This amendment has been prepared with the objective of increasing standards for setbacks along
highways and railroads for residential and commercial uses. Recent residential development
along the south side of CSAH 42 provided an example of the current minimum requirements for
development.
This Amendment was discussed on several occasions by the Planning Commission and
recommended for approval on July 1l, 1995. The amendment will increase building setbacks and
correspondingly, require increased lot sizes along highways and collector streets. The
amendment accomplishes the same along (overhead) high power transmission easements and
pipelines.
Similar amendments were recommended two years ago. They were part of a larger package of
amendments that failed to receive enough votes for adoption. The need for the increased
standards was questioned as well as the variety of ordinances that were recammended at the time.
Maximum density reductions in the R-2 and R-3 Residential Districts have since been
accomplished via separate amendments. Also not included is the previously recommended
specific performance criteria for landscape buffer yards.
Recommended Action: MOTION to adopt Ordinance B- , An ordinance amending
Ordinance B Section 7.2 Supplementary Yard Regulations.

NOTTCE IS HEREBY GIVEN, the City Council of the City of Rosemount will hold a public
hearing to consider the item listed below on Tuesda.y, August 1, 1995, in the Council
Chambers of the City Hall, 2875 145th Street West, beginning at 8:00 p.m., or as soon
thereafter as possible,
The purpose of this hearing is to consider an amendment to Ordinance B the City of
Rosemount Zoning Ordinance. The amendment will require increased lot dimensions and
yard setback criteria for principal and minor arterial highways, collector streets, railroad
right-of-ways and easements for high power transmission and pipelines.
Those persons wishing to comment on this issue are invited to attend and be heard at the
Tuesday, August l, 1995 City Council Meeting at 8:00 p.m. Written comments will be
accepted prior to the meeting by the Planning Department. Questions regarding the proposed
amendment should be directed to the Planning Department at 322-2051.

Reg,�lations of Ordinance B- City of Rosemount Zoning Ordinance is amended to include as follows:
6. Scope: The following supplementary yard regulations shall only apply to lots platted or
developments granted preliminary plat approval after adoption of this ordinance.
a. Where a lot or a parcel of land abuts or is traversed by an easernent intended for or
containing high power electrical transmission or a pipeline conveying natural gas or
petroleum, principal structures shall be setback a minimum of thirty (30) feet from the
easement boundary.
b. Where a yard has been required to provide for a buffer yard, earthen berm or planting strip
for the purpose of screening views and reducing noise levels in residential areas, principal
and accessory building setbacks will be increased accordingly to protect the buildable
portion of the lot and to preserve the buffer yard, earthen berm, or planting strip.
c. The following table defines dimension standards that shall apply when property is adjacent
to railroad, collector street, �inor arterial, principal arterial rights-of-way; and easments
for pipelines or high power transmissions:

THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS:

VVHEREAS, Dakota County HRA owns land and is continuing to acquire the balance of all
remaining properties necessary to complete the assembling of all parcels for a Senior Housing
project on approximately 2.5 acres of land located along Cameo A,venue, between 146th and
Lower 147th Streets West, and being more fully described as follows:

WHEREAS, the Planning Commission of the Ciry of Rosemount has reviewed the high density
residential concept planned unit development at a public hearing conducted on July 25, 1995 and
has passed a motion to recommend approval of the request with conditions; and
WHEREAS, a Public Hearing has been conducted by the City Council to hear testimony
regarding the high density residential concept planned unit development in accordance with
- Section 12.2 of the City of Rosemount Zoning Ordinance.
THEREFORE BE IT RESOLVED that the City Council of the City of Rosemount hereby
. approves the high density residential planned unit development concept plan for the Dakota
County HRA for approximately 2.5 acres of land located along Cameo Avenue, between 146th
and Lower 147th Streets West, subject to the following conditions:
1. A review of the underground parking driveway access design and a redesign of the
pazking/circulation setback which eliminates the set back variance and provides a detailed
plan for screening the driveway and parking lot from property to the west.
2. Submission and approval of a detailed landscaping plan for the entire project with the final
development plan.
3. Submission and approval of a revised final building design which architecturally softens
the three-story design features of the entire building.
4. Full compliance with all requirements of the Rosemount Zoning and Subdivision
Ordinances, except as may be approved through the PUD.
5. Submission and approval of a detailed lighting plan.

Development Project is consistent with the Goals, Objectives and Policies of the Community and
Comprehensive Guide Plan; and .
WHEREAS, the proposed land use is adjacent to the Rosemount Downtown Commercial District
and is within the Central Community Commercial Study Area; and
VVHEREA5, an application has been submitted to rezone the project area from Rl-a Single Family
to R-4 Multiple Family Residential; and
WHEREAS, existing and planned water and sewer utility services are capable of ineeting the
needs of the development; and
"- W�IEREAS, existing and planned storm water facilities are capable of ineeting the needs of the
development; and
-- WFIEREAS, transportation facilities in the immediate area.provide sufficient ca.pacity to
accommodate the needs of proposed development; and
WHEREAS, the City of Rosemount has reviewed the proposed redevelopment project and
anticipates a very minor net increase in the additional sewer demand resulting from the proposed
development, which is not scheduled for construction before 1997; and
WHEREAS, the Planning Commission reviewed and recommended approval of the Minor
Comprehensive Guide Plan Amendment during a Public Hearing conducted on July 25, 1995; and
WHEREAS, a Public Hearing has been conducted by the City Council to hear testimony regarding
the high density residential concept planned unit development in accordance with the policies as set
forth in the Rosemount Comprehensive Guide Plan; and
WHEREAS, the proposed guide plan amendment and project will provide the opportunity to fulfill
a demonstrated need for additional senior-.housing in Rosemount.
THEREFORE BE IT RESOLVED that the application by the Dakota County HRA for an
amendment of approxunately 2.5 acres of land located along Cameo Avenue, between 146th and
Lower 147th Streets West to the City of Rosemount Land Use Plan re-guiding the property from
UR Urban Residential to HR�iigh Density Residential be approved, subject to review and approval
by the Metropolitan Council, and that the City Staff be directed to prepare a Minor Comprehensive
Guide Plan Amendment request for submission to the Metropolitan Council.
