The attached memos from the Planning and Engineering Departments
describe Mallard Pond, an agricultural density subdivision of 170
acres that will result in two lots for immediate residential use
and a large remnant outlot that may be subdivided in the future.
For now, the preliminary and final plats are combined as an
"Administrative Plat." Rezoning is not necessary given the
balanced density of the two lots at the one per ten agricultural
residential density.
On February 14, 1995 the Planning Commission discussed the proposed
subdivision and recommended approval.
Mr. Winkler and his consultant have met with city staff and have
agreed on a solution to the easement and alternative drainfield
location issues indicated in the attached memos.
Recommended Actioa: A MOTION to adopt A RESOLUTION APPROVING THE
MAT,LAR.D POND AGRICULTURAi� SUBDIVISION.

NOTICE IS HEREBY CsIVEN, the City Council of the City of Rosemount�vill hold a public
hearing on Tuesday, March 7, 1995 in the Council Chambers of the City Hall, 2875 145th
Street West, beginning at 8:00 p.m. or as soon thereafter as possible. The public hearing
listed below pertains to property situated east of Bacardi Avenue and north o£County Road
38. This subdivision is proposed to be located on the following legally described property:
The South Half of the Southeast Quarter(Sih_of the SE�/+)of Section 26,Township I 15,Range 19,Dakota
County,Minnesota,except the norch 600.00 fcet thereof. Togetherwith the Northeast Quarter(NE'h)of
Section 21,Township 115,Range I9,Dakota County,Minnesota,except the east 1 rod thereof,and also
excepting the following described paccels: Commencing at the southeast comer of said Norcheast Quarcer,
thence west along The south line thereof,a distance of 607.35 feet to the point of begixuung of land to be
described;thence continuing west along said south line,a distance of 589.25 feet;thence detlect 9Q degiees
right and north,a distance of 633.00 feet;thence deQec[90 deg�es right and east a distance of 50.00 feet:

W�REAS, on March 7, 1995 the City Council of the City of Rosemount
held a public hearing and approved the administrative plat for
Mallard Pond subject to conditions; and
WHLREAS, the developer, Winkler Development, has ma.de application
for approval of the agricultural subdivision for Mallard Pond; and
�REAS, the Planning Commission of the City of Rosemount reviewed
the final plat on February 14, 1995 and has recommended approval of
the Ma.11ard Pond subdivision.
NOW, THEREFORE, BE IT RLSOLVED, the City Council of the City of
Rosemount hereby approves the Mallard Pond agricultural subdivision
subject to:
1) dedication of easements for drainage and ponding as required
by the city engineer on Lots i and 2, Block 1 and Outlot A;
2) realignment of the alternative drainfield on Lot 1 in response
to the drainage pattern;
3} approval by the Dakota County Platting Commission including
the dedication of five feet of half right-of-way as required;
and
4) Park Dedication in the form of two units of cash contribution
at the rate established by the current fee resolution; and
5) Geographic Information Systems (GIS) contribution for two
units at the rate established by the current fee resolution.

8a. NEW BUSINESS Mallard Pond combined preliminary and final plat.
Mr. Bart Winkler, owner of approximately 170 acres of land in the Agriculture district east
of Bacardi Avenue and north of County Road 38 is requesting approval of a plat that would
result in two residential lots of fifteen and five acres, and an outlot of approximately 150
acres.
The 15 acre lot contains an existing house that would be for sale. The five acre lot is vacant
and available for sale. The outlot may be subdivided for residential use in the future,
preferably if or when sewer and water is available. The properry is not anticipated to be
available for inclusion into the Metropolitan Urban Service Area (MUSA) until after the year
2013 according the Comprehensive Guide Plan.
RESID� DEVELOPMENT ISSUES
Both lots conform to current standards for lots in the Agriculture District. Both ha.ve or
exceed 300 feet of frontage on Bacardi Avenue. The maximum density requirement is met at
the one dwelling unit per 10 acres.
The properties will have private septic systems and wells. The existing contours aze shown
on the preliminary site plan with proposed primary and altemative locations. The alternative
drain field location for lot 1 should be moved north, away from a low area that functions as
a drainage course.
A wetland separates the two lots and house sites. An easement for ponding should be
required over the ordinary high water elevation for the wetland. The same will be required
for the lake. In addition, the natural drainage swale that channels runoff from the ditch
along Bacazdi Avenue into the wetland should be protected with a drainage easement.

Park dedication will be in the form of two cash units of pazk dedication corresponding to the
two lots. Park dedication will be settled relative to the outlot when it is replatted for
whatever form of development is ultimately established.
The Dakota County Plat Commission has reviewed the plat and requires an additional five
fe�t of right-of-way from the property that fronts County Road 38 on the south. This
contributes towards the cross-section needed for a two lane rural highway per Counry
guidelines.
The house on lot 2 was built several years ago with the 170 acres under single ownership.
Consequently, the driveway extends south onto the outlot where a maintenance shed is
located, before connecti.ng to Bacardi Avenue. The driveway has been modified in response
to a Planning Staff suggestion that it be reoriented so that the house does not depend oa
easements on adjacent parcels for access. Any remnant driveway that extends across the
boundary line from lot 2 to the outlot will have legal non-conforming status within five feet
on either side of the boundary line.
RECONIlV�IVDATION
MOTION to recommend approval of the Mallard Pond combined preliminary and final plat
subject to:
1, Dedication of easements for drainage and ponding as required by the City Engineer
on Lots 1 & 2 Block 1 and Outlot A;
2. Realignment of the alternative drain field on Lot 1 in response to the drainage pattem;
3. Approval of the Dakota County Platting Commission including the dedication of five
additional feet of half-right-of-way as required; and,
4. Park dedication in the form of two units of cash contribution at the rate established by
the current fe� resolution.

The foliowing is a review of the preliminary plat for Mailard Pond Estates by Engineering
and Public Works. It is recommended that the Developer's engineer make an appointment
with City staff to review the required easements before going any further with the
preliminary piat.
DrainaQe Easements
The attached map shows ponding and utility & drainage easements required by the City.
Please show the required easements on the piat.
The ponding easements were established using peak elevations provided in the 1989 Cifjr
of Rosemount Drainage Plan. The utility & drainage easements were established by field
surveys and the 1989 City of Rosemount Drainage P/an.
Note that this property contains Minnesota DNR numbered wetlands 320W, 321 W and
12W.
Drain Field
The proposed altemate drain field for proposed Lot 1, Block 1 is bisected by a 30 foot wide
utility and drainage easement. This proposed altemate drain field must be located outside
easement limits.
Drivewav Permit
A new driveway has been constructed for proposed Lot 2, Block 1 without a permit. The
City of Rosemount requires that a Driveway Permif be obtained before constructing a
driveway within a street right of way. There is no cost for the permit.

The Dakota County Plat Commission met on January 17, 1995,
to consider the final plat of MAr.r,ARD pOND. Said plat is
adjacent to C0. RD. NO. 38 and is, therefore, subject to the
Dakota County Contiguous Plat Ordinance.
County guidelines require 55 feet of half right of way for a
two lane rural highway. Traffic counts indicate access will
be determined by the County Highway permit process and
restricted access is not required on the plat.
No work shall commence in the County right of way until a
permit is obtained from the County Fiighway Department and no -
permit will be issued until the plat has been filed.

a copy of the attached notice of a Public Hearing for consideration of a proposed
agricultural subdivision to be referred to as Mallard Pond on property located east of
Bacardi Avenue and north of County Road 38 in Rosemount, enclosed in sealed

On Friday afternoon Mr. Norm Brucker cantacted Staff in response to
a public notice received regarding the Mallard Pond Subdivision.
Mr. Brucker informed Staff that a lot division of the subject
property had occured several years prior to this request. Staff
was aware that this approval had occured, but was led to believe b�r
the applicant, Mr. Bart Winkler that the resolution had never been
filed by the applicant. Upon further review and cross-checking of
various property files at City Hall, a document was discovered that
apparently appears to have been recorded. A copy of this document
received back from the Dakota County Recorder' s Office has been
attached for review by Council. This underlying property
information is not provided upon the plat which has been supplied
to the City for approval.
Staff's initial review of the parcel ma.ps and property ownership
records do not reveal these properties as being seperate lots of
record. We are now in process of attempting to contact the
surveyor to determine whether or not an oversight exists in the
preparation of the plat. It is anticipated that a further update
on this issue will be provided for Council at Tuesday night's
meeting.
At this time Staff recommends that the Public Hearing be conducted
on this item as advertised to the public and surrounding property
owners. Unless Staff can obtain information in working with the
applicant to effectively resolve this issue, then it is recommended
that the request be tabled to allow sufficient time to properly
address this matter.
Recoa�ended Action: Recommendation to conduct public hearing on
Mallard Pond Subdivision and to table action upon resolution for
approval subject to resolving underlying property parcel
information.
