Memo & Nliscellaneous / Su ortin Documentation. � Mr. Jim Allen and Mr. Gar�r Bergquist of Hampton Development Corporation are requesting approval of the final development plan, preliminary plat and rezoning of appraximately 38 acres of property east of Shannon Parkway and north of 160th Street West, south of the Winds Crossing area. The plat consists of 77 single family lots that generally conform with R-1 Single Family Detached Residential standards . The attached Planning Commission review memo details the six lot depth variances related to the preliminary plat . On May 9 , 1995, the Planning Commission reviewed the PUD and recommended approval of the final development plan, preliminary plat and related rezoning. All of the property within the plat would be rezoned to R-1 Single Family Residential Detached. The project will be constructed in two phases and final plats will be required for each phase. Recommended Actioa: MOTION to adopt A RESOLUTION APPROVING THE SHANNON POND EAST PLANNED UNIT DEVELOPMENT AND PRELIMINARY PLAT AND AUTHORIZING THE EXECUTION OF A PUD AND MASTER SUBDIUISION DEVELOPMENT AGREEMENT. - and - MOTION to table action regarding the rezoning to R-1 Single Family Residential Detached until approval of a final plat for each a licable hase. The proposal concerns 38 acres of land between the "Winds Crossing" area, Shannon Parkway and 160th Street West. The property is �uided urban residential in the Comprehensive Guide Plan and is currently zoned Agricutture (AG). Approval of the planned unit development, preliminary plat and rezoning is needed. In addition, finai plat approval will be required for each of two anticipated phases. BACKGROUIYD On September 27, 1994, the Planning Commission approved the concept plan with three conditions: 1. Approval by the City En�ineer of grading and utilities plans and "swapping" of eYisting drainage easements; 2. Modification of the fmal development plan to reduce the number of variances where pra.ctical solutions e:cist; and 3. Acceptance by the Plannin' Commission of the remaining variances for preparation of the fmal development plan for recommendation to the City Council. PTJD REVISIONS The preliminary plat has been revised to eliminate ten lot depth and one lot width variance. In addition, the street design has been altered to remove a corner bulge known as an "eye brow". In the process, the developer also gained an additional lot. No lot width or lot area variances are needed for the piat. Previously, a concern was indicated by Planning Staff regarding the second connection to Shannon Parkway. The City Engineer finds the intersection acceptable, given the distance to 160th Street. As a result, the plat will ultimately have four accesses - two from Shannon Parkway, one from 160th Street West and one from the vacant properry to the east. The two ponds tend to limit flexibiliry with re?ard to lot and street desi�n. Minor adjustments are being recommended to various locations of the edges of the ponds to solve variance issues. The 120 ft. diameter right-of-way (ROR� compresses the lots on either side. To compensate, the lots are ten feet wider than the minunum. The building pads are at a minunum of 38 feet deep at these points and increase to a minimum of seventy feet deep. As a result, the variances are considered minor and would not result in hardships that would support future variance requests. DEPTH V�RIANCES (Minimum Standard = 125 ft.) Development around the southern pond depends on the Cities acquisition of an outlet for drainage to future ponds in Empire Township. In addition, lots 3-b, block 4 cannot be developed until the property to the east is developed and the shared street (street E) is built. LANDSCaPING AND PARK ISSUES A landscape plan is required that provides boulevard trees for each lot frontage. Screening planting strips are also required along Shannon Parkway and 160th Street West. Eight foot wide bituminous trails will be required along Shannon Parkway and 1bOth Street West as indicated in the Comprehensive Park Plan and Development Guide. The tra.il segments will be built contiguous with each phase. However, if 160th Street is to be upgraded as a counry highway, then the cost of the trail may be escrowed so as not to be disturbed by construction. No land is needed for park development in this proposal. The Parks Plan indicates additional acquisition of land contiguous with Winds Crossing Park which is more than 525 feet ea.st of Shannon Pond Ea.st. GRAD[NG&UTILITTES Preliminary grading and utilities plans ha.ve been submitted to the Engineering Department for approval. Two ponding areas are located within the PUD that are already owned by the Ciry. The edges of the ponding areas will be altered slightiy to accommodate the lot and street design. This will involve a minor swappin� of land. The En�ineering department has found that the swap can be accommodated and has no adverse impact on the ponding areas. REZONING The entire property witl have to be rezoned to R-1 Single Family Residential Deta.ched. The Comprehensive Guide Plan supports the rezoning because of the urban residential land use designation. The parcel is in the l�ietropolitan Urban Service Area (NIUSA) and is served by the May 9, 1995 Planning Commission Reviews ' Shannon Pond East Page Three StJNIlVIARY . The preliminary plat has been modified to reduce the number of variances consistent with the review _ recommendations of September 27, 1994. The remaining six variances will not negatively impact the development of the property for residential use, nor will the variances create hardships that would support the granting of future variances petitioned by future residents. The plan exhibits efficient access, circulation, and lot design which generally conforms to the topography and the two ponding areas. FIIYDINGS In approving the Concept Plan, the Planning Commission must find as follows and forward its fmdings to the Ciry Council: 1. The Plan provides su�'ficient usable open space and evidences a suhstantial preservation of natural features to warrant the grantin, of variances through Planned Unit Z�evelopment. 2. The Plan complies with the intenr of the Comprehensive Guide Plan. 3. The proposed development will not be detrimental to surrounding propemes. 4. The Plan is more creative and will provide a berter living, working or shopping environment than is possibde under strict ordinance requirements. The following is a list of general comments regarding the plat. A. STREETS - The layout of the strests is satisfactory from an engineering standpoint. The developer will be required to escrow for future street and trail assessments on 160th Street when that portion of the plat is constructed. In addition, a trail wiil be constructed by the developer on the east side of Shannon Parkway from it's existing terminus to 160th Strest. 160th Strest may be constructed as a county road in 1996. However, it is more likely that it will occur in 1997. B. STORM DRAINAGE - The site is presently served by two ponds, constructed under City Project #197, the Valley Oak Outlet. The completed portion of Project #197 was only the first phase and the second phase will consist of a piped outlet from the southeriy pond across 160th Street and into Empire Township. • Public Works has had discussions with the property owners in Empire Township for a number of years in an effort to acquire an easement for the pipe and another pond. Untii the second phase is constructed, Shannon Pond East should only consist of twenty to thirty homes in the north westerly corner. In addition, a temporary overland outlet from the southerly pond should be graded to provide an outlet for the two existing ponds to the north. C. SANITARY SEWER - The site is served by a trunk sanitary sewer that meanders through the property and was constructed three years ago under City Project #233. The area is serviced by the Empire Treatment Plant. The preliminary plans are s�fficient to serve the site. • � � f D. WATER MAIN - The Comprehensive Potabie Water Plan caiis for the extension of an eight inch water main on the west side of the plat, adjacent to Shannon - Parkway, from the northwest comer to 160th Street.- The Plan aiso caHs for a twelve inch water main ftom Shannon Parkway easterly adjaeent to 160th Street. When Shannon Pond Third Addition was constructed (west of Shannon Parkway) a water main extension was constructed across to the east side of Shannon Parkway. This should be connected with the eight inch main requir�d by the Plan. This forty-acre site will only have the Shannon Parkway water main connection and will not be looped until such time that the property to the east or west is developed to ciose a water main loop. This is not a major concern, but does leave the area susceptible to many customers without water, 'rn the possibility of a water main break on Shannon Parkway. E. EASEMENTS - The city currently has fee title to the two ponding sites. A meeting has been set up between the city attorney, public works and the developer to discuss the status of these easements/ownership rigfits and the developer's responsibilities. There is a possibiiity that lot lines could dissect the ponding sites if agreed to by all parties.
