Much discussion has occurred regarding tYus proposed change. The Planning Commission recommended approval of the amendments on November 14, 1995. Additional discussion occurred on November 28, 1995 in light of concerns raised by the City Council on November 21, and also during a worksession discussion that was held concerning the conduct of ineetings and public hearings in general. Consistent scheduling of Planning Commission meetings and public hearings is a primary . concern. The Planning Commission has acknowledged that accessibility to the public is vital to the hearing process and a majority of the Commission is in support of a new schedule for Planning Commission Meetings: 5:30 p.m. Optional worksession times for informal discussion items with no official actions or recommendations. 6:30 p.m. New starting time for regular meeting. 7:00 p.m. New starting time for scheduled public hearings (or as soon thereafter as possible). All Planni.ng Commission conducted public hearings will now be scheduled for 7:00 p.m. A related change is the necessity for St�ff to set required public hearings as part of the applica.tion receipt and screening process. This will streamline the process by eliminating the City Council consent item preparatioa that had been used previously and often ca.used delays. There are many good reasons to sometimes delay a project review, but in light of the "sixty day law", City Staff is forced to think of ways to eliminate dela.ys wherever possible. Recommended Action: A MOTION to adopt a Zoning Ordinance Teart Amendment that will shift public hearings from the City Council to the Planning Commission for Planned Unit Developments and Ordinance Amendments; and, A Motion to adopt a Subdivision Ordinance amendment that will shift public hearings from the City Council to the Planning Commission for preliminary plats. This has been titled the ' 1996 Street and Utility Reconstruction Improvement Project. ' This Feasibility Report proposes the construction of approximately 2,600 feet of trunk storm sewer line ranging in size from 24" to 66". It also proposes the reconsfruction of ' approximately 4,600 feet of 32' to 40'wide Urban section streets complete with bituminous paving, concrete curb and gutter and sidewalks. It also proposes the replacement of 4,700 ' feet of watermain, 4,600 feet of sanitary sewer main and 60 sewer and water services. ' The total estimated cost of the project is approximately $2.65 million. Funding for the ' project will come from the Storm Water Core and Utility, Sanitary Sewer Core, Watermain Core, Assessments, 1996 C.I.P. items and encumbered funds. ' Burial of private overhead utility lines is also addressed in this report. NSP has estimated ' the cost for the majority of the project area to be approximately $647,000. Frontier Telecommunications has estimated the cost of burying their lines in the project area to be ' approximately $22,000. NSP has also estimated the cost of burying their electrical line from 145th Street through Erickson Park and up to TrunkNighway 3 to be approximately ' $50,000. There is funding for the $50,000 segment in the 1996 C.I.P. However, there is not funding available for any of the other private utility costs and it is not recommended to ' proceed with those projects. ' The projeet construction could be completed to the first Iift of bituminous and all restoration in 1996. The final lift of bituminous is proposed to be installed in 1997 after which the ' assessment hearing can be held. ' The project is feasible from an engineering standpoint and should be constructed as proposed. ' , City Project No.266 Page 1 ' , ' 2 INTRODUCTION , 2.1 Authorization - On October 17, 1995 the Rosemount City Council authorized the ' preparation of an Engineering Feasibility Report for the 1996 Street and Utility ' Reconstruction Project. This project has been designated as City Project No. 266. A previous feasibility report was completed under this project number for only the ' storm drainage facilities which the new project totally encompasses. ' 2.2 Scope - This project provides for total street and utility reconstruction on Cameo , Avenue between 145th Street West and Lower 147th Street West� Lower 147th , ' Street West between Canada Avenue and Burma Avenue, and Burma Avenue between Lower 147th Street West and 146th Street West. Burma Avenue between , 145th Street West and 146th Street West and 145th Street West at Burma Avenue ' will not be totally reconstructed -- as much as possible of the curb and gutter and ' sidewalk will be saved. The proposed storm drainage facilities continue north of 145th Street West through the City Hall parking lot to the Erickson Park pond. It ' is proposed to make street, storm drain, watermain, sanitary sewer, sidewalk, street , light, and overhead utility improvements with this project. ' 3.2 Project Zoning - Generally the project is zoned single family residential west of � Cambrian Avenue. East of Cambrian Avenue, the project is a mix ofmultiple family residential, community commercial, highway service commerciaf, and public zoning. ' i3.3 Project History-Street flooding at the intersection of Lower 147th Street West with ' Cameo and Cambrian Avenues as wel! as street flooding at the intersection of � 145th Street West and Burma Avenue prompted the Utility Commission on October ' 3, 1994 to authorize the preparation of a Feasibility Report to address the drainage ' problems on Lower 147th Street and Burma Avenue. On December 12, 1994, the Rosemount Utilities Commission received the Feasibility Report "Erickson 190 ' City Project No.266 Page 4 ' ' , Draina e District, South Trunk Line -- Lower 147th Street & Burma Avenue." The 9 , December 12, 1994-report estimated storm drainage improvements to be $1.13 million. Because of the high cost, the Utility Commission requested that an , estimate be done for a Phase I im rovement on 145th Street West from Bumle P Y ' Avenue to Burma Avenue and from Burma Avenue north to Erickson Pond. At the January 9, 1995 Utility Commission meeting, an estimate of$410,000 for the Phase ' I improvement was presented to the Commissioners. At that meeting the Utility ' Commission tabled further action on the Phase I improvement until the prioritization ' of City wide storm drainage problems could be done. ' Because over one-third of the $1.13 million cost of the storm drainage improvement ' was the restoration of City streets that are in poor condition, the City Council provided funding in the 1996 Budget for street improvements to be done at the � same time as storm draina e im rovements. On October 17 1995 the Rosemount 9 p , , ' City Council authorized the preparation of an Engineering Feasibility Report for 1996 Street and Utility Reconstruction Project. ' , Generally, record drawing information on street construction is unavailable. Burma ' Avenue from 146th Street West to 145th Street West was reconstructed in the mid 1980's. Record drawing information on the existing storm sewer that begins at the ' intersection of Lower 147th Street West and Cameo Avenue and ends at Erickson ' Pond show that it was constructed in 1959. ' ' City Project No.266 Page 5 � ' Record drawing information on exis#ing watermains is available but precise dates ' of construction are unavailable. It is estimated that 90% of the existing watermain on this project was constructed between 1935 and 1955 with the remaining 10% ' constructed since 1955. Record drawings show tF�at all existing sanitary sewer in ' �the proposed project area was constructed in 1955. These streets ' will require a total reconstruction. The streets are retatively flat except , Cameo Avenue which has some grade to it. ' City Project No.266 Page 6 ' ' ' About 50 driveways are present in both the residential and commercial ' areas. All of these wiil be reconstructed to the right-of-way line, or as needed to match new street grades. ' ' The westerly part of the City Hall parking lot will be impacted by the construction. The lot has a bituminous surface with concrete curb and ' gutter. The project will also have a major impact on the Garden Club's � community garden and will require the transplanting of numerous plants and , trees. ' 3.4.2 Storm Drain: The proposed project is located in the Erickson Pond drainage ' district and the Erickson 190 subwatershed. ' „ A 15 concrete storm sewer flows east from the intersection of Cameo ' Avenue/Lower 147th Street West to Burma Avenue. It then flows north on Burma to 146th Street West, east on 146th Street West to Bumley Avenue, ' north on Burnley Avenue to 145th Street West, and west on 145th Street ' West to Burma Avenue. At the intersection of Burma Avenue/145th Street , West the pipe changes to a 27"concrete storm sewer. The 27" storm sewer flows north to an outlet to Erickson Pond. , ' The intersection of Lower 147th Street West and Cameo Avenue has flooded at almost every rainfall event for the past number of years. There ' ' City Project No.266 Page 7 ' ' are an inadequate number of catch basins and the pipe size is inadequate , for the amount of runoff which flows to this intersection. The intersection of 145th Street West and Burma Avenue aiso floods occasionally but oniy at , lar er events. ' 3.4.3 Watermain: The existing watermain nefinrork consists of 40 to 60-year-old ' cast iron pipe. The watermain is 6" on Lower 147th Street West from ' Canada Avenue to South Robert Trail (TH 3), Cameo Avenue from 145th Street West to Lower 147th Street West, and Burma Avenue frorn Lower ' 147th Street West to 145th Street West. The watermain is 8" on Lower ' 147th Street West from South Robert Trail (TH 3) to Burma Avenue and 12" on 145th Street. ' ' 3.4.4 Sanitary Sewer: All sanitary sewers within the proposed project limits are 8"vitrified clay pipe placed in 3' segments. Record drawings show thaf the ' network is about 40 years old. The sanitary sewer network was televised ' over the last five years and was generalfy found to be in structurally fair , condition. Video tape review indicated possible groundwater infiltration and wastewater e�ltration through the large number of joints. Wastewater is ' backed u at locations in the i e network from nearly flat grades in the p pP , pipe. ' City Project No.266 Page 8 ' , ' The 8"vitr�ed cla i e that flows from near the rear of the McMenom and YPP Y ' Shamrock Animal Hospital Buildings southeasterly to the lift station near the intersection of 145th Street West/Burma Avenue is in poor condition. The , i e rou hl runs alon the east ro ert line of businesses alon South PP 9 Y 9 p p Y 9 ' Robert Trail and services these properties. It is cracked along its entire length and is crushed (egg shaped) at locations. ' , 3.4.5 Sidewalk/Trail - The existing 4' to 10' wide concrete walks are in poor to ' good condition. Streets east of South Robert Trail (TH 3) support a large quantity of trucks going to and ' from Flue el Elevator. Also future commercial business additions in the "Ratzloff' 9 � ' block will increase vehicular traffic in the vicinity. , The traffic counts on Cameo Avenue show that it is a typical residential street. The ' ADT on Cameo Avenue immediately north of Lower 147th Street West is 375 and ' south of 145th Street West the ADT is 260. ' is similar. The ADT east of Canada Avenue is Traffic on Lower 147th Street West ' 540 and west of TH 3 (South Robert Trail) the ADT is 820. ' ' ' , ' ' ' � ' i ' City Project No.266 Page 18 ! I 4 PROPOSEDIMPROVEMENTS � 4.1 Roadway/Parking Lot-For City Project No. 266, it is proposed to reconstruct the ' existin streets to various widths to match the traffic. ameo Ave e ' g C nu will remain � 36' wide as will Lower 147th Street West from Cameo Avenue to TH 3. West of Cameo Avenue, Lower 147th Street West will be narrowed to the typicaf 32' wide � residential street. East of TH 3, Lower 147th Street West will remain 36' wide. ' Burma Avenue will remain at its current width. 146th Street West from Burma , Avenue to Burnley Avenue will just be replaced as necessary for storm drain construction. , ' On the 36' and wider streets the proposed street section will consist of approximately 5" of bituminous surFace and 8" of Class 5 gravel. On the 32' wide , �� �� street the proposed street section will be 4 bituminous surface and 6 Cfass 5. All , proposed streets will be flanked with B618 curb and gutter. Approximately the ' western 30' of the City Hall parking lot will be removed and replaced as the result of proposed storm sewer work. � ' It is proposed to utilize the sand stockpile in the Business Park at no cost for granular borrow replacement. � � ' � City Project No.266 Page 11 ' ' 4.2 Storm Drain - The im rovements ro osed as art of Cit Pro'ect No. 266 would P P P P Y 1 ' be to replace the storm drainage system from Lower 147th Street West and Cameo Avenue to Erickson Pond. The proposed improvements wouid replace the 15" , � „ �� storm drain with approximately 2,600 of pipe ranging in size from 24 to 66 . The ' proposed piping along Lower 147th Street West includes approximately 345' of 24" ' and 27"pipe from Cameo Avenue to Cambrian Avenue, approximately 295' of 30" and 36" pipe from Cambrian Avenue to TH 3, approximately 380' of 42" pipe along ' Lower 147th Street West from TH 3 to Burma Avenue and then 1,600' of 66" pipe ' along Burma Avenue to Erickson Pond. The proposed new alignment of the trunk system stays along Burma Avenue so that the more expensive larger pipe is kept ' to a minimum. Leads with smaller i e are ro osed from the trunk easterl alon PP p p Y 9 , 146th Street West and 145th Street West to collect runoff at the Burnley Avenue and 145th Street West and 146th Street West intersections. ' ' The proposed alignment from 145th Street West to the north is through the City Hall ' parking lot. This will minimize the disruption to the flower garden area and existing utilities in that same area ' ' The preliminary design is based on a ten-year rainfall event and provides for the storm water runoff for 56 acres (12 residential and 44 commercial). The drainage ' area generates 250 cubic feet er second at the outlet on Erickson Pond. The p � design includes being deep enough at Lower 147th Street West and Trunk Highway 3 to allow for future Trunk Highway 3 storm drain improvements providing drainage ' ' City Project No.266 Page 12 ' ' for ro erties to the south and north in the existing commercialized areas. This P P , lead to the pipe being much deeper than the present system at Trunk Highway 3 and Lower 147th Street West and along the downstream pipe. ' ' 4.3 Watermain -The existing watermains are old and small in diameter for existing and future land use plans in the area. The existing watermain is estimated to be 40 to ' 60 years old and would probably need replacing before the next street ' reconstruction. Also, the existing main diameters may not be adequate for proper ' fire proteetion. An 8" to 12" diameter is recommended for commercial and multi- family areas. Therefore, it is proposed to replace all watermains within the limits ' of the street reconstructions. ' The 6" cast iron watermain on Lower 147th Street West from Canada Avenue to , Cameo Avenue will be removed and re laced with 8" ductile iron i e. p pp ' The 6" cast iron watermain on Cameo Avenue from 145th Street West to Lower ' 147th Street West, the 6" cast iron watermain on Lower 147th Street West from ' Cameo Avenue to TH 3, the 8" cast iron watermain on Lower 147th Street West ' from TH 3 to Burma Avenue, and the 6"cast iron watermain on Burma Avenue from Lower 147th Street West to 145th Street West will be removed and replaced with ' 12" ductile iron pipe. ' ' ' City Project No.266 Page 13 , , The 12" watermain wili connect to the 12" watermain on 145th Street West at , Cameo and Burma Avenues. This 12" loop will improve fire protection to the future Senior Housing Development, Fluegel Elevator, and other existing/future ' commercial develo ment. P ' It is also proposed to remove and replace existing 6" cast iron watermain on TH 3 ' „ at Lower 147th Street West with 12 ductile iron watermain. This will be installed ' so a future loop closure could be completed with 12"watermain on TH 3 from 145th , Street West to Lower 147th Street West. It will also be installed so a future loop closure could be completed with 12" watermain on TH 3 from Lower 147th Street ' West to the existing 12"watermain about 500' north of Cambrian Avenue on TH 3. ' Watermain depth will be increased at TH 3. Future improvements to TH 3 will ' necessitate the lowering of TH 3 in order to facilitate drainage for a curb and gutter ' cross section on TH 3. ' Water services in the area will be replaced to the right-of-way line. Hydrants, ' valves and appurtenances will be improved at the same time as the watermain. � 4.4 Sanitary Sewer - As previously stated the existing 8"vitrified clay pipe sanitary , sewer is about 40 ears old and in oor functional condition. Because of this Y p ' condition and the fact that the storm drain trunk line replacement may cause disturbance to the sanitary sewer line, the 8"clay pipe will be replaced with 8" PVC. ' , City Project No.266 Page 14 ' , 4.5 Sidewalk/Traii -Sidewalk wiil be re laced or instalied on both sides of streets west P , of Burma Avenue and on Burma Avenue south of 146th Street West. Every effort will be made to save existing sidewalks to the north of 146th Street West, but its ' removal and re lacement are ' c ude ' the cost estimate. Pro osed concr p m I d m p ete ' sidewalks will be at least 5' wide. Pedestrian ramps will be installed or reconstructed to current standards at all intersections. ' , In addition at various locations in the downtown area sidewalk replacement will be ' completed with this project. ' . 4.6 Park/Garden - The gardens west of the City Hall parking lot and north of 145th ' Street West will be impacted by sanitary sewer and storm drain improvements. Trees and bushes wiU be restored as part of the contract. The Erickson Park ' amphitheater will be restored to its existing grade. ' ' 4.7 Street Lights -The street lighting system is proposed to be improved as part of this project. A �Square Shoebox" style street light is proposed for use at all street ' intersections on the ro'ect. The "S uare Shoebox" 100 watt HPS lam will be p 1 q p ' mounted on a 25' aluminum pofe. Section 12.2 PUD PROCEDURE: C. Conceut Review of Ordinance B - City of Rosemount Zoning Ordinance is amended to read as follows: C. Concept Review: Upon receipt of a complete application, including supporting information, the City Administrator or the City Administrator's designee shall set a date for a public hearing for formal review of the PUD. The applicant shall make a presentation of a proposed PUD at a public hearing before the Planning Commission. The Planning Commission shall recommend approval, revision, reapplication, or denial of the Concept Plan. SECTION II. Section 12.2 PUD PROCEDURE: E. Conce�t Plan Review-Public Hearing of Ordinance B- City of Rosemount Zoning Ordinance is amended to read as follows: E. Final Development Plan Review: The applicant shall prepare a Final Development Plan for the proposed development and shall prepare graphic and written material as follows(20 copies). SECTION III. Section 12.2 PUD Procedure: H. Public Hearing of Ordinance B - City of Rosemount Zoning Ordinance is amended to read as follows: H. Public Hearing-Final Development Plan/Rezoning: Applicant shall make a presentation of the Final Development Plan/Rezonings at a public hearing conducted by the Planning Commission. The City Council shall consider the recommendation of the Planning Commission and testimony from the public hearing and either approve or deny the plan. If the plan is approved,the City and the applicant will enter into a development agreement prepared by the City. Requested changes in the Fina1 Development Plan after approval has been granted will require submission of an amended plan document, a revised plat(if applicable), and amended development agreement, and a review process incorporating the public hearing requirements, unless the changes are minor enough to be authorized by administrative directives. SECTION IV. Section 16.2 Procedures: D. Public Hearing of Ordinance B- City o,f'Rosemount Zaning Ordinance is amended to read as follows: D. PUBLIC HEARING : No amendment to this ordinance sha11 be considered until a public hearing has been held by the Planning Commission. A notice of the time, place, _ and purpose of the hearing shall be published in the City's's oi�icial newspaper, at least ten(10) day prior to the hearing. Amendments affecting changes in zoning districts shall require mailed notice to each property owner within three hundred fifty feet (350') of the affected property owner. However, zoning changes in'the Agriculture, Agriculture OrdB-55 Pg I preserves, and Rura1 Residential Districts shall require mailed notice to each property ' owner within one-fourth(1/4)rniles of the affected property. The City shall use its available records to deternune the names and addresses of property owners. Failure to give notice to individual property owners or defects in the notice shall not invalidate the proceedings,provided a bona fide attempt was made to comply with these provisions. SECTION V. XVII.104 AN ORDINANCE AMENDING ORDINANCE NO.XVII.4 CITY OF ROSEMOUNT SUBDIVISION ORDINANCE REGARDING CITY COUNCIL AUTHORIZATION FOR SPECIFIC PUBLIC HEARINGS TO BE HELD BY THE PLANNING COMMI5SION THE CITY COUNCIL OF THE CITY OF ROSEMOUNT,MINNESOTA ORDAINS AS FOLLOWS: SUBD.3.2. PRELIlVIINARY PLAT PROCEDURES of Ordinanee XVII.4- City of Rosemount Subdivision Ordinance is amended to read as follows: a. Application and Fee. The subdivider or owner shall file with the City Clerk twenty(20) copies of the preliminary plat and such supplementary information as may be required and a cash fee in the amount established by resolution. In addition to the application and fee, the subdivider shall be required to prepay a11 planning, engineering and legal expenses incurred by the City for the review of said request, based on an estimate. b. Public Hearing. The Planning Commission shall submit a recommendation to the City Council within sixty(60) days of receipt of the application. The Planning Commission shall hold a public hearing on the Preliminary Plat after notice of the time and place thereof has been published once in the official newspaper at least ten(10) days before the day of the hearing. The City Council shall act to approve or disapprove the preliminary plat. If disapproved, the reasons for disapproval shall be set forth in the minutes of the Council. This ordinance sha11 be effective immediately upon its passage and publication according to law. Formally acted upon by the Council of the City of Rosemount this 19th day of December, 1995.
