access to
State Trunk Highway 3 .

The Minnesota Department of Transportation (Mn/DO'1� has reviewed the Carrousel Plaza
preliminary plat in compliance with Minnesota Statute 505.03, subd, 2, Plats. We have the _
following comments.
� • As we have stated in previous correspondence there should be one.point of access for
each side of TH 3 in this area. They may be at the same location or separated as two
T intersections. The access or accesses should serve all land access nesds in the area
between CSAH 42 and IbOth Street.
MnIDOT does intend to deny additional access to TFi 3 as praposed by the Carrousei
Plaza development for safety and operational reasons. It is our position that
alternative access avaiiable to the site from CSAH 42 and TH 3 via Carrousel Way
and from Chippendale Avenue should serve the property. �
• We request that access control be dedicated to Mn/DOT where the pIat abuts TfI 3
right of way. -
• A Mn/DOT drainage permit will be required. Wachter pond, south of the site, is the
low point of TH 3 and is a dead-end pond. The storm sewer system has limited
capacity to accept additional water. Run-off from the site must not be allowed to
inundate the pond and the highway. The site drainage system must prevent such an
event. Development of Outlot A should also be considered when assessing the effects
of the current proposal: Deta.iled drainage computations must be submitted with an

, accommodate not only existing and proposed land uses, but all future uses as well. Additional
. ; direct access to TH.3 must be prevented. TH 3's subordinate functional role, to provide Iand
,: i access, is complicated by a difficult geometric design that attempts to deal with topography and
��: ; proximity to the ra.ilroad tracks. Platting and subdivision of property should be arranged so that
� � access to the highway may be gained at one or two key intersections. We cannot allow the
