Celebrity Bowl Charities, Inc. has submitted its Gambling Premises Permit Renewal Applicatian for the period
of April l, 1996 through March 31, 1998. Celebrity Bowl Charities leases space from City Limits Lanes and
Lounge. They have paid the$100 investigation fee which is a requirement of the new gambling ordinance
adopted by the City Council in 7uly of this year. Since the 80 percent annual expenditure requirement takes
effect January 1, 1996, this requirement will not have to be met for this renewal application, although the
a.�ected organizations need to keep this in mind beginning with their 1996 expenditures. Approximately a month
ago, the local charities and business connected with charitable gambling were provided with the new ordinance
and a memorandum explaining the 80% donation requirement and other conditions of the new ordinance. Staff
recommends adoption of a resolution approving this application.

ADDENDUM TO LEASE AGREEMENT
The undezsigned parties agree that this Lease Agreement shall operate as an addendum to the Minnesota
Lawfui Gambiing Lease Agreement attached hereto.
1. This lease may be terminated by either party upon thirty(30)days written notice.
2. If the Lessor terminates this Lease within six(6)months of the initial date, the Lessor agrees that the
rent&comp for the last month shall be reduced by the sum of$250.00 to reimburse Ceiebrity Bowl Charities for
the out-of-pocket expense incurred in obtaining a premise permit
3. Rent and azry compensation shall be due on the 20th day of the month following the month earned.
(e.g.. December rent and compensation shall be due on the 201h of January). No rental shall be paid or shall be
due until a gambling license is issuefl and determined to be effective by the State of Minnesota. The Lessor
understands that no gambling activity shall be authorized or occur until duly licensed. Compensation will be paid
to the lessor or the lessor's designee in accordance with the compensation schedule on file.
4. The Lessor agrees that all equipment including cash banks maintained with individual games are the
properiy of Celebrity Bowl Charities. That such equipment and cash banks shall be released to Celebrity Bowl
Charities or their representatives upon demand.
5. The Lessor agrees that Celebrity Bowl Charities shall be the only entity authorized to engage in
charitable gambling on the premises of the Lessor during the time that this agreement is in effect. Celebrity Bowl
Charities may waive this restriction only by specific written agreement prior to any other gambling activity.
6. The parties agree that in the event either parry is required to incur attorney's fees or costs to enforce the
terms of this agreement, that same may be considered as an element of damage and rec;avered from the breaching

7. All parties agree that no rent or compensation shall be due for any period that the site is closed for
business. All rents will be pro-rated for partially closed periods. A period is defined as 1 calender month
8. The I,essor agrees that Celebrity Bowl Charities will be reimbursed for all excessive shortages.
Excessive shortages are defined as the amount of the shortage that exceeds.003 of gross sales. Failure to
reimburse Celebrity Bowl Charities by the 20th of the following month will result in the withholding of any Rent
and Compensafiion that is due until the reimbursement is made.

RENEWAL FOR CELEBRI'I'Y BOWL CB[ARTTIES,INC.
NOW,THEREFORE,BE IT RESOLVED,that the City Council of the City of Rosemount
hereby approves the Gambling Premises Permit Renewal Application submitted by Celebrity Bowl
Charities, Inc. to conduct lawful gambling at City Limits Lanes and Lounge, 15400 South Robert
Trail, Rosemount, MN for the period of April 1, 1996 through March 31, 1998.
