'T'EM � i���` �,�� � ATTACHMENTS: Letter to Mr. Timothy Dwyer and map of APPROVED BY: progased park. � The Parks and Recreation Committee has expressed a strong desire to acquire a 15.6 acre pazcel located on the southeast comer of the Kelley Trust property. I have attached a rough draft of a letter to be sent to Kelly Trust. The purpose of the letter is to forward an offer for a 15.6 acre parcel of the available 547 acres which Kelley Trust is expected to put up for sale in the near future. According to Mr. Tim Dywer of Kelley Trust, the value of this land is $29,000 to $30,000 per acre, or $452,400 to $468,000. Funds available include a balance of$359,090 in park improvement funds, a grant for $50,000, and additional donations of $50,000 from Rosemount Jaycees and USPCL The Parks and Recreation Committee is looking at an offer of$200,000 ($100,000 from park improvement funds, $50,000 from the grant, and $50,000 from other donations) for the parcel in cash, and the remainder in prededicated acres. I will discuss this offer in more detail at the meeting. Dwy er � � � Attorney at Law 525 Hamm Building St. Paul, MN 55102 RE: Offer for 15 acre parcel Dear Mr. Dwyer, In a previous meeting, I informed you of the City of Rosemount's interest in acquiring a 15.6 acre parcel of land located in the south portion of your property in Rosemount, east of Shannon Parkway. This parcel borders two City parks, Carrolls Woods to the south, and Schwarz Pond to the east. It offers a connect between these two parks, allowing a greater capacity to serve residents with opportunities for quality passive recreation: The acquisition is included in the Comprehensive Park Plan and Development Guide for the City of Rosemount. The combined park would blend natural wooded areas, open grassland with native prairie remnants, and a beautiful pond. For years to come, this setting would provide opportunities for passive recreational activities such as walking, nature & wildlife study, family and individual "quiet space". Other purposes of the park include vegetative preservation and restoration, and interpretive education. The purpose of my letter is to present a preliminary offer to Kelly Trust for the purchase of this parcel. On behalf of the Rosemount City Council, we are prepared to offer $200,000 for such a purchase. In addition, we request the balance of funds needed be accepted in the form of pre-land dedication. Please share the above offer and request to your board of directors. I would be happy to present details of the park plan at your convenience. If you have questions, I can reached at 322-6003. (Rosemount) and 7ames Steckart (Contractor). I WHEREAS, the City has the need for services of the type provided by the Contractor; and WHF.REAS, the Contractor possesses the required experience and expertise for the performance of the required services. NOW Z�iF.K�FORE, the parties agree as follows: I. Scope of Services. The Contractor will perform the following services: 1. Plan, conduct, coordinate and evaluate youth, teen and family programs and special events. 2. Supervise, train, direct and evaluate volunteers and interns. 3. Supervise activities for persons engaged in recrea.tion programs and co- sponsored events. 4. Interface with the City parks and recreation staff and programs. 5. Perform within a budget by monitoring revenues and expenses in assigned areas to assure sound fiscal control; assure effective and e�cient use of budgeted funds, personnel, materials, facilities and time management. 6. Prepare a variety of studies, reports and related information for decision-rnaking purposes. 7. Communicate official plans, policies and procedures to volunteers and the general public; respond to routine citizen complaints and concerns regarding programming. 8. Prepare for publication a variety of brochures, calendars, letters, posters, news releases, flyers and related communication rega.rding recreation programs. 9. Seek additional and future funding through sponsorships, donations and grants. 10. Maintain accurate inventories and make recommendations for purchase of supplies and equipment. 11. Access county-wide referral system through a personal computer. 12. Perform a variery of duties including but not lunited to answering the phone, typing correspondence, ntnning errands, picking up supplies needed for activides, helping set up tables and chairs for classes and functions. 13. Attend meetings including but not limited to Advisory Committee, RAP Committee, School District #196 Collaborative, and Teen Night. . II. Time of Performance. This Agreement will begin as of March , I995, and will terminate December 31, 1996. III. Compensation. Compensation to the Contractor will be $34,000 per year; this amount will be paid in monthly payments of$2,834 per month. The Contractor shall pay any and all taxes due to Federal, State or Local governments and the City shall not withhold any amounts therefore. After one year of satisfactory performance by the contractor, the compensation will be $35,000 per year wluch will be paid in monthly payments of$2,917 per month. IV. Independent Contractor. The Contractor is an independent contractor and not an employee of the City. The Contractor shall retain control over the manner and means of the work set forth above. The Contractor understands and acknowledges that the City shall not provide any benefits of any type in connection with this Agreement, including but not limited to health or medical insurance, unemployment insurance, workers' compensation insurance. V. Insurance. The Contractor shall provide evidence of automobile insurance coverage for all motor vehicles used in connection with work under this Agreement for a combined single limit for bodily injury and property damage of not less than $500,000 per occurrence and general liability insurance in the amount of at least $500,000 per occurrence. VI. Termination. Either party may terminate this Agreement at any time by giving written notice of the intention to terminate to the other party 14 days prior to such ter�unation. VII. General Terms and Conditions. A. This Agreement may be amended only by written consent of both parties. B. The Contractor must provide evidence of a valid drivers license; in the event that the Contractor's drivers license is suspended or revoked during the term of this Agreement, he must immediately notify the City. C. The City will provide office space and supplies for use by the Contractor. 2 D. Any and all reports, manuscripts and other work products, whether completed or not, that are prepared or developed by the Contractor as a part of this Agreement shall be the shared property of the City and the : contractor and such items shall be turned over to the City promptly at the City's request or at the termination of this Agreement; any confidential reports and information shall remaia the property of the City. E. The Contractor acknowledges that he has received a copy of the City's Workplace Harassment Policy, and that he understands that he must comply with its terms.
