On October 13, 1995 at 10:00 a.m. the City received one bid for the Utility Standby
Power Provisions contract. This contract is for the pur�chase of a generator set which will
be able to provide electrical power to our wells and Iift stations in the event of,a power
o�tage. It also includes the retrofit of the wells and lift sta#ions so that they can be easily
connected to the generator set. Payment for this emerg,ency generator would come from
the three Core Funds for Water, Sanitary Sewer and Storm Water.
The only bid for the Utility Standby Power Provisions was�from Mendota Electric, Inc.
The Engineer's estimate was approximately 570,000. Dean Sharpe from Sebesta,
Blomberg and Associates completed the plans and specifications. Staff and Mr. Sharpe
recommend that the City receive and reject the bid.
Staff recommends that we proceed with re-bidding the generator set and equipment
separately and to request quotes (because this work is w:���less than 525,000) for the
electrical work.

RIGHT OF APPEAL: An owner of property to be assessed may appeal the
assessment to the district court of Dakota County
pursuant to Minnesota Statutes, Section 429.081 by
serving notice of the appeal upon the Mayor or Clerk of
the City within 30 days after the adoption of the
assessment and filing such notice with the district court
within ten days after service upon the Mayor or Clerk.
LIM{TATION ON No appeal may be taken as to the amount of
APPEAL: any assessment adopted by the City Council unless a
written objection signed by the affected property owner
is filed with the Clerk prior to the assessment hearing or
presented to the presiding officer at the hearing. All
objections to the assessments not received at the
assessment hearing in the manner prescribed by
Minnesota Statutes, Section 429.061 are waived,
unless the failure to object at the assessmenthearing is
due to a reasonable cause.
DEFERMENT OF Under the provisions of Minnesota
ASSESSMENTS: Statutes, Sections 435.193 to 435.195, the City may,
at its discretion, defer the payment of assessments for
any homestead property owned by'a person 65 years
of age or older for whom it would be a hardship to
make the payments. However, the City has elected not
to establish any deferment procedure pursuant to those
Sections.

PREPAYMENT: You may prepay the entire assessrnent to the Treasurer
of the City until the assessment roll is certified to the
County Auditor; after certification to the County
Auditor, prepayments of the entire amount remaining
due may be made to the County Auditor at any time
prior to November 15 in the year this assessment is
adopted.
N0 PARTIAL: The City Council has not authorized the partial
prepayment of assessments priar to certification of the
assessment or the first installrnent thereof to the
County Auditor.
PREPAYMENT WITHOUT No interest shall be charged if the entire
INTEREST, OR WITH assessment rs paid within 30 days from
INTEREST TO END OF the adoption of the assessment roll. At
YEAR: any time prior to November 15 of any year following
the year the assessment is certified, the owner may
prepay to the City Treasurer the whole assessment
remaining due with interest accrued to December 31 of
the year in which the prepayment is made.
INTEREST RATE: If the assessment is not prepaid within 30 days from
the adoption of the assessment roll, interest will accrue
on the assessment at the rate of 7.4534%. Interest
accrues from the date to be specified in the resolution
tevying the assessment, but not earlier than the date of
such resolution. Assessments shall be payable in equal
annual installments extending over a period of up to 10
years, the first of the installments to be payable with
general taxes for the year 1995, collectible with such
taxes during the year 1996.

PETITION-HANSON PROPERTY
Concerning a parcel of property cnnsisting of approximately 0.36 acres located
on the west side of 134th Way midway betrveen Bengal Avenue and 130th Street West
in the City of Rosemount, Dakota County, �nnesota
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN�the City Council of the City of Rosemount will hold apublic hearing to consider
the item listed below on Tuesd�. October 17. 1995 in the Council Chambers of the City Ha11, 2875 1�Sth
Street West,beginning at 8:00 p.m., or as soon thereafter as possible. On Tuesday, September 12, 1995 the
Planning Commission, acting as the Board of Appeals and Adjustments, held a public hearing and granted a
variance requested by the properry owner for property situated on the west side of I30th Way, half-way
between Bengal Avenue and 130t1i Street West, legally-described as follows:
That part of the Southeast Quarter of the Southwest Quarter(SEt/4 of SW'/4)of Section 16,Township
115,Range 19,Dakota County,Minnesota,described as follows: Commencing at the southwest comer of
said Southeast Quarter(SE'/4);thence north 90 degrees East(assumed bearing)along the south line
thereof a distance of 733.10 feet;thence north 00 degrees East a distance of�1.56 feet;thence north 45
degrees 06 minutes 42 seconds west a distance of 256.92 feet to the beginning of a tangential curve to the
right,radius of 185.41 feet,and to the actual point of be�nni»g;thence northwesterly along said curve
which is concave to the northeast central angle of 28 degrees 52 minutes,a distance of 9431 feet,thence
north 16 de�ees 14 minutes 42 seconds west,tangent to said curve,a distance of 51.81 feet;thence south

The initial public hearing was held before the Board of Appeals and Adjustments on Tuesday,May 9, 1995
and was continued to several meetings before final determination and decision was declared in favor of a
variance.
The purpose of this hearing is to consider a Petition of Appeal to reverse the September 12, 1995 decision
of the Board of Appeals &Adjustments that granted variances to minimum setback and lot dimension/area
standazds to a11ow construction of a sin�le family detached dwelling as required in Section 7.1 of Ordinance
B-City ofRosemount Zoning Ordinance.
Persons wishing to comment on this issue aze invited to attend and be heazd at the Tuesday. October 17,
