Ma.rlin Rechtzigel are requesting an Agricultural lot division of 90 acres on the southwest corner of CSAH 42 and STH 52 . The division would create a separate ten-acre parcel for their house and a large shed with the remaining 80 acres containing the farm buildings that would be acquired by their son. The division is dependent upon three variances. The Planning Commission, acting as the Board of Appeals and Adjustments, heard the request at a public hearing conducted on May 9 , 1995 . The petitioned lot width and two side yard setback variances were denied after considerable discussion by the Board. The Board was unable to find hardship which would support the granting of the variances as required by ordinance. Furthermore, the petitioner was unwilling to explore alternatives suggested by both the Board and staff that may have reduced the number of variances . The petitioner� s desire to maintain a ten-acre parcel for strictly purposes of tax relief was viewed as an abstraction and not a hardship. The Planning Commission recommended denial of the division of the basis of the denied variances. Mr. and Mrs. Rechtzigel have chosen to appeal the variance decision to the City Council . Approval of the division is only possible if the City Council overturns the denial made by the Board of Appeals and Adjustments . If the City Council overturns the denial, then the Council may approve the division with conditions . A public hearing has been recommended to be scheduled for June 6, 1995 for Council consideration of the appeal. Action regarding the division should be postponed until after the appeal public hearing. Therefore, the recommended action is to open the public hearing for the Rechtzigel agricultural division and continue the hearing until June 6, 1995 at which time the appeal can be acted upon. Recommended Action: A MOTION to continue the public hearing for the Rechtzigel Agricultural Division until June 6, 1995 .
