This public hearing is required for the review of the concept for a mixed use planned unit
development proposed for the undeveloped property south of County State Aid H'ighway 42,
between Chippendale Avenue and Shannon Parkway. On September 26, 1995 the Planning
Commission conducted a public information meeting regarding the concept and received many
comments from the approxirnately thirty(30) residents in attendance. Most of the comments were
negative. As a result, extensive minutes were prepared and are attached for your review. The
attached memo also summarizes the concerns. The attached Planning Commission Mema discusses
the conept in detail. �

On September 26, 1995, the Planning Commission reviewed the concept for a m�ed use planned unit
development for the 77 undeveloped acres between Chippendale Avenue, Shannon Parkway and south
of CSAH 42. The public was invited to provide comments which were received by the.Planning
Commission. The mixed uses include retail and service commercial, office, and attached residential.
The following process issues will be initiated with the approval of the concept PUD:
1) A PUD final development plan will be prepared providing design considerations that respond to
conditions of approval of the concept review, as well as issues identified during the review process;
2) A Comprehensive Guide Plan Amendment is required for appro�mately 28 acres of the northern
half of the property to bring it into the Metropolitan Urban Service Area(MUSA);
3) A preliminary plat will be needed to subdivide the property into parcels and right-of-way for public
and private improvements;
4) The various parcels will be rezoned to applicable commercial and residential zoning districts. The
City Council may choose to implement rezonings with final plat approval related to each phase and
consistent with practice.
Some of the comments and concerns identified by the audience participants included:
* The extent of commercial development along CSAH 42 all the way to Shannon Parkway.
* The relative need for additional gas stations and fast food restaurants in the proposed location
indicated in the concept.
* The resulting noise, traffic, lighting, and environmental effects o,f'the commercial uses.
* Inadequate buffering between commercial and residential uses with possible drainage impacts.
* The need for another park in the eastern vicinity of the O'Leary's Hills residential area.
* The potential for low-income or subsidized housing with attendant neighborhood impacts
regarding safety, vandalism, and property value depreciation.

After considerable discussion and comment the Planning Commission recommended approval of the
concept subject to the following conditions:
1) incorporation of Engineering and Park Department recommendations relative to access,
circulation, grading, utilities and park dedication specified in attached department memos;
2) Blocks 8 and 9 densities shall be limited to six(6) dwelling units per acre:
3) approval of the Dakota County Platting Commission;
4) elimination of identified variances to setbacks for buildings and parking or the Planning
Commission must forward findings as required in Section 12.2 of the Zoning Ordinance to the City
Council in support of any variances;
5) provision of conceptual information regarding Lot 9 intended for residential uses, if part of phase
l;
6) conformance with the subdivision and zoning ordinances for PUD final development plan review,
platting, and rezoning requirements;
'7) approval of a Comprehensive Guide Plan Amendment to add the commercial elements of the first
phase of the PUD in Blocks 1 and 2 into the MUSA;
8} a traffic study must be conducted; and
9) Block 10 be retained (reserved)for commercial uses for ten years and that any residential uses that

would be subsequently developed be limited to 12 dwelling units per acre.
; Mr. John Voss the planning consultant representing the partnership indicated that the plans would be
! modified to eliminate variances and conform with development standards. He also indicated that the life
span of the phasing plan would be longer than indicated in the sta.ff report.

WHEREAS,the Chippendale Pariners have applied for approval of a mixed use planned unit development for
their property in the City of Rosemount located between Chippendale Avenue, Shannon Parkway, and south of
Couniy State Aid Highway 42,legally described as follows:
The North Half of the Northeast Quarter(N'/Z of the NE'/4)of Section 31,Township 115 North,Range 19
West,EXCEPT the right-of-way for Counry State Aid highway No. 42,City of Rosemount,Dakota County,
Minnesota.
WHEREAS,the proposed planned unit development is consistent with the goals and policies of the
Comprehensive Guide Plan; and
WHEREAS, on September 26, 1995 the Planning Commission reviewed the concept planned unit
development and adopted a motion to recommend approval of the Chippendale Partners MiaLed Use Concept
Planned Unit Development with conditions; and
WHEREAS,the City Council conducted a public hearing on November 7, 1995 to hear testimony regarding
the proposed planned unit development in accordance with Section 12.2 of the City of Rosemount Zoning
Ordinance as well as Sta.te Statutes.
NOW,THEREFORE,BE IT RESOLVED,the City Council of the Ciiy of Rosemount hereby approves the
� concept for the Chippendale Partners Mixed Use Planned Unit Development subject to:
� l. incorporation of Engineering and Park Department recommendations relative to access, circulation,
! grading, utilities, and park dedication as outlined in their reviews for the Chippendale Partners
� Concept Planned Unit Development;

The Chippendale Pariners PUD was prepared with the benefit of Planning Commission discussion at a
work session on August 22, 1995.

`{ PROPOSAL:

s� The proposed PUD Concept combines commercial and residential uses on 77 acres of undeveloped land
r;
+ that fronts the south side of CSAH 42 between ShannonParkway on the west and Chippendale Avenue
�i on the east. Residential uses aze established along the southerly boundary with the O'Leary's Hills single
�� family deta.ched additions. The property is currently in the Agriculture District except the existing bank
��: properry on the northeast corner which is zoned C-4, General Commercial.
LAND USE:
The property is guided PD-MLT Planned Development-Mixed use which anticipates land uses which
provide transitions�'om the established residential uses adjacent to the south and west, and commercial
uses established on the east side. Single family detached residential uses aze established along the north
:a side of CSAH 42.
Approximately 28 acres of the northem half of the property fronting along CSAH 42 is not currently in the
Metropolitan Urban Service Area(MUSA). This area was expected to be brought into the MLTSA with
the second phase of the Comprehensive Guide Plan in 1998 to 2005. A Comprehensive Guide Plan
Amendment will be required to place all or part of the property in the MUSA.
The PUD proposes low density attached housing of 6-8 dwelling units per acre adjacent to the existing
single family housing to the south and a variety of generally stand alone commercial uses along CSAH 42.
A centrally located parceT has been defined in accordance with the Planning Commission's direction to
provide space for a"big box" commercial use. This central pazcel is 11.8 acres in size,which is lazger
than the area occupied by the Rosemount Market Square PUD.
---. ACCESS&CIRCUI,ATION:
Six access points aze proposed that will be dedicated forpublic right-of-way(ROV�. Three connections
to CSAH 42 aze shown with 1/8 mile spacing consistent with current County standa.rds. The center
access to CSAH 42 is full movement with the two on either side being right-in,right-out

One primary east-west street is provided aligning with 151st street on the east at Chippendale Avenue and
December Trail on the west ax Shannon Parkway. One southerly connection to the O'Leary's Hills
Additions aligns with Clazet Avenue. The Street design responds concerns identified by Staff eliminating
through connections between CSAH 42 and Claret Avenue.
The Plan includes several privaxe driveway accesses to Chippendale Avenue and Shannon Parkway. The
dtiveway connection to Shannon Parkway should be eliminated because of the proximity to the
intersection at CSAH 42. Access to the northwest comer parcel should occur along 151st Street on the
south and Crestone Avenue to the east The access to Chippendale Ave. for the existing bank in the
northeast corner will become a right-in/right-out only connection. Traffic increases along Chippendale
Avenue will eventually necessitate a median between CSAH 42 and 151st Street West. The driveway
connecting block 6 to Chippendale may need to be eliminated
Several proposed driveway locations along 151 st Street West create concerns because of proximity to
intersections. The proposed driveway for the existing bank appeazs to be so close to Chippendale Avenue
that no stacking space is possible at the intersection and southbound vehicles would still be stopped at an
angle which could block through traffic. Similar concerns result from the service station entrance to 151st
Street West at block 6. Both intersections should be shifted as faz west as possible to minimize entry/exit
traffic conflicts with traffic stacking up and moving through the Chippendale Avenue intersection.
The City Engineer will recommend that a detailed traffic study be conducted to examine traffic flow
� projections based upon proposed uses added to the existing land uses to arrive at specific
recommendations for access locations, spacing and traffic controls.
Pi.�iT'rIlVG Iss�s:
' The PUD is divided into ten blocks with blocks 1-7 proposed for commercial uses and blocks 8 and 9 for
residenrial uses with attached single family units of R-2 densities. Block 10 is capable of accommoda.ting
a"big box" commercial use in the center of the site. If mazket forces do not support this type of
development,then block 10 would be proposed to be developed for multiple residential use with densities
in the R-3 range of 10- 14 units per acre.
Most of the blocks would eventually be fiuther subdivided to support separate ownership of the multiple
uses. From the beginning,blocks 5 and 6 aze shown with one distinct use, and therefore the details of
setbacks should be discussed.
The existing bank occupies a lot that would be split by the 151st Street West ROW and a service station
would be developed on the now isolated southem remnant The existing pazking lot encroaches into the
setbacks required by Chippendale, CSAH 42 and the westem property line. As existing pazking,the
parking and drives mayhave legal-non-conforming status and cannot be enlarged or replaced without
being brought into conformance.
Portions of the existing bank access and pazking can be redistributed,especially with the above mentioned
access concems for support. Block 4 and block 5 aze presented as sharing a pazking lot with four rows of
� pazking that crosses the common boundary line along the southern half of the two blocks. The findings
� for the PUD would have to support the shared pazking and or driveways as necessary. The proposed
� parking lot overlaps with the existing system and the azea that is proposed to be removed should be
completely defined

FARKING CONSIDERATIONS:
Some of the uses require additional detail to provide an indepth parking requirement analysis. Such
infonnation would include the number of seats in restaurants,service bays in the auto service azea and
o�cupanc�,rating in the day care. However, initial review ofBlock 1 suggests that more than sufficient
parlang is available. A design modification is warranted to eliminate several rows of pazking that aze
orierned to traffic lanes instead of maneuvering lanes.

The Staff recommendation regarding the Park Dedication requirement will be for cash contribution and
trails/sidewalks. The Plan indicaxes sidewalks along CSAH 42,East side of Shannon Pazkway, west side
of Chippendale Avenue and both sides of 151st Street West. Staffwill recommend that sidewalks also be
included on 6oth sides of Crestone Avenue and Cimarron Avenue, and on the west side of Clazet Avenue.
� No land dedication will be recommended, given the proximity of Jaycee Park located 1/8th of a mile south
on the west side of Shannon Pazkway.
- O'I�R CONSIDERATIONS: -
All of the commercial blocks have pazkin�lot setback encroachments to various degrees. Blocks 1, 2, 3,
• 6 and 7 have encroachments to the 151st Street West ROW. Block2 has an encroachment along the east
side adjacent to Claret Avenue(at CSAH 42). Block 6 encroaches along Chippendaie Avenue and block
{ '7 encroaches along Cimarron Avenue.

�. Six building encroachments are located at:
Block 1 -Along 151st Street West-Day caze and Retail;
Block 2-Along 151st Street West-Restaurant at southwest comer of block;
Block 3 -Along 151st Street West-A I000 sq. ft. bldg.. in the east-center of the block;
Block 7-Along the southern boundary adjacent to Block 8 intended for Residential uses,both office/
retail buildings encroach at their southeriy elevations.
The site has relatively fev���;�'at ..ssonstraints that would justify d�e variances needed for the setback
encroachments. Man�d street alignments with December Trail on the west,ElaretAvenue on the
south and 151st Street on the east do not appear to warrant the variances.
A small wetland occurs near the existing bank,but it does not appear to be directly reiaxed to variance
issues.
The Plan should provide si�ificant buffering a(ong the southerly side yazds of blocks 6 and?to mitigaxe
land use incompatibilities with particular regard to the service station proposed for block 6 and the
intended residential uses of block 8. The three proposed ponding areas provide opportunities for
landscaping amenities that will provide transitions between the existing single family residential pattern of
. the O`Leary's Hills additions to the soutiL
No details have been provided for the residential uses intended for blocks 8 and 9. If block 9 is intended
� to be in the first phase,the some conceptual information should be provided. As with other
' developmerns, a separate PUD or major PUD revision will be required in the future if the housing
component is premature at this time. Given that blocks 8 and 9 aze located at a criticai transition poin�
the Planning Commission may prefer to have housing concepts included with the PUD.

In approving the Concept Plan,the Planning Commission must find as follows and forwazd its findings to
the City Council.
1. The Plan provides su�icient useable open space and evidences a substantial preservation of natural
features to warrant the granting of vaziances through Planned Unit Developmen�k
' The existing pond is being preserved and three ponding areas are indicated along the southern
boundary adjacent to the single family residential, creating opportunities for iransitions.
2. The Plan complies with the intent of the Comprehensive Guide Plan.
The proposed PUD does appear to be consistentwith the PD MUPlanned Development-11�Iixed Use
section of the Comprehensive Guide plan as it applies to the MclVamera Property.
3. The proposed development will not be detrimental to surrounding properties.
The Planning Department is not aware of any part of the PUD that would be considered detrimental
�recommended modiftcations and enhancements are provided.
4. The Plan is more creative and will provide a better living,working or shopping environment than is
possible under strict ordinance requirements. `
The PUD has been prepared to respond to the Planning Commission's interest in providing space for
a large retail use labeled"a big box".
RECOMIVIENDATION:
MOTION to recommend approval of the concept for the mixed use planned development presented by
Chippendale Par�ers to the City Council subject to:
1. incorporation of Engineering and Pazk Department recommendations relative to access, circulation,
grading, utilities and pazk dedication as mentioned above and outlined in the attached memos;
Z. Blocks 8 and 9 densities shall be limited to six(6) dwelling units per acre and the alternative residential
proposal for Block 10 shall be limited to twelve(I2) dwelling units per acre;
3. approval by the Dakota County Platring Commission;
' 4. elimination of identified variances to setbacks for buildings and parking or the Planning Commission
must forward findings as required in Section 12.2 of the Zoning Ordinance to the City Council in
, support of any variances;
5. provision of conceptual information regarding lot 9 intended for residential uses if part of phase l;

The following is a review by the Engineering/Public Works Department of the "Land Use &
Phasing Plan" and "Utility & Ponding Plan" of the P.U.D. Concept Plan submittal by the
� Chippendale Partners. The plans are both dated September 8, 1995.
Drainaqe Facilities
Proposed ponding locations conform with the City's Storm Water Management Plan.
Wetland areas in the northeast and southwest corners of the property will not change. All
drainage from this development will ultimately be to Wachter Lake which conforms with the
Storm Water Management Plan. .
Existing County 42 from Shannon Parkway to Chippendale Avenue has aggregate shoulders
and ditches with a limited amount of curb and gutter. Due to the proposed turn Ianes on
CSAH 42 the ditches will be eliminated and an urban section including the construction of
curb and gutter will be required. Beehive inlets in the median ditch and south side ditch
would have to be reconstructed into catch basins. Storm sewers in the proposed
development may need oversizing to handle run-off from the County 42 right-of-way. The
plans need to show storm drain connection to the recently installed outlet from the Carrollton
Addition on the north side of CSAH 42. Oversizing for this pipe will be paid from the Storm
Water Utility.
Sanitary Sewer
Generally, the proposed sanitary sewer in the north one third of the property flows to the
Rosemount Treatment Plant via a connection to the Metropolitan Council sewer in County
McNamara Addition Review
42 right-of-way. The proposed sanitary sewer in the south two thirds of the property fiows
to the Empire Treatment via a connection to existing sewer at Claret Avenue.
The location and direction of flow of proposed sanitary sewers appears to conform with
MUSA requirements. Sizing of the Claret pipe stiU needs to be checked from an engineering
standpoint.
Watermain
The proposed watermain layout generally conforms to the Comprehensive Water System
Plan. Staff requests that the 12" main running through the commercial area be iocated in
151 st Street right-of-way between Crestone and Cimarron Avenues.
It is also requested that future development of the low density multiple areas in the
southwest and southeast corners of the property include 8" watermain,. The 8" watermains
would connect the 8" main on Crestone with the 16" main on Shannon Parkway and the
8" main on Cimarron Avenue with the 16" main on Shannon Parkway. This would provide
loop closures as identified in the Comprehensive Plan and additional fire protection.
Streets
Street alignments and layouts are acceptable. Staff will be hiring a consultant to analyze the
impact of this development on traffic movements in the area, especially the effect on
Chippendale Avenue at the developer's expense.
briveway connections to Shannon Parkway north of the proposed 151 st Street will not be
allowed. Driveway connections to 151 st Street for Blocks 5 and 6 will have to be located
a minimum of 250' from the centerline of Chippendale Avenue. Driveway connection
between Block 7 and 151 st Street needs to be aligned with the driveway connection for
Block 4. Driveway connections to 151 st Street for Blocks 2 and 3 need to be located a
minimum of 250' from the centerline intersection of the main entrance street from County
42 with 151 st Street.
Chippendale Avenue requires reconstruction south of 151st Street. It is in the C.I.P. which
policy then requires a pre-payment of future assessments for those improvements.
Sidewalks. & 7rails
Bituminous trail construction is proposed along County 42 from Shannon Parkway to
Chippendale Avenue. The existing bituminous trail along Shannon Parkway, just south of
County 42, runs along the curb fine of the right turn lane. Staff is requiring that the trail at
this location be relocated farther east to create a clear zone or boulevard between the trail
and curb.

Easements & Right-of-Wavs
50' of half right-of-way is required on Chippendale Avenue along Shannon Parkway, a total
of 80' is required including what is already dedicated.
10' utility and drainage easements are required on the property lines.
80' of right-of-way is required on 151 st Street and the Claret entrance off CSAH 42. 66'
of right-of-way is required on Crestone and Cimarron and 60' on Claret to the south.
Ponding easements will be required and appear adequate at this concept stage. Further
evaluation is required prior to platting.
The Dakota County Plat Commission must approve the Preliminary Plat prior to City approval.
They have reviewed this Concept Plan and have approved the access to CSAH 42 and the
right-of-way on CSAH 42.
Fees & Assessments
A Geographic Information Systems (GIS) fee will be requested at the time of final platting at
the rate in effect at that time. Currently it is 550 per lot/unit in housing acreage and 5100
per acre in other zoning districts.
Per the City's Assessment Policy, the pre-payment of assessments is based on the zoning
for the property. The low density multiple (R2? area is to pay for half of a 32' residential
street and the commercial zoning is to pay for half of a 49' commercial sized street. The R2
area has approximately 440' of frontage multiplied by 546.36 per foot t1994 RESA) equaling
520,400. The commercial area measures approximately 260' of frontage at 576.63 per foot
equalling 519,925. Total pre-assessment payment of 540,325.
� Permits
A NPDES permit must be applied for (and a copy submitted to City Staff) plus an approved
Grading Plan are required prior to grading the site.
, Currently the norther 15-20 acres are not in the MUSA which will require a Comprehensive
Guide Plan amendment prior to construction of sanitary sewer in that area. An MPCA permit
and MCES letter are also required prior to sanitary sewer plan approvaL

� Assistant Planner Rick Pearson provided a summary an application submitted by Chippendale/42
Partnership, property owner and developer, and their request for concept approval for a mixed use
commercial/residential planned unit development. The 77-acre parcel combines commercial and
� residential uses on undeveloped land that fronts on the south side of County Road 42, between
t T� Shannon Pazkway and Chippendale Avenue and is cunently zoned AG Agriculture and guided in the
� City of Rosemount Comprehensive Guide Plan's Land Use Designation for PD-MU Planned
Development-M'v�ed Use. The project will require a Comprehensive Guide Plan Amendment to
bring all or a portion of the northern half of the site into the Metropolitan Urban Service Area
(MUSA).
John Voss, development consultant for the property owner, was present and responded to questions
regarding this proposal. The Chippendale/42 Concept PUD proposes low density attached hausing of
six to eight dwelling units per acre adjacent to eacisting single family houses to the south and a variety
of commercial uses along CSAH 42. A centrally located parcel has been defined in accordance with
the Planning Commission direction to provide space for a"big box" commercial use. This parcel is
11.8 acres in size which is larger than the area occupied by the Rosemount Market Square PUD.
Several residents were present for comment and raised several issues regarding the proposed
development of this site. Kelly Sampo, 3589 152nd Street West, expressed concern regazding
_ drainage impacts to abutting properties, questioned the need for more gas stations and fast food
restaurants, and adequate parking for commercial uses. Kris Davis, 3661 152nd Street West, cited
ponding, adequate buffer and screening between commercial and residential uses, pazk area,
overdevelopment of commercial area, impact on public services for traffic and pedestrian safety and
security, and noise as questions that should be addressed.
' Bill Day, 14955 Crestview Avenue, discussed vandalism, traffic, and environmental impact
concerns. Mr. Day also questioned whether adequate time and scope of notice to property owners
was sufficient. Assistant Planner Pearson advised that this was not a formal public hearing as
mandated by State Statute. However, the City issued a notice to all property owners within the state
mandated 350 feet of the subject property as a courtesy invitation to this informational meeting and
discussion by the Planning Commission to provide and opporlunity for initial public input and

comment. These comments will be forwazded to the City Council along with the Planning
�' Commission recommendation and become a part of the legal record at the formal public hearing
which is proposed to be held by City Council in November.

The floor was opened for further public discussion. Mr. Mark Deforrest, 3643 152nd Street West
- expressed concern for adequate berm and landscaping between residential and commercial uses and,
further, stated his opposition to a single large retail proposal. Lee Schuldt, 3764 Upper 149th Street
West, stated that inforrnation had been related, by a local builder, that commercial was not planned
nor was it intended for this property and that the current market does not support the proposed
commercial element of this development.
Kelly McGivern, 15173 Claret Avenue, related her concern about the proposed "big box" retail area,
ponding issues, and whether it was wise or desirable to extend commercial further to the west of
Chippendale Avenue into e�sting residential areas. Tracy Morgan, 14950 Colorado Avenue, noted
that she opposed further commercial development on this site. Mr. Steve Werner, 3864 Upper 149th
Street West discussed concern for increased noise and traffic should late-hour (i.e. fast food)
commercial uses be sited on this property. He further stated that he felt he had been misled about
how the McNamara properry would be developed. Joel Heimkes, 15201 Claret Avenue, discussed
traffic issues and his opposition to additional commercial in this area.
Doug Cashman, 15265 Columbary Circle, requested identification of the "downtown" and what azea
it encompasses and his fear that too much strip commercial/retail development would draw�business
j• away from a defined "downtown." Mr. Mark Lindell, local consultant present for another agenda
#� item, reiterated that consideration for further commercial strip development along County Road 42
;, would be detrimental to cunent efforts for emphasis and re-establishment of the Rosemount

;� "downtown."

Mr. Ron Bennet, 3966 Upper 149th Street West discussed this concern that the proposed commercial
` uses would not be consistent with his expectation for a lazge single user. Further, the construction of
fences for security by residents abutting the commercial property could be an attraction for
vandalism. Mr. Bennet further expressed cvncern for overdevelopment of commercial azeas within
_ the City with no regard for marketability, increased traffic, and appropriateness of additional

commercial uses along County Road 42.
� The Planning Commission discussed storm water management issues,proposed�ariances, townhouse
' design, vehicular and pedestrian traffic patterns, increased tra�c, potential for reduction of proposed
commercial development in future phases, variances, aesthetic tceatment, and residential density
issues. Lengthy discussion ensued.
� MOTION by Ingram to recommend to City Council approval of the concept for the mixed use
planned development presented by Chippendale Partners subject to:
1) incorporation of Engineering and Park Department recommendations relative to access,
