At the November 7, 1995 meeting the Councii adopted the Emergency Vehicie Pre-
emption System Ordinance and an Agreement with Dakota County. We finally received
the MNDOT or State Agreement regarding the same. The City Attorney has reviewed
the Agreement and Staff recommends that the attached resolution be passed and that
Council authorize the necessary signatures on the EVP Agreements with MNDOT.
There are two separate agreements - one for the 145th Street & Trunk Highway #3
signal light and the second for CSAH 42 & Trunk Highway #3 signal. I have attached
only one sample because they are identical except for the location. �
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION ENTERING INTO AN
AGREEMENT WITH THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTATION, FOR

A RESOLUTION ENTERING JNTO AN AGREEMENT WITH
THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTATION,
FOR THE INSTALLATION OF AN EMERGENCY VEHICLE PRE-EMPTION SYSTEM
BE IT RESOLVED that the City of Rosemount enter into an agreement with the State of
Minnesota, Department of Transportation for the following purposes, to-wit:
For the installation, operation, maintenance and removal of emergency vehicle pre-
emption at the existing traffic control signals on Trunk Highway No. 3 iSouth Robert
Trail) at 145th Street West and at Trunk Highway No. 3 (South Robert Trail) and
CSAH 42 (150th Street West) in accordance with the terms and conditions set forth
and contained in Agreement No. 62009 Supplemental Agreement No. 1 and
Agreement No. 69168 Supplemental Agreement No. 1, copies of which are before
the CounciL
BE IT FURTHER RESOLVED that the proper City officers be and hereby are authorized to
execute such agreements, and thereby obligations contained therein.

EVP on Trunk Highway No. 3 at CSAH 42 and 145th Street in Rosemount
Dear Mr. Osmundson:
Enclosed please find three original copies of each supplemental agreement between the State of
Minnesota, Department of Transportation and the City of Rosemount covering the cost,
maintenance and operation of the emergency vehicle preemption additions to the referenced
intersections.
Kindly review the agreements, and, if approved, present it to the proper officials for execution
on behalf of the City of Rosemount. They should be advised to sign all copies of the
agreements, making sure to attaeh the corporate seal to all copies thereof and to all copies of
the resolutions.
Please return the executed agreements to my attention for further processing. When the
agreement has been fully executed, a copy will be returned to the City of Rosemount.

WHEREAS, there exists in full force and effect Traffic
Control Signal Agreement No. 62009 dated April 5, 1984, entered
into by and between the State of Minnesota, Department of
Transportation, hereinafter referred to as the °State" , and the
City of Rosemount, hereinafter referred to as the "City" ,
WITNESSETH: �
WHEREAS, Minnesota Statutes Section 161.20 (1994)
authorizes the Commissioner of Transportation to make
arrangements with and cooperate with any governmental authority
for the purposes of constructing, maintaining and imprvving the
Trunk Highway system; and � .
WHEREAS, it is justified and considered mutually
desirable to install emergency vehicle pre-emption at the
existing traffic control signal on Trunk Highway No. 3 (South �
Robert Trai1) at 145th Street West; and
WHEREAS, the City requests and the State agrees to the
installation of an Emergency Vehicle Pre-emption System,
hereinaf.ter referred to as the "EVP System, " as a part of the
existing traffic control signal installation in accordance with
the terms and conditions hereinafter set forth; and
WI-iEREAS, the City and the State will share in the
installation, operation, maintenance and removal of the EVP
System as hereinafter set forth;

. NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
l. The City with its own forces and equipment or by
contract shall install the EVP System at the existing traffic
control signal on Trunk Highway No. 3 (South Robert Trail) at
145th Street West, at its own cost and expense.
2 . The State shall perform the cabinet modifications
for the EVP System work provided for in Paragraph 1, at its own
cost and expense.
3 . The EVP System provided for in Paragraph l hereof
shall be installed, operated, maintained, or removed in
accordance with the following conditions and requirements :
a. All maintenance of the EVP System shall be
done by State forces.
b. Emitter units may be installed and used only
on vehicl.es responding to an emergency as
defined in Minnesota Statutes Chapter 169 . 01,
� Subdivision 5 and 169 . 03 . The City will
provide the State' s Assistant Division
Engineer or his duly appointed representative
a list of all such vehicles with emitter
units .
� c. Malfunction of the EVP System shall be
reported to the State immediately. �

� d, In the event said EVP System or components � �
are, in the opinion of the State, being
. misused or the conditions set forth in
Paragraph b above are violated, and such
- misuse or violation continues after receipt __
by the City of written notice thereof from
the State, the State shall remove the EVP
System. Upon removal of the EVP System
pursuant to this Paragraph, the field wiring,
cabinet wiring, detector receivers, infrared
detector heads and indicator lamps and all

other components shall beeome the property of
the State.
- e. All timing of said EVP System shall be i

4 . Except as provided for herein, all terms and
conditions eontained in said Agreement No. 62009 shall remain in
full force and effect.
