WHEREAS, on August 1, 1995 the City Council of the City of Rosemount approved of the concept for a residential planned unit development on property currently refened to as The Dodd Triangle"; and WHEREAS, on August 22, 1995 the Planning Commission of the City of Rosemount recommended approval of the final concept for a residential planned unit development and preliminary plat on property currently referred to as "The Dodd Triangle"; and WHEREAS, the proposal is in conformance with the R-2 Single Family Residential District density standards; and WHEREAS, on September 19, 1995 the City Council held a public hearing in accordance with the City of Rosemount Zoning Ordinance and State Statutes. NOW, THEREFORE, BE IT RESOLVED, the Ciry Council of the City of Rosemount hereby approves the final concept plan for the residential planned unit development and preliminary plat on property as legally described above subject to: ' L incorporation of engineering recommendations relative to grading and utilities plans and ponding capacity into the final development plan; 2. execution of a pre-assessment agreement to provide funds in the amount of$65,070 for the developer's share of future improvements on Dodd Blvd with the p that should the City acquire Outlot C for public use, the amount would be reduced to 44,670.00•r � ► 3. execution of a pre-assessment agreement to provide funds in the amount of$6,365.00 for the Developer's share of trunk water main improvements if the water m�installed as a public (chap. 429) improvement or the Develo per will b e r e i m b u r s e d f o r o v e r s i z m g o f t h e t r u n k w a t e r main from core funds if the water main is privately installed; 4. execution of a pre-assessment agreement to provide funds in the amount of$21,054.00 for the Developer's share of future trail improvements on Dodd Blvd., with the provision that should the City acquire Outlot C for public use, the escrow amount would be reduced to $14,450.00; —� 5. MY COMMISSION EXPIREB 1•31•Ob ���w��� Qlty of Ro�emonot Daican Coonty.lYBnom�o�a !/11 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1995 - A RESOLUTION DECLARING COST TO BE ASSfSSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT 145TH STREET IMPROVEMENTS - CHILI AVENUE TO CAMEO AVENUE CITY PR4JECT #245 �; WHEREAS, a contract has been let for 145th Street Improvements - Chili Avenue to Cameo Avenue, and the contract price for such improvement is 5684,652, and the expenses incurred or to be incurred in the making of such improvement amount to 5119,762 so that the total cost of the improvement will be 5804,414. NOW, THEREFORE, BEJT RESOLVED by the City Council of Rosemount Minnesota: 1 . The portion of the cost of such improvement to be paid by the City is hereby declared to be 5751,914 and the portion of the cost to be assessed against benefited property owners is declared to be S 52,50Q. 2. Assessments shalf be payable in equal annual installments extending over a period of -- 10 years, the first of the installments to be payable with general taxes for the year 1995, and shall bear interest at the rate of 2% points per annum above the interest rate paid by the City for its bonds from date of the adoption of the assessment resolution. 3. The City Clerk, with the assistance of the Public Works Director shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcet of land within the district affected� without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection; and BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: 1 . A hearing shall be held on the 17th day of October, 1995, in the City Hall at 8:00 p.m., or as soon thereafter as possible, to pass upon such proposed assessment and ; at such time and place all persons owning property affected by such improvement wilt be given an opportunity to be heard with reference to such assessment. 2. This Public Hearing is necessary to review the final development plan containing revisions to the Wensmann proposal for townhouse development in the 18.5 acre area known as the "triangle" between 145th street West, Shannon Parkway and Dodd Blvd. A public hearing is also required for the associated preliminary plat that will ultimately define street right-of-way, lots and blocks for two homeowner associations and the designated park land. The land that would become a fire station will be included with the PUD but initially platted as an outlot. Development of the outlot would occur as a future phase if the City does not acquire the parceL PLANNING COMIVIISSION REVIEW The Planning Commission reviewed and recommended approval of the revised final development plan on August 22, 1995. The plan had been revised to reduce the number and scope of variances related to the park and setbacks for buildings and driveways/parking areas. Concerns were expressed regarding the drainage and ponding issues, but the City Engineer and the Developer were continuing to work together to resolve the issues. The Developer and the City have had subsequent discussions regarding the amounts of the pre- assessments, particularly with regard to the cost of improving Dodd Blvd. The Developer is attempting to balance the relatively high cost of land acquisition against a comparatively low "mark up" for the townhouse units based upon adjacent established neighborhood patterns. The pre-assessment funding mechanisms have been standard practice in the City for several years. The need for funding future street improvements that benefit developments is not met by the existing assessment policy which only allows assessments against lots that directly front local streets. As a result, a "gap" exists in funding for streets such as Dodd Blvd., Diamond Path and other streets that are not intended to provide direct driveway access but have limited eligibility for other funding sources. Acquisition of land for a fire station will reduce the amount of the pre-assessments for podd Blvd. as well as some of the utility issues. However, the cost of the land acquisition is apparently rising proportionately to offset the anticipated future street improvements. The alternative strategy would be for the City Council to waive some or all of the pre-assessment amounts in return for a purchase agreement that represents an equitable value for the fire station site minus the pre-assessment amounts. FINAL RESIDENTIAL PLANNED UMT DEVELOPIV�NT (PUD) AND PRELIIVIINARY PLAT FOR THE DODD BLVDISHAIYNON PKWY/14STH ST W "TRIANGLE" On August 1, 1995, the City Council approved the concept residential planned unit development (PUD) for Wensmann Homes Inc. on 18.5 acres between Dodd Blvd., Shannon Parkway and 145th Street West. The next step is to review the final development plan incorporating design refinements and final plat for the first phase of construction. The remaining issues to be resolved include refinements to the grading and utility plans; design refinements to facilitate emergency vehicle movements and creating a strategy to reserve a parcel for a new fire station pending a successful referendum. The City Council also approved to concept of a 1.5 acre "mini park" to resolve the park dedication issue. FINAL DEVELOPMENT PLAN: The PUD has been refined to enhance emergency vehicle movements by increasing driveway widths and turning radii. These refinements are consistent with previously identified concerns of the Fire Marshal. The concept plan wouid have required five foot building setback variances for the four buildings of block 4 to the park. The park has been downsized to 1.4 acres to eliminate the variance. Increasing the park back to 1.5 acres could be accomplished by moving the two eastern buildings (units 9-16) eight to ten feet to the east and enlarging the frontage along the public street. Grading, ponding and utility issues require further refinements. The holding capacity of the pond will have to be enlarged and discharge controlled as the water is conveyed into the system that includes Carrollton Second addition. The City Engineer has attached specific recammendations for conditions for grading, utilities and Dodd Blvd. reconstruction. PRELIMINARY PLAT: The project will be platted into four blocks and three outlots. Separate associations will be created for the two townhouse types. Block arrangements will relate to the two associations . The property anticipated for the fire station will be separated from block three and designated as outlot C. If the referendum fails, then outlot C could be developed for residential uses as a future phase. Outlot A will be designated for park use and block 4 is anticipated to be platted as outlot B in anticipation of a second phase. Final plats will be required for the first phase and anticipated next year for subsequent phases. � v�r�e�,��i�va�, �,r�,���z a ,�,�.�,w ,,.�«,,:. August 22, 1995 Planning Commission Reviews � Wensmann Final PUD/Preliminary Ptat ("Triangle") Page Two LANDSCAPING: The preliminary landscape plan indicates quantities of materials substantially above the minimum requirements. Essentially twice the minimum requirement of 111 trees is being provided for by a combination of evergreen, ornamental and shade trees. Foundation plantings for the dwellings are also being provided. REZOlvING: The park area will have to be rezoned to PB Public / Quasi Public from R-2 Single Family Attached Residential. The fire station parcel would also be rezoned to PB if the referendum is passed and the parcel is acquired by the City. These rezonings should occur at the time of final plat approval. VARIANCES: Front yard setback variances for the private driveways have been identified along Dodd Blvd.(12 feet); 145th Street West (10 and 15 feet); and along the private driveway between the deck homes and the single story housing types. Other minor variances for small parking areas can be eliminated with design adjustments. The 11 unit cluster in the north western corner is 26 feet from the proposed right-of-way for the public street. The resulting four foot encroachment should be eliminated by attaching the single end unit to another cluster that is less confined. Much of the driveway encroachment west of the pond area will either be consumed by fire station development or reduced by design refinements. The driveway encroachments east of the pond can be mitigated by extensive plantings in the 18 feet area separating the bituminous trail along Dodd Blvd. and the interior driveway. FINDINGS: In approving the Concept plan, the Planning Commission must find as follows and forward its findings to the City CounciL 1. The Plan provides sufficient useabie open space and evidences aa substantial preservation of natural features to warrant the granting of variances through Planned Unit Development. The Plan includes a 1.S acre parcel that will be available for park development. The property is currently being used for agricultural production and therefore, has no natural features that warrant preservation other than the imponation of landscaping. 2. The Plan complies with the intent of the Comprehensive Guide Plan. The comprehensive guide plan land use designation is high density residential (HR). The proposed densiry of the development equals the minimum density requirements for HR. 3. The proposed development will not be detrimental to surrounding properties. No evidence has been presented to the Planning Department that would suggest that the proposed PUD would be detrimental to surrounding properties. 4. The Plan is more creative and will provide a better living, working, or shopping environment than is possible under strict ordinance requirements. The staggered building design relationship presented by the deck home clusters provides a variation of building facade that is aesthetically superior to existing building rypes in the immediate viciniry. The minor setback encroachments created by the driveways are reasonable tradeo�`'s for the building � and street design that eliminates or reduces grid relationships and contributes to perceptual daversiry.
