Per directive action of Mayor McMenomy we are placing this information and
update on Council agenda for your review and comment. Ron Wasmund and
myself inet with City legal council on 2/28/95 to discuss proper legal action and
response to Mr. Laxman Sundae's security deposit return request.
� Mr. Charlie LeFever recommended returning Mr. Sundae's security because using it as
' leverage to install the system has not and is not working. We will be returning Mr.
Sundae's deposit. We have been advised to take proper legal action and cite the
property and work it through the court system.
We have written and requested access to Mr. Sundae's site to re-evaluate the
conditions. We intend to have a consulting engineer accompany us to do a perculation
test and soil borings evaluation. Should access be denied we will request a warrant from
the court. A soil boring will provide better information on the failure issues. Should the
borings indicate non-complying separation to limiting soils or water table, a citation for
corrective action wiil be issued. The judicial system will settle this issue properly.

Dear Mr. Sundae:
In response to your request for Council action and return of your$8000.00 septic system
installation security deport for septic system/building pernut conditions at 2635-2637 132nd
Court,we are requesting your written permission for access to the site.
We would like your permission to re-evaluate and inspect the septic system area and current
conditions. We would like to do a perculation test and/or soil borings and take a more in-depth
look at the existing septic tanks. This work however cannot be properly done until all snow,ice
and frost is gone. Our intent would be to do this sometime in mid to late May of I995.
We feel this evaluation of conditions will resolve numerous issues. With your written
permission we will schedule this inspection with you. I will patiendy await your written
response.
