Recommended Action:
I. A MOTION to approve of a Minor Comprehensive Guide Plan
Amendment adding approximately 15 acres to the City' s MUSA,
subject to approval by the Metropolitan Council .
II. A MOTION to table rezoning for approximately 14 .92 acres
from Agricultural to General Industrial until final plat .
III. A MOTION to approve a PUD Concept Plan for Koch Refining Co.

The attached Planning Report provides a description and analysis of the Koch
Refinery/Wayne Transport Development proposal. This summary is intended to provide
Council with an upda.te of the project activity that has occurred since it's review by the
Planning Commission.
On June 13, 1995 members of the Planning Commission reviewed the development proposal
and approved motions recommending approval to the Council for a11 applications connected
with this project. Two key elements in their approval conditions are as follows:
1. Alignment of the proposed West S.T.H. 52 frontage road and its point of
future connection with County Road 42.
2. Authorization to obtain a temporary driveway access permit to County Road
42 until such time as the frontage road is developed.
These key conditions are dependant upon approval from Dakota County based upon their
relationship to County Road 42. A copy of the Planning Commission meeting minutes for
this item have been atta.ched for your review.
On June 16, 1995 a letter was sent to Dakota County requesting review of the preliminary
plat and asking that these issues be considered. A copy of this letter has been attached for
review. On 7une 26, 1995 the Dakota County Plat Commission met to review the project.
They reviewed a revised PUD plan drawing prepared by the applicant which now shows the
proposed frontage road located appro�cimately 1100 feet west of the 42/52 interchange. This
location met with very favorable review by the Plat Commission. The proposed temporary
driveway access where Koch property has frontage on 42, however, did not meet with their
approval and resulted in their decision not to recommend approval of the plat. A copy of
their letter dated 7une 26, 1995 summarizes this decision.

Koch and Wayne Transport representaxives have been reviewing their options as a result of
the determination from Dakota. Counry concerning the temporary access. At this tune a
series of alternatives e�sts in proceeding with the development project. They appear to be
as follows:
1. Acquire additional right-of-way off-site and improve all or a portion of the
fronta.ge road to provide access to 42.
2. Improve a portion of the frontage road and provide access to former County
Road 38 to the north.
3. Process an appeal from the decision of the County Plat Commission to the
County's Physical Development Board Commission for the temporary
driveway access as proposed.
4. A combination of one of the above altematives.
The applicant is considering these options and will be working with City Staff to consider the
most appropriate direction to take with respect to this issue. Therefore, the recommended
condition for this issue has been modified to reflect this position. Resolution to this issue is
viewed as critical to the continued progression of this project beyond it's preliminary stage.
Recommended Action:

Dear Mr. Osmundson:
The Dakota County Plat Commission met on June 26, 1995, to ��,
consider the preliminary plat of the PUD for Koch '
Industries/Wayne Transport. Said plat is adjacent to CSAH
NO. 42 and is, therafore, subject to the Dakota County
Contiguous Plat Ordinance.
The Plat Commission recommended, on a 3 to 2 vote, not to
recommend approval of the plat as the County's spacing
guidelines do not allow private driveways on roads with �
projected ADT of over 15, 000.
The Plat Commission is in favor of the location of the
future street alignment as it meets the spacing guideline of '
;th mile west of the T.H. Na. 52 ramps.
County Board Resolution Number 82-151 states the followinq:
If a plat is submitted to a city and the access spacing is
NOT consistent with the Access Spacing Guidelines, then the
city may proceed in one of the following two wayst
A. If the City approves of the access spacing as shown in
the preliminary plat, then the city staff should submit
written comments to the County Plat Commission
outlining their reasons for recommending approval of
the plat. The Plat Commission may then consider
whether a variance is in the best interest of the
County.
B. If the City does NOT approve of the access spacing as
shown in a preliminary plat, then city staff should
work with the developer in attempting to meet the
County's guidelines, Also, city staff should submit a
written memo to the County Plat Commission outlining
their objections to the preliminary plat. Any
conflicts must be resolved before the County Plat
Commission considers final approval.

The city may appeal the Plat Commission recommendation to
the County Board of Commissioners. Please let me know if
the city wishes to appeal this recommendation and I will
prepare the agenda item. The appeal would be placed on the
agenda for the next Physical Development Board Commission
meeting.
No work shall commence in the County right of way until a
permit is obtained from the County Highway Department and no
permit will be issued until the plat has been filed.

Dear Mr. Stevenson:
Enclosed for your review please find a copy of the proposal received by the City of
Rosemount for the Koch Refining Co. proposed development of property located at the
northwest corner of S.T.H. 52 & C.S.A.H. 42. For your information, I have also enclosed
a copy of the Staff Planning Report which accompanied this request before the Rosemount
Planning Commission on June 13, 1995.
On June 13, 1995, the Planning Commission approved this proposal with a number of
conditions. One of the conditions added by the Planning Commission required "decisions
and fact fmding" by Dakota County. Specifically what the City is looking to Dakota. County
for response in this regard is as follows:
l. Alignment of a proposed west frontage road to S.T.H. 52 where it intersects with
C.S.A.H. 42. & needs for associated 42 roadway unprovements.
2. A temporary or interim driveway access from C.S.A.I3. to the proposed Wayne
Transport Facility.
3. Needs for traffic safety improvements at the S.T.H. 52 & C.S.A.H. 42 Interchange.
4. Needs for additional right-of-way where the pla.t is contiguous to C.S.A.H. 42.
The City of Rosemount has identified this project as an unportant economic development
opporlunity for the community. The City of Rosemount would appreciate the cooperation of
the County Plat Commission in reviewing this project and assisting in fmding cooperative
solutions to meet the immediate needs of Koch Refining Co.; while at the same time
identifying long-range design objectives which satisfy Dakota County Highway design
standards.

Planning Commission Action: Approved all four recommended motions and stipulated an

BACKGROUND
Koch Refining Company has requested approvai of a Minor Comprehensive Plan
Amendment; Rezoning; PUD Concept Plan and Preliminary Pla.t for property located near
the northwest intersection of C.R. 42 and S.T.H. 52. The applications support the intent of
Koch to acquire the property and buildings owned by Wayne Transport located in Inver
Grove Heights at 117th Street. Koch would then be providing Wayne Transport with a new
facility and land on approxunately 15 of the 55 acres recently acquired by Koch on the
former Dunn fann property. The entire 55 acres is included in the Concept Plan and
Preliminary Plat requests, however the plan amendment and rezoning would include only that
area of land where Wayne Transport would be located, including the area:afforded temporary
access to C.R. 42.
MINOR COMPREHENSIVE GUIDE PLAN A1VI�NDIV�NT
The area in question is guided for General Industrial land use and therefore the amendment
does not require any changes in the land use designation. The change involved includes the
addition of appro�cimately 15 acres of land to the Municipal Urban Service Area (MUSA) in
order to provide for urban sewer services to the property. Although sewage trea.tment for
many of the rural industrial users in eastern Rosemount is provided by on-site septic systems,
Wayne Transport has identified a need for urban sewer services. This is based upon the
number of employees working regular shifts on the property (37 office and 22 mechanics),
food gra.de and chemical washing facilities and the approximate 80 drivers that will be
coming and going during the course of the work day. The Metropolitan Council Wastewater
Services (MCWS) has estimated that the sewage flows, based upon information supplied by
Wayne Transport, shouid be an equivalent of 40 SAC units. Although the Rosemount
Wastewater Treatment Plant has present design limitations, the amount of anticipated waste

flows projected from new construction going to this plant appears to be somewhat lower over
the past two years than estimated by earlier projections. Therefore, it is not anticipated that
proposed increases in flows will impact current plant operaxions beyond it's present treatment
capacity. The MCWS will be taking a closer look at current flow rates relative to its rated
capacity and providing additional feedback through their review process.
Infrastructure Availabilitv
In terms of sewer availability, the interceptor runs easterly a distance of appro�nately 600
feet from the north end of the property. A trunk line would be extended as planned for in
the Eastern Rosemount Utility Study. The developer would have responsibility for
improvements related to the area being serviced. The City would be responsible for
additional capaciry above that required to service the development. Further analysis will be
required as to the cost and method for funding these trunk line improvements.
No additional impacts on the regional transportation system are anticipated as a result of this
project. Although a slight increase may result in the number of truck trips to and from the
site, they will only shift to a point further south along Hwy. 52 where a grade separated
interchange will provide for increased safety on the system. Dakota County Highway
Department had expressed some concerns over the uutial access point for the proposed
service road at it's intersection with C.R. 42. A temporary access driveway has now been
proposed for the property frontage along C.R. 42 with the ultimate service road connection
proposed to occur further west off-site. Additional right-of-way would need to be acquired
to provide for this connection.
Water services may be supplied from the rural 6" water main for domestic level flows to the
development. Further evaluation will be required as to the demands for fire suppression and
tank washing operations relative to available flows. It is possible that additional on-site
facilities may be needed to support water use demands of the business operations. The City
Engineer and East End Utility Study have identified the long-term need for an elevated
storage tower in this vicinity. This project alone is not anticipated to trigger this need, but
will serve to justify an intensifying need for implementing identified water needs in this area.
Increases in surface water runoff are anticipated to be accommodated through the use of on-
site detention ponds. No identified wetlands exist upon the site.
Procedurally, the City would consider approval for the comp plan amendment conditioned
upon approval by the Metropolitan Council.

REZONING
Within the past few years the City rezoned 10 acres (known as the L.H. Sowles property)
from Agriculture to General Industrial, along with a subdivision and site plan approval for a
building that was never constructed. The balance of the 45 acres contained in the property
representing the PUD concept area is presently zoned Agriculture. Appro�mately 2.47 acres
of the proposed Wayne Transport site as shown is within the General Industrial Zoning.
This would leave a balance of roughly 12.45 acres to be rezoned for the lot and an estimated
.85 acres for the temporary access drive to C.R. 42 for a total of 14.92 acres to be rezoned
from Agricultural to General Industrial.
Land to the west is zoned Agricultural with single family homes along 42.
Land to the North along C.R. 38 is zoned Agricultural with General Industrial zoning further
to the North.
Land to the Fast at the northeast intersection of C.R. 42 and S.T.H. 52 (Soleberg 10 ac.)
was recently rezoned to General Industrial. The balance is zoned Agriculture and Public.
Land to the South is zoned Agricultural with a few single family homes along the North and
South side of C.R. 42.
The subject property is all guided for General Industrial in the Future Land Use Element of
the City's Current Comprehensive Guide Plan. As such, the proposed rezoning is found to
be consistent with the City Comprehensive Plan and is recommended for approval.
PUD CONCEPT PLAN
In many respects, the site plan which is presented has good design characteristics associated
with the overall la.yout. The buildinas are oriented toward the front of the site which helps
to break up views of the paved rear surface area containing staging opera.tions. The location
for Wayne Transport also affords direct access to the rail spur identified as an asset for
receiving bulk shipments for the business. A PUD is required where multiple buildings are
proposed on a single parcel and to provide for the orderly planning of a phased development.
A review of various conceptual site development issues are as follows.

Access
A single access point is the only driveway proposed for the site. Whereas this may seem
logical given the temporary access driveway planned, a second driveway access is deemed
necessary for providing for the orderly flow of tra.ff'ic to and from the site. Further
consideraxion should also be given to affording an opportunity to separate the heavy truck
trafFic from the main circulation of employee and visitor vehicles.
Setbacks ,
The principal and accessory building locations shown meet required setbacks. The parking
azeas, however, would involve variances as follows:

Some deviation to required parking and circulation set backs may be appropriate where

Variances to parking setbacks along the east property line may be warranted provided a high
quality landscaped planting/screening area plan can be devised.

Site Covera�e
A significant portion of the site is dedicated to the improvement of buildings, paved surfaces,
and aggregate outdoor storage areas for the parking of semi tra.ctors and trailers. The
maximum lot coverage requirements of the General Industrial District is 50%.

The question this design raises is whether or not an aggregate base should apply toward the
lot coverage maximum percentage limitation. The defuution of Lot Covera.ge according to
the Zoning Ordinance is as follows: "The percent of the lot covered with structure, paved
and other impervious surfaces." One can make a case for the fact that crushed aggregate
does have pervious characteristics and may provide for limited absorption of water. On the
other hand, water will run off gravel at a much different rate than a landscaped or natural
vegeta.tive area. If the lot covera.ge requirement is applied to the site, then an additional
estimated 10 acres of green space would need to be added to the site bringing the total land
area for Wayne Transport up to 25 acres. This will not be viewed favorably by the
applicant. The PUD procedure does, however, afford us the ability to accommodate some
flexibility in the ordinance interpretaxion, provided there is a sound effort made toward
enhancing the overall appearance of the development and ensuring that adequate provisions
for on-site drainage are designed.
An engineering analysis of drainage conditions is not typically conducted at the Concept
stage of review, but will receive thorough review at the Final Development Plan stage. One
substantial measure to enhance the appearance of the outdoor storage area would be to
provide for a landscaped set back area along the north and west perimeter of the storage
area.
Pa.�'kin�
A total of 150 parking spaces, or nearly twice the required 77 spaces are proposed for the
site. The additional pazking spaces are intended to accommodate the approximate 80 drivers
that will create additional parking demand in addition to the 59 workers estimated to be
employed on-site. Limited opportunities for additional parking on-sitp exists should a need
develop. Slight modifications to the parking areas may be necessary to accommodate an
additional access point to the site.
FINDINGS
In approving the concept plan, the Planning Commission must fmd as follows and forward its
fmdings to the City Council:
1. The Plan provides sufficient usable open space and evidences a substantial
preservati�n of natural features to warrant the granting of variances through the
Planned Unit Development.
The plan has the potential tc provide for substantial usable open space. The degree will,,
however, be dependant upon the future development of the outlot areas and ultimate

configurations for the service road and possible future improvements to the 42/52
interchange. There are no substantial natural features that warrant preservation and thereby
minimizes potential conflicts with the natural environment.
2. The plan complies with the intent of the Comprehensive Guide Plan.
The Comprehensive Guide Plan land use designation is General Industrial which supports the
intended land use and associated rezoning to General Industrial. The proposed development
will also provide an opporlunity to provide for orderly growth by expanding the MUSA area
where services are readily available to service regional-scale industriaUcommercial
development. The PUD will also provide opportunities for the attraction of new business
and the retention and expansion of an existing business in this area of the region to expand
employment opportunities and increase/diversify the City's taY base.
3. The proposed development will not be detrimental to surrounding properties.
The applicant has attempted to minunize impacts of the development with surrounding non-
compatible land uses by positioning the initial phase of development toward the middle of the
site pernutting open space to serve as a transitional buffer until future redevelopment of land
occurs. The PUD concept also provides for temporary access to C.R. 42 and further
minimizes the immediate impacts of a proposed service road through the property until
provisions can be made for acquiring additional right-of-way off-site.
4. The Plan is more creative and will provide a better living, working or shopping
environment than is possible under strict ordinance requirements.
The long-term plan of the PUD is to accommodate a west fronta.ge road to 5.T.H. 52 which
will ultimately provide for a better and safer working environment for the area with respect
to commercial traffic. Over the long term it will also serve to implement the
recommendations of the Highway 52 Corridor Study by removing local trips from the
highway for commercial circulation and improved safery by encouraging the removal of at-
grade intersections to Highway 52.
PRELIlVIINARY PLAT
Platting of the property is required due to subdivision and resubdivision of land that will
occur in conjunction with the PUD. The plat includes the entire 55 acre parcel owned by
Koch. A lot area of approximately 15 acres is proposed for Wayne Transport, an estimated
5 acres for the proposed frontage road right-of-way and the balance of approximately 35
acres that would be designated as Outlot for future industriaUcommercial development.

Lot & Street Desi�n
Lot 1 and Outlots A&B meet the minimum 5 acre lot size for General Industrial lots as
required by the Zoning Ordinance. There are, however, a series of isolated & truncated lot
remnants that occur to the South and Ea.st of the proposed fronta.ge road location. This is a
function of the conceptual street design which was initially suggested by City Staff. This
was based upon the possible alignments as recommended by the Highway 52 Corridor Study
(a copy study design has been attached). 5ubsequent review of the proposed frontage road
connection point to C.R. 42 by the Dakota County Highway Department, however, has
pushed the location off-site further west of the railroad right-of-way.
Another issue is the fact that the Wayne Transport lot is deta.ched from the street frontage,
which is prohibited by the City's Subdivision Ordinance. This presents a significant concern
with respect to access and proper design of the subdivision layout. It is recommended that
the street alignment be moved so as to provide direct access from the lot to the street. A
concept as to how this might be accomplished has been attached for review. This revised
layout would not only provide for direct access, but would also resolve the isolated parcel
concerns and allow for a third outlot that would meet the minimum 5 acre lot size
requirement.
En_in�eerin�
There is a substantial amount of engineering da.ta that will need to be provided xelative to the
plat and associated improvements. This level of detail is typically not supplied at the PUD
concept stage of approval. The City Engineer has, however, reviewed the proposal and is in
general support of the proposal to develop this area for General Industrial land use.
It is recommended that action on the preliminary plat be ta.bled until a revised plan is brought
forth and preliminary engineering information to support the plat can be developed.
OTHER ISSUES
Koch Refining has identified the need for a short time frame in making their decision to
either acquire the cunent Wayne Transport property and construct them a new building, or
pursue other land options to support their fire station needs. City Staff has assured Koch
representatives that we will do everything possible to expedite the required reviews for the
project. Early reviews of the Concept Plan with Planning Commission and Council will
provide the applicant with necessary feedback as to the feasibility and general acceptance of
the project. If supported, this would enable the City to proceed with the Comp Plan

Amendment with Met Council which may take up to 2 months or so for review and
approval. Further refinements and detailed engineering information may be developed to
support this project and required local approvals during this time period.
SUNIlVIARY
The proposed project meets the intent of the City's Comprehensive Guide Plan, serves to
further economic development objectives of the City and esta.blishes a framework for
improving traffic safety in relation to the regional transportation system. If the Concept Plan
receives favorable considera.tion by the Planning Commission and City Council, then the
necessary measures to proceed with MUSA expansion can be initiated along with further
project deta.ils necessary to support required development approvals.

Representatives for the development have indicated they aze unable to secure an agreement at this
time due to delay in a legal process. Therefore, they are formally requesting an amendment to this
condition that would permit phases 1 and 2 to proceed with final platting and rezoning prior to
procuring an agreement for the railroad spur relocation. Mr. Reid Hanson, local legal counsel, and
Mr. Glenn Sexton, Director of Construction CMC Heartland Partners, were in attendance and
provided a brief history of the project and explained that a federal court process has delayed progress
in securing resolution to the railroad spur issue.
There were no further comments from the audience. Vice-Chair DeBettignies cicsed the public
hearing at 7:00 p.m.
City staff maintains that the spur has a substantial impact on the overall design of the planned unit
development and, without assurance of its relocation, the design of the development as a whole
would be in jeopardy. Staff has determined that no significant changes have occurred in the factors
surrounding this approval condition that would warrant its modification or removal and, therefore,
recommends the applicant's request for a PUD amendment request be denied.
The Commissioners discussed the request at length with Commissioners Droste, DeBettignies, and
Tentinger concurring that, with no verbal or written communication from the CP Rail indicating their
support of and assurance as to the relocation of the railroad spur issue, they were unwilling to risk
the chances that this situation may not be resolved in a timely manner. Commissioner Ingram sta.ted
her position that this development is a positive step that will provide economic support to the City of
Rosemount.

Vice-Chair DeBettignies opened the public hearing to hear testimony regarding a development
proposal from Koch Refining Company for their property situated near the northwest intersection of
County State Aid Highway (CSAH) 42 and State Trunk Highway (STH) 52. The recording secretary
has placed the Affidavit of Publication and Affidavits for Mailing & Posting of Public Hearing
Notice on file with the City.
Senior Planner Andrew Mack reviewed the development proposal from Koch Refining Company to
provide Wayne Transport trucking with a new facility on approximately 15 acres of a 55-acre tract
currently owned by Koch (former Dunn farm). Koch Refining Company has advised they are
interested in acquiring the existing Wayne Transport buildings and property located in Inver Grove
Heights to accommodate their immediate fire station needs. Approval of this proposal will require
the following: 1) Minor Comprehensive Guide Plan Amendment to add approximately 15 acres of
land into the Metropolitan Urban Service Area (MUSA); 2) a rezoning from AG Agriculture to IG
General Industrial a major portion of the proposed site; 3) the planned unit development (PUD)
procedure is required for the multiple buildings proposed for the single parcel and a phased
development; and 4) approval of a preliminary and final plat for subdivisian and re-subdivision of
the land.

Hany Johnson, consultant, and Phillip E. Kairis, project engineer, for Koch Refming Company
were present in the audience and presented a brief overview of the project and discussed general site
plan issues. They responded to several comments from the audience as well as the Commissioners.
Myron Napper, 3381 145th 5treet East, and Elroy Sell, 2975 145th Street East, were both in the
audience and both expressed their concerns regarding the temporary access to County State Aid
Highway 42 indicating their objection for the proposed temporary, as well as future frontage road,
access point to CSAH 42. Specifically, they discussed whether or not safety issues had been
considered regarding the proposed intersection in relationship to the existing STH 52/CSAH 42
intersection to the east.
Dennis Ozment, 3275 145th Street East, advised that the proposed alignment of the service road
would impact buildings on his property. However, in his capacity as State Representative, Mr.
Ozment advised he had some involvement in the STH 52/55 corridor improvement process and
expressed his belief that the long term plan of this PUD appears to accommodate alignment of a
planned frontage road along State Trunk Hi?hway 52 which will ultimately provide for an improved
and safer working environment and vehicular movement for the area. Details for temporary and
final access issues can be addressed as development proceeds based on requirements and comment
from both the counry and state highway departments.
There were no further comments from the audience.
Vice-Chair DeBettignies closed the public hearing at 8:35 p.m.
Senior Planner Mack advised that the proposed project is consistent with the intent of the City's
Comprehensive Land Use Plan for industriai development of this property, therefore, rezoning to IG
General Industrial is appropriate. The PUD also provides opportunities for the attraction of new
business and the retention and e;cpansion of an existing business in this area of the region which will
expand employment opportunities and increase and diversify the City's tax base.
Commission members discussed the proposed development at length. The major issue identified was
a safety issue for proposed temporary access in the close proximity to the major CSAH 42/STH 52
intersection. The Commissioners were in support of the project, but concurred that further review
and additional study regarding the safety issues of temporary access, temporary frontage road
location, and interchange be conducted by the County Highway Department.
MOTION by DeBettignies to recommend to the City Council approval of a Minor Comprehensive
Guide Plan Amendrnent adding ( no MUSA land trade) approximately 15 acres to the City's existing
Metropolitan Urban Service Area, subject to approval by the Metropolitan Council. Second by
Ingram. Ayes: Droste, DeBettignies, Tentinger, Ingram. Nays: 0.
MOTION by DeBettignies to recommend to the City Council approval of a rezoning for

acres of the site from Agricultural to General Industrial; and
W�IEREAS, water and sewer utility services are within close proximity to the site; and
WIiER�AS, transportation facilities in the immediate area provide sufficient capacity to
accommodate the needs of proposed development with proper connections; and
WHEREAS, the Rosemount Comprehensive Guide Plan anticipates the need to provide
urban level services in the proximity of C.S.A.H. 42 and S.T.H. 52 and this site is contained
within this area as identified in the plan; and
WHEREAS, the City of Rosemount has reviewed and compared its anticipated vs. actual
sewer demand for the Rosemount Wastewater Treaxrnent Plant and has concluded that there
is sufficient capacity to accommodate projected flows from the proposed development; and
WHEREAS, the Planning Commission reviewed and recommended approval of the Minor
Comprehensive Guide Plan Amendment during a public meeting conducted on 7une 13,
1995; and
WHEREAS, a Public Hearing has been conducted by the City Council to hear testimony
regarding the concept planned unit development in accordance with the policies as set forth
in the Rosemount Comprehensive Guide Plan; and
VVHER�AS, the proposed project will provide the opportunity for sound economic
development activities by retaining and expanding employment availabiliry in this azea of the
