Mr. Mike Mickelson requested a building permit to construct a house for his residence on property
he owns north of the Valleywood Golf Course. The property consists of five separate parcels, one of
which is owned by a family member. On November 14, 1995, the Planning Commission acting as the
Board of Appeals and Adjustments granted Mr. Mickelson a variance for the property because it did
not front on a public street.
The variance had conditional approval including:
* assembling the undeveloped parcels to eliminate future building pernut requests for lots of record;
* acquisition of an easement from the golf course that will substitute for a public street; and,
* rezoning of the property from Agriculture to Rural ResidentiaL
The rezoning is consistent with the Comprehensive Guide Plan land use designation of the property
which is Rural Residential. The rezoning is also consistent with the current use and proposed
development of the property with private septic system and well. The density is less than one
dwelling unit per five acres.
Recommended Action: A MOTION to adopt an ordinance providing for the rezoning of
property in the northwest quarter of Section 18, Township 115, Range 19, owned by Mike
Mickelson from AG Agriculture to RR Rural Residential.

CTTY OF ROSEMOUNf ZONING ORDINANCE

THE CITY COUNCIL OF THE CITY OF ROSEMOUNT,MINNESOTA ORDAINS AS FOLLOWS:
Section l. Ordinance No. B, adopted September 19, 1989, entitled Ciry of Rosemount Zoning
Ordinance is hereby amended to rezone from AG Agriculture to RR Rural Residential the following
described property located within the City of Rosemount, Minnesota to-wit:
That part of the West Half of the Northwest Quarter of Section 18, Township 115,
Range 19 Dakota County, Minnesota which lies northerly of the following described
line: Beginning at a point on the east line of said West Half of the Northwest
Quarter distant 2150.03 feet north of the southeast corner thereof; thence west at
right angles to said east line 235.00 feet; thence deflect to the right 61 degrees 04
minutes 48 seconds a distance of 201.63 feet; thence deflect to the left 81 degrees
14 minutes 08 seconds a distance of 867.63 feet; thence deflect ta the right 18
degrees 16 minutes 37 seconds a distance of 172.02 feet to a point on the West line
of the Northwest Quarter of said Section 18, said point being a distance of 601.63
feet Southerly of the Northwest corner of said Section 18, as measured along the
West line thereof, and said line there terminating.
Together with that part of Government Lot 2, Section 7, Township 115, Range 19,
Dakota County, Minnesota lying west of the east 80 rods thereof. Containing
19,452 acres.
i n 2. The Zoning Map o£the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled Zoning Map of the City of Rosemount shall not be
republished to show the aforesaid rezoning, but the Clerk shall appropriately mark the said zoning map
on file in the Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this
Ordinance and all of the notation references and other information shown thereon are hereby
incorporated by reference and made a part of this Ordinance.
i n . This ordinance shall be effective immediately upon its passage and publication
according to law.
