BURT, CITY ADMIl�TISTRATOR AGENDA��� A � � � 1111 ATTACHMENTS: RESOLUTION APPROVED BY: � On October 4, 1995 the city council adopted an ordinance to regulate pawn shops and pawn brokers within the city. The ordinance allows the city council to set annual license fees by resolutioq and the city council adopted a resolution on October 14, 1995 setting the annuallicense fee at $5,000. Upon evaluating almost one year's worth of information from the business conducted at the one pawn shop in the city, it is more appropriate to set a license fee based on transactions•and time spent by police department sta,i� It has been estimated the community seivice officer's time for one year is between $1500 and $1700. I am therefore recommending that the initial fee be $1500 and be escalated based on the average number of daily pawn transactions as follows: 0 to 10 pawns- $1500/year; 11 to 20 pawns- $3000 a year and over 21 pawns- $5,000 a year. As with all license fees, staff will continue to review the fees and recommend necessary changes when the city council considers the annual fee resolution. It is my recommendation that the city council adopt the attached resolution to change the license fee to an escalating fee based on transactions. During this investigation,' it was learned that some of the stolen property was later sold at your pawn shop under false pretenses, thereby taking advantage of your business. As a result, you were forced to surrender that property for future evidentiary value in this case. Because of this direct loss to your business and in consideration of the elements of this investigation, financial recovery may be in doubt. Despite all that, you have shown a strong I willingness to cooperate with law enforcement in an effort � to prevent a similar incident occurring again. On January 20, 1995, I contacted your business after receiving information that a three piece amplifier was believed to have been pawned at your business. f described the above item to you and in a short period of time was advised that you still had possession of the amplifier and would certainly hold it for my department to recover. On January 21, 1995, I iret with you at your business and received the above item without any delay or questions from you. With your assistance in the recovery of the property I was able to complete my investigation and return the property back to the owner. VVithout your assistance in this matter it would have been more difficult to recover the properiy for the owner and solve the case. I very much appreciate your timely assistance and feel that in the future, should the need arise, I would have no problem in obtaining assistance from you. .
